1. Ⅱ. 2.에서 보는 것처럼, ‘시ㆍ도지사’ 또는 ‘시장ㆍ군수ㆍ구청장’이 보건복지부장관 또는 질병관리청장이 전국에 적용되는 행정처분을 따를 의무가 없는 것으로 보인다. 대신에, Ⅱ. 2.에서 보는 것처럼, 지방자치법 제166조 제1항, 제169조 제1항 또는 제171조 제1항에 의하여, 보건복지부장관, 질병관리청장이나 특별시장, 광역시장, 특별자치시장, 도지사, 특별자치도지사는 시ㆍ군 및 자치구의 사무에 관하여 조언 또는 권고하거나 지도할 수 있으며, 이를 위하여 필요하면 시ㆍ군 및 자치구에 자료의 제출을 요구할 수 있고, 보건복지부장관이 시ㆍ도지사에게, 시ㆍ도지사가 시장ㆍ군수ㆍ구청장에게 주식회사의 임시주주총회 소집제한 또는 금지에 관한 처분을 기간을 정하여 서면으로 시정할 것을 명하고, 그 기간에 이행하지 아니하면 이를 취소하거나 정지할 수 있고, 보건복지부장관, 질병관리청장이나 특별시장, 광역시장, 특별자치시장, 도지사, 특별자치도지사는 시ㆍ군 및 자치구의 자치사무에 관하여 보고를 받거나 서류ㆍ장부 또는 회계를 감사할 수 있다. 생각건대 보건복지부장관이나 질병관리청장 등 중앙행정기관의 장이 전국에 공통되는 행정처분을 하고 싶으면, 감염병예방법에 그 근거규정을 두면 법적으로 확실해질 것으로 본다.
2. 충청남도 공고 제2021-4호(사회적 거리두기 2단계 연장에 따른 방역조치 변경 행정명령 공고)를 보면, 처분대상이 충청남도 내 15개 시ㆍ군 전역이고, 행정명령 등 별도 조치를 발령한 시ㆍ군은 그 조치에 따르고, 시ㆍ군별로 상황에 따라 추가 방역 강화조치가 가능하지만, 완화된 조치는 불가하다고 기재되어 있다. 그러나 (ⅰ) 감염병예방법에 충청남도 내 시ㆍ군이 충청남도의 행정명령(임시주주총회의 소집 제한 또는 금지)을 따라야 된다는 내용이 없는 것으로 파악되고, (ⅱ) 지방자치법 시행령 제8조 관련 별표 1에 의하면 코로나 19를 예방하기 위한 사무(임시주주총회의 소집 제한 또는 금지)가 시ㆍ도와 시ㆍ군 간에 유사하고, (ⅲ) 지방자치법 제9조 제1항, 제9조 제2항 본문 제2호 바목, 제10조 제3항에 의하여 충청남도 내 15개 시ㆍ군이 충청남도의 행정명령을 따라야 되는 것이 아니라 자신의 시ㆍ군의 행정명령에 따라 임시주주총회의 소집 제한 또는 금지를 할 수 있는 점에서 볼 때, 충청남도 내 15개 시ㆍ군이 충청남도의 행정명령과 다른 행정명령을 발령할 수 있고, 충청남도의 행정명령에 완화된 조치가 불가하다고 기재될지라도 충청남도 내 15개 시ㆍ군이 완화된 조치(임시주주총회의 소집 제한 또는 금지)를 내릴 수 있는 것으로 사료된다. 생각건대 감염병예방법에 “시장ㆍ군수ㆍ구청장이 시ㆍ도지사의 행정처분과 다른 행정처분을 할 수 있다. 그리고 시장ㆍ군수ㆍ구청장이 시ㆍ도지사의 행정처분보다 완화된 행정처분을 할 수 있다.”는 근거규정을 두면 법적으로 확실해질 것으로 본다.

Prevention” in the jurisdiction.

Si/Do, Si/Gun, and Autonomous Gus must ensure that they do not compete with each other when dealing with business affairs, and when business affairs compete with each other, the Si/Gun and Autonomous Gu handle it first(Article 10, Paragraph 3 of the Local Autonomy Law). The ordinances or rules of Si/Gun and Autonomous Gus shall not violate any ordinances or rules of the Si/Do(Article 24 of the Local Autonomy Law).
