본 논문은 현행 「공동주택관리법」상 공동주택을 총괄 관리하는 관리주체로서 관리사무소장의 관리업무에 대한 법적 지위와 그 범위를 검토하고, 주요 문제점과 한계를 분석하여 법적 개선방안을 도출・제시하고자 하였다. 이로 인해 보다 체계적이고 효율적인 공동주택관리체계가 구축될 수 있는 것에 목적을 두었다. 본 연구의 연구방법은 문헌조사 방식이다. 2019년 현재 우리나라 전 국민의 77% 이상이 거주하고 있는 공동주택의 관리에 있어서 가장 중요한 목적인 입주자의 안전과 재산, 권익을 보호하기 위해서는 투명하고 효율적이며 체계적・전문적인 관리가 필수적으로 요구된다. 이를 위해서는 관리사무소장이 입주자대표회의 및 그 회장, 기타 입주자 등의 부당한 간섭이나 갑질에서 벗어나 관계법령 규정에 입각하여 소신 있는 관리를 할 수 있도록 신분 및 임기의 보장이 이루어지는 등 강력한 법적・제도적 뒷받침이 이루어져야 할 것이다. 이러한 법적・제도적 기반의 확충을 위해서는 「공동주택관리법」 등 관계법령의 개정, 「(가칭)주택관리사법」의 신규 제정 등 법제도 개선이 시급히 선행되어야 한다. 아울러 공동주택에 거주하고 있는 입주자 등과 그들을 대표하는 기구인 입주자대표회의의 공동주택관리자에 대한 인식과 문화 또한 근본적으로 바뀌어야 할 것이다.
This paper examines the legal status and scope of duties of head of management office of multi-family housing, a major management entity, and analyzes major problems and limitations of the multi-family housing management system under the current 「Multi-family Housing Management Act」. In this regard, this study devises legal strategies for improvement so as to establish a more systematic and efficient multi-family housing management system. As of 2019, more than 77% of all Koreans reside in multi-family housing, in which transparent, efficient, systematic and professional management is essential in order to protect the safety, property and rights of the occupants, which is the most important purpose of management of multi-family housing. To this end, strong legal and institutional support for the guarantee of status and term of office must be provided so that the head of the management office is able to manage with confidence based on the relevant laws and regulations, free from unreasonable interference or abuse from the council of occupants’ representatives. In order to expand the legal and institutional basis for this purpose, it is necessary to modify and improve the current legal system, including the revision of relevant laws such as the 「Multi-family Housing Management Act」 and the new enactment of the (tentatively named) Housing Managers Act. In addition, the perception and culture of the occupants who reside in multi-family housing and their representative entity, the council of occupants’ representatives, should be fundamentally changed.
