감염병의 예방 및 관리에 관한 법률에서는 예방접종에 따른 피해가 발생한 경우 예방접종약품의 이상이나 예방접종 행위자 등의 과실 유무에 관계없이 그에 대한 보상을 받을 수 있는 길을 열어놓으면서, 질병관리청장이 예방접종과 피해 사이의 인과관계 유무에 관하여 결정하도록 하고 있다.
그동안 예방접종과 피해 사이의 인과관계를 인정하지 아니하는 질병관리청장의 결정의 취소를 구하는 행정소송이 거의 제기되지 아니하였고, 이에 따라 법원에도 축적된 판례가 거의 없는 상황이다. 그러나 2021년 현재 희망하는 전 국민을 대상으로 코로나19 백신 예방접종이 진행 중이므로 향후 이와 관련된 국가보상 신청 건수가 급증하고, 질병관리청장의 인과관계 불인정결정의 취소를 구하는 행정소송도 늘어날 가능성이 있다. 따라서 지금이 그 어느 때보다도 예방접종과 피해 사이의 인과관계 판단에 관한 정밀한 검토가 필요한 시점이라고 할 것이다.
이와 관련하여 기존에 대법원은 예방접종과 피해 사이의 인과관계 인정에 관한 질병관리청장의 결정의 법적 성격을 재량행위로 보면서, 질병관리청장의 위 결정은 가능한 한 존중되어야 하고, 법원으로서는 질병관리청장이 주어진 재량권을 일탈·남용하였는지 여부만 심사해야 한다고 판시한 바 있다. 그러나 예방접종과 피해 사이의 인과관계 인정에 관한 질병관리청장의 결정의 근거가 된 법규의 체재·형식과 문언, 위 결정이 속하는 행정 분야의 주된 목적과 특성, 위 결정 자체의 개별적 성질과 유형 등을 종합적으로 고려하였을 때, 질병관리청장의 위 결정의 법적 성격을 재량행위가 아니라 기속행위로 파악하고, 완전심사 및 판단대체방식을 적용하여 질병관리청장의 위 결정에 대해 보다 엄격한 사법심사를 하는 것이 바람직하다고 생각한다.
나아가 질병관리청장의 인과관계 불인정결정의 취소를 구하는 행정소송에서는 예방접종과 피해 사이의 인과관계에 관한 증명책임을 적절히 완화하고 있는 기존의 대법원 판례의 판단 기준을 원칙적으로 적용하되, 다만 코로나19 백신처럼 신종 감염병에 대응하기 위해 개발된 백신의 경우에는 단기간의 백신 개발과정 및 완화된 승인·허가 심사절차로 인하여 안전성에 대한 지속적인 우려의 시선이 있다는 점과 해당 백신의 예방접종 후 어떠한 중증의 피해가 발생할 가능성이 있고 그 발생확률이 어떠한지 빠른 시일 내에 정확하게 파악하는 것이 상당히 어렵다는 점을 추가로 고려해야 한다.
Infectious Disease Control and Prevention Act requires the Commissioner of the Korea Disease Control and Prevention Agency to decide whether there is a causation between vaccination and damage, regardless of abnormality of the relevant vaccine, or negligence of the person who performed vaccination, etc.
In the meantime, few administrative lawsuits have been filed against the decision made by the Commissioner of the Korea Disease Control and Prevention Agency that does not recognize the causation between vaccination and damage. However, as of 2021, the number of applications for state compensation will increase rapidly due to Covid-19 vaccination, and the number of administrative lawsuits seeking cancellation of the decision made by the Commissioner of the Korea Disease Control and Prevention Agency which denies the causation between vaccination and damage will also increase shortly. Therefore, I believe that now is the time to review some of the issues regarding causation between vaccination and damage.
The Supreme Court of Korea previously ruled that the legal nature of the decision made by the Commissioner of the Korea Disease Control and Prevention Agency regarding the causation between vaccination and damage is a discretionary act, and that it should be respected as much as possible, and that the court should only examine whether the Commissioner of the Korea Disease Control and Prevention Agency has deviated or abused its discretion. However, considering the form and wording of the law on which the above decision was based, the main purpose and characteristics of the administrative field to which the above decision belongs, and the individual nature and type of the above decision, I think that the legal nature of the decision made by the Commissioner of the Korea Disease Control and Prevention Agency regarding the causation between vaccination and damage should be identified as a non-discretionary act, rather than a discretionary act, and that the court should conduct a more strict judicial review of the above decision.
In principle, the court should apply the judging criteria which were made clear by previous Supreme Court cases, which properly relaxes the burden of proof regarding causation between vaccination and damage in the course of administrative litigation. However, in the case of vaccines developed to cope with new infectious diseases, such as the Covid-19 vaccines, it is important to consider that there are continuous concerns about the safety of those vaccines due to the short-term vaccine development process and the application of emergency use authorization procedures. And in such cases, it is also important to consider the fact that it is quite difficult to fully understand what kind of severe damage can be caused by such vaccination, and that it is also difficult to figure out the probability of such severe damage within a short period of time.
