국가는 펜데믹 상황 아래에서 코로나19의 대량 확산을 막기 위해 행정명령에 의해 종교의 자유에 대해 대체 어느 범위까지 제한을 가할 수 있을 것인가라는 궁극적인 문제의식에서 이 글은 출발한다. 따라서 우리나라의 종교의 자유는 헌법 제37조 제2항에 의해 제한이 가능하므로 그 기원을 둔 미국의 종교와 자유와 다른 의미로 해석되어도 괜찮은 것인지 아니면 미국 연방헌법 수정 제1조에서 근본적인 권리로 종교의 자유를 규정하고 있는 미국에서처럼 엄격한 보장에 방점을 두어야 하는 것인지와 같은 쟁점을 검토하기 위해, 이 글은 비교법적인 연구를 통해서 종교의 자유의 보장과 그 제한 및 제한의 한계에 관한 헌법해석에 필요한 시사점을 찾고자 한다. 특히 미국 연방헌법상의 종교의 자유 제한의 위헌심사 기준을 살펴보고, 코로나19 사태로 인한 위기상황에서 국민의 종교의 자유와 국민의 생명・신체의 보호 문제를 어떻게 양립시킬 것인지를 살펴보고자 한다. 그런 관점에서 미국 연방헌법 수정 제1조의 종교의 자유와 그 제한에 대한 엄격한 심사기준과 그 예외에 대해 검토하면서, 특히 각 주지사가 발령한 재택명령을 통한 종교 활동의 자유 제한과 그 한계에 관한 쟁점을 연방법원의 판례를 중심으로 살펴보기로 한다.
This article starts with the ultimate question of to what extent the state can impose restrictions on religious freedom by an executive order to prevent the mass spread of COVID-19 under the pandemic situation. Therefore, to examine issues such as whether it is okay to interpret religious freedom in a different sense than American religion and freedom, or whether it should focus on strict guarantees as in the United States, which stipulates religious freedom as a fundamental right. In particular, I would like to examine the unconstitutionality of the U.S. Federal Constitution's restrictions on religious freedom and how to balance the issues of people's freedom of religion and protection of their lives and bodies in a crisis caused by the COVID-19 incident. From that point of view, I will examine the strict scrutiny and exceptions to the freedom of religion and restrictions under the First Amendment to the U.S. Constitution, focusing on the U.S. federal court precedents, especially on restrictions and limitations on religious activities through Stay-at-Home Orders issued by governors.
