대상판결은 지금까지 허용되는지 여부가 불분명하였던 노동조합 설립무효 확인의 소 내지 노동조합 지위부존재 확인의 소가 명문의 규정이 없이도 민사상 ‘확인의 소’로서 허용된다는 점을 명확히 한 최초의 대법원 판례이다. 대법원이 대상판결을 통하여 위와 같은 형태의 민사소송이 허용됨을 천명함으로써, 법외노조 통보의 근거 규정이었던 구 노동조합 및 노동관계조정법 시행령(2021. 6. 29. 대통령령 제31851호로 개정되기 전의 것) 제9조 제2항을 더는 적용할 수 없게 된 법적 공백이 어느 정도 보충될 것으로 보인다. 나아가 교섭창구 단일화 제도하에서 복수 노동조합 중 어느 한 노동조합은 다른 노동조합의 설립무효 내지는 그 법적 지위의 부존재 확인을 구할 수 있는 확인의 이익이 인정된다고 판단한 점 역시 눈길을 끈다.
대상판결은 본안과 관련해서도 노동조합 및 노동관계조정법 제2조 제4호에 규정된 주체성, 자주성 등이 노동조합의 실질적 요건임을 명확히 하는 한편, 만약 이러한 요건을 흠결한 경우에는 해당 노동조합의 설립신고가 수리됨으로써 형식적 요건이 이미 구비되었을지라도 노동조합 및 노동관계조정법상으로는 그 설립이 무효이거나 노동조합으로서의 지위(헌법상 노동3권의 주체가 될 수 있는)를 갖지 아니한다는 점 역시 분명히 하였다는 점에서 의미가 크다. 나아가 대상판결이 노동조합의 설립이 무효인 경우에도 사후적으로 이러한 하자가 보완될 수 있음을 밝히면서, 이를 심리·판단하는 법원뿐 아니라 소송에 임하는 당사자가 유의하여야 할 사항에 관하여 상세한 지침을 남겼는바, 이 역시 주의 깊게 눈여겨볼 가치가 있다.
앞으로 대상판결을 계기로 노동조합 내부 및 사용자와의 분쟁을 실효적으로 해소할 수 있는 제도적 방안에 관하여 보다 많은 논의와 진전이 있기를 기대하여 본다.
The subject judgment is the first decision by the Supreme Court to clarify that a lawsuit for confirmation regarding invalidity of establishment of a trade union or the absence of a trade union status is permitted without express legal provisions. This is expected to fill some of the legal voids arising from inapplicability of Article 9(2) of the former Enforcement Decree of the Trade Union and Labor Relations Adjustment Act(amended by Presidential Decree No. 29950, Jul. 2, 2019), which had been the basis for the notification of non-legalization of a trade union. Furthermore, it is also noteworthy that the subject judgment made it clear that under the system of simplified bargaining window, one of multiple trade unions may file a lawsuit confirming that the establishment of other trade unions is invalid or that its legal status does not exist.
The subject judgment clarifies that workers’ initiative and independence stipulated in Article 2 Subparag. 4 of the Trade Union and Labor Relations Adjustment Act are substantial requirements for a trade union, and if these requirements are not met, the establishment of a union is considered invalid and its legal status as a trade union―which can be the subject of the three labor rights of workers under the Constitution―is denied, even if procedural and formal requirements for becoming a trade union are fulfilled by the acceptance of the report on the establishment of the union. Furthermore, the subject judgment revealed that these defects can be corrected afterwards even if the establishment of the trade union was invalid, and it left detailed guidelines on matters that should be noted not only by the courts for hearing and judgment but also by the parties involved in the lawsuit.
