이번 레깅스 판결(2019도16258)로 인해 카메라 등 이용촬영죄의 해석은 새로운 전기를 맞이하였다고 볼 수 있다. 단순히 신체 부위의 성적 상징성을 판단하는 단계에서 사회적·규범적 의미에서 성적 상징성을 판단하는 단계로 나아간 것이다. 기존의 판례에서 진일보하여 카메라 등 이용촬영죄의 보호법익인 성적 자유는 소극적으로 자기 의사에 반하여 성적 대상화가 되지 않을 자유이며, 여기에는 공개된 장소에서 자신의 의사에 의해 노출된 신체도 함부로 촬영당하지 않을 자유도 포함된다고 본 것이다. 나아가 성적 수치심에는 다양한 형태와 층위가 있으므로 분노와 공포의 경우에도 피해자의 처지와 관점을 고려할 때 성적 수치심이 유발되는지 신중하여야 한다고 보았다. 그 결과 레깅스를 착용한 사안의 경우도 카메라 등 이용촬영죄가 성립할 수 있다는 것이다.
대법원의 이같은 새로운 변화에는 변화된 대중의 성의식과 성적 가치관을 투영하는 작업도 동반되어야만 한다. 2008년 대법원이 구체적 판단 기준을 제시한 이후, 카메라 등 이용촬영죄가 성폭력처벌법에 규정된 이후로 13년에 가까운 시간이 흘러 성적 상징성 등 규범적 현실에 많은 변화가 있었기 때문이다. 성적 자유에 공개된 장소에서 자신의 의사에 의하여 드러낸 신체 부분이라도 함부로 촬영되지 않을 권리가 포함된다는 것은 타당하다. 그러나 카메라 등 이용촬영죄의 구성요건은 단순히 동의 없는 비동의촬영을 규정하고 있는 것이 아니다. 레깅스 판결의 사안과 같은 사례들에 대한 처벌의 필요가 인정된다면 해석으로 그 한계를 뛰어넘을 것이 아니라 카메라 등 이용촬영죄를 비동의촬영을 처벌하는 형태로 개정하든가 공개된 장소에서의 도촬행위를 처벌하는 새로운 조문의 입법작업을 추진함이 타당한 해결방법이라고 생각한다.
아무리 정교하더라도 법원의 해석이 입법이 되어서는 안 된다. 향후 카메라 등 이용촬영죄의 보호범위에 대한 논란은 더욱 거세질 것으로 보이며, 그 결과 현행 조문의 개정에 대한 요구도 커질 것이다. 이제는 대법원의 정교한 판단 기준도 그 수명이 다했음을 인정하고 해석지침의 한계를 극복할 새로운 해결책을 찾아야 할 시점이다.

It is reasonable to revise the crime of voyeurism in the form of punishment for non-consent shooting or to promote the legislative work of a new article punishing voyeurism in public places.
No matter how elaborate, the interpretation of the court should not be legislative. In the future, the controversy over the scope of protection for voyeurism is expected to intensify, and as a result, the demand for revision of the current provisions will also increase. Now is the time to admit that the Supreme Court's judgment standards have reached the end and find a new solution to overcome the limitations of the interpretation guidelines.
