의료법은 의료인이 아닌 사람의 의료행위를 금지할 뿐만 아니라 의료인일지라도 면허된 것 이외의 의료행위를 하는 것을 금지하면서 양자를 동일하게 무면허 의료행위로 형사 처벌할 수 있도록 하고, 이를 위반한 의료인에 대하여서는 직업 수행에 대한 중대한 제재처분도 가할 수 있도록 한다. 그런데 의료법 등 관계 법령에는 ‘의료행위’의 정의나 의료인에게 ‘종별로 면허된 의료행위’의 내용·범위 등을 적극적으로 정하는 규정이 없어 이는 법 해석·적용의 영역으로 광범위하게 남아있다. 따라서 의사 등에게 예견가능성과 행동지침을 제공할 수 있도록 ‘면허된 것 이외의 의료행위’ 해당 여부에 관한 판단 기준을 정립하는 것은 중요하다.
이 글은 양·한방의 이원적 의료체계하에서 의사 등의 의료행위가 ‘면허된 것 이외의 의료행위’에 해당하는지 여부에 관한 판단 기준의 정립 방향에 관한 연구이다. 근래 한의사의 의료기기 등 사용을 둘러싸고 양의사와 한의사 간의 직역 갈등이 고조되고 있으므로, 의료기기 등을 사용한 한의사의 의료행위를 중심으로 검토한다.
대법원판결 등에 대한 분석을 토대로 위 판단 기준의 바람직한 정립 방향을 모색하여 보면, 의사 등의 ‘종별로 면허된 의료행위’ 범위의 가변성과 중첩 가능성을 인식의 토대로 삼고, 국민의 건강 보호와 증진에 중점을 두어 해당 의료행위에 보건위생상 위해 우려가 있는지 여부를 가장 우선적으로 고려하여야 하며, 만일 보건위생상 위해 우려가 없다면 양·한방의 독자적 발전이라는 목표는 보다 포용적인 관점에서 달성하는 것이 타당하다. 일련의 의료행위 중에서 진단결과를 도출하기 위한 정보 수집 및 해독 과정의 경우, 그 과정에 보건위생상 위해 우려가 없다면 의사 등이 다양한 정보를 토대로 삼아 진단결과를 도출하는 것은 의료서비스 수준 향상에 이바지할 뿐만 아니라 의료전문가인 의사 등의 전문적인 자율성의 영역을 존중하고 의료소비자의 의료서비스 선택권도 보장하여 줄 수 있으므로, 그 정보 자체의 학문적 원리를 기준으로 의사 등에게 그 사용을 금지하는 것은 타당하지 않다. 이는 정보 수집 및 해독 과정의 일환으로 진단용 의료기기 등을 사용하는 경우에도 마찬가지이므로, 진단용 의료기기 등 사용에 보건위생상 위해 우려가 없다면 진단결과·치료행위를 포함한 일련의 의료행위의 경위·목적·태양을 고려하여 해당 의료행위 전체와 양·한방의 학문적 원리의 관련성을 검토하여야 한다. 이때 진단용 의료기기 등 사용에 보건위생상 위해 우려가 없다는 것은 그 사용행위 자체가 안전할 뿐만 아니라 해당 의료기기가 제공·산출하는 정보(검사결과)와 해독 과정에 의학적 신뢰성이 있음을 의미한다.
위와 같은 판단 기준을 적용하면, 한의사의 진단용 의료기기 등 사용범위를 확장하는 데 기여할 수 있을 것으로 보이고, 이는 양·한방이 의료공학기술의 발전에 따른 결실을 공유하면서 상호 더욱 수준 높은 의료서비스로 나아갈 수 있도록 함으로써 궁극적으로는 의료법의 입법 목적인 국민의 건강 보호와 증진에 이바지할 것이다.
The Medical Service Act, prohibiting medical practices done by medical practitioners beyond the scope of their own licenses as well as medical practices done by non-medical practitioners, punishes offenders. If offenders were medical practitioners, significant sanctions could be imposed on their licenses, too. As the Act and related legislation don’t define the details and scope of medical practitioners’ licenses actively, they are largely left for the realm of legal interpretation and application. Establishing the criteria for determining “medical practice beyond the scope of license”(hereinafter “the criteria”) is important to provide doctors with the possibility of foresight and guidelines.
This article does research on the criteria under the dual medical system of western and oriental medicine. As tensions between western and oriental medical doctors have been rising recently over the issue of oriental medical doctors’ use of medical devices, this article focuses on it.
The desirable criteria could be sought on the basis of analysis of the related legal principles set by the Supreme Court. First, there should be perception of the variable and overlapping scope of doctors’ licenses. Then, the criteria needs to prioritize whether there’s concern on public health, and if there’s none, the goal of individual development of western and oriental medicine has to be achieved in more inclusive ways. When it comes to information gathering and interpreting to make a diagnosis among the sequential medical practice, in case there’s no concern on public health, the character of the basis for information itself should not be the criteria. Allowing doctors to use various information before making a diagnosis contributes to the improvement of the medical service quality, respects doctor’s professional autonomy, and guarantees wide choices for the medical service consumers. Likewise, as long as there’s no concern on public health, the use of diagnostic medical devices deserves special approaches. On the premise that there’s no concern on public health, the sequential medical practice including the final diagnosis and treatments should be examined as a whole on the relevance to academic basis of western or oriental medicine. ‘No concern on public health’ herein means that the act of usage is medically safe, and the result provided by the diagnostic medical device and the interpretive process are medically credible.
Applying this desirable criteria will contribute to the expansion of diagnostic medical devices usage of oriental medical doctors, and to the improvement of the public health ultimately, by sharing the benefits from medical engineering technology advancement between western and oriental medicine.
