문재인 정부는 출범 초기 연방정부에 버금가는 지방분권을 내세우고, 헌법개정안을 발의하면서 지방분권과 지역균형발전에 관한 의지를 표하였다. 그러나 정치적 해법을 찾지 못하고 좌절하고 말았다. 그 대안으로 나온 것이 바로 지방자치법의 전면개정이다.
2021년 1월 13일 시행된 지방자치법 전부개정 법률은 1988년 전부개정 이후 33년 만에 이루어졌다. 이번에 개정된 지방자치법은 향후 지방분권특별법, 주민조례발안법, 중앙지방협력회의법, 지방공무원법, 교육훈련법 등 관계 법률과 대통령령 등 하위 법령의 제・개정 준비가 필요하다.
개정 법률의 주요 내용과 그에 대한 평가에 대해서는 비판이 주를 이룬다. 전반적인 체계와 내용에 대하여는 지방자치 기본법으로서의 법적 체계를 구축하는 종합적 안목이 부족했고, 자치입법권 및 자치조직권 등 지방자치의 핵심적 요소를 충분히 보장 하고 있지 않다는 것이다. 또한, 지방자치단체 기관구성 다양화 및 특별지방자치단체의 도입, 특례시에 관한 사항, 주민자치회에 관한 규정 등에서는 보다 면밀한 분석과 체계화가 필요했다는 비판이 있다. 그리고 지방자치단체의 자치권의 실질적 보장 미흡, 국가 우월적인 규범 구조, 즉 여전한 후견적 지방자치와 주민참여 제도화의 미흡을 지적하기도 한다. 그러나 주민조례발안제도, 중앙정부와 지방자치단체 및 지방자치단체 상호 간의 협력과 상생을 가능하게 하는 제도적 근거를 마련한 점 등은 높이 평가되어야 할 것이다.
필자는 오래전부터 우리 사회가 안고 있는 시대적 과제는, 경제적 양극화 문제의 해결, 지역 문제 그리고 통일이고 생각해 왔다. 그중 지역 문제를 해결하기 위한 마지막 수단은 지방분권형 헌법개정이라고 생각해 왔다. 지방분권과 지역균형발전이라는 두 문제를 해결하기 위해서는, 무엇보다도 분권화된 제도와 그에 기초한 정책이 중요함은 물론이다. 강력한 지방분권 정책의 실현으로 경제회복과 국민통합을 이루어나가고 있는 프랑스는 우리의 좋은 예가 되리라 생각한다.
자치와 분권의 문제는 제도와 법리 그리고 정책의 문제를 떠나 인간의 이기심과 욕망과도 연결되어 있다. 그러기에 더욱 어려운 과제이다. 그러나 이 문제를 해결하지 않고서 우리 대한민국은 진정한 선진국으로 나아갈 수 없다. 이에 분권형 헌법개정을 촉구하는 바이다. 이는 시대적 과제이자 우리 기성세대에게 주어진 숙제이다. 미온적인 지방자치법의 개정만으로는 이 큰 시대적 과제를 달성할 수 없다.
The Moon Jae-in government asserted their belief in decentralization and balanced regional development running parallel with those of a federal government in the early days of its inauguration by proposing the constitution revision proposal. This attempt, however, was frustrated due to their failure to find out political solutions. So what they came up with as an alternative was the complete revision of the Local Autonomy Act.
Completely Revised Local Autonomy Act which came into force in January 13, 2021 was a revision made in 33 years since its complete revision in 1988. This recently revised local autonomy act should require establishing and revising of various relevant laws including Special Act on Decentralization, Act on Inhabitant-Proposed Ordinances, Act on Meetings for Cooperation between Central and Local Governments, Local Public Officials Act and Education & Training of Local Public Officials Act and subordinate legislation such as executive orders.
Major points of the revised law have been criticized by many assuming a critical attitude toward it. They pointed out that the revised law lacked an all-seeing eye for establishing a legal system as a fundamental act on local autonomy and failed to sufficiently provide the core elements of local autonomy such as self-legislative power and self-organizing rights. Also pointed out was a lack of close analysis and structuring in providing stipulations in regard to diversifying local entity organization, introducing the Special Local Entity, matters relating to special cities and the citizen autonomy council. In addition, a lack of substantial realization of the local entity’s right of self-government and normative structure enabling state superiority, that is, still lingering ‘local autonomy under the guardianship’ and insufficiently institutionalized system for participation of residents were also pointed out. However, the revised law should be rated high in that it provides the institutional basis enabling the operation of the inhabitant-proposed ordinances system and co-existence/ cooperation between the central government and the local entity and between the local entities themselves.
The author has long upheld the notion that matters of polarization, regional development imbalances and unification are the important problem of the times, which should be solved by the people of this age. The author has concluded that the last means to get rid of regional development imbalances should be a constitutional amendment focusing on decentralization. It goes without saying that institutionalized decentralization and policy operation based on it should play a vital role in settling the two problems of decentralization and balanced regional development simultaneously. France set a good example in that they achieve the economic recovery and national unity by implementing powerful decentralization policy.
Issues of autonomy and decentralization are closely related to selfishness and desire of a man, not to mention its institutional and legalistic nature and policy implementation. This makes them all the more a difficult task to cope with. However, without solving these problems, Rep of Korea will not be able to achieve a target of being an advanced country in a real sense. The author therefore urges that a constitutional amendment focusing on decentralization should be made. That is the important problem of the times, which should be solved by the people of older generation of this age. Such great problem of the times can not be solved by a lukewarm revision of the Local Autonomy Act alone.
