이 글에서는 예방접종 의무화의 의미를 검토하고, 의무화된 예방접종 또는 미접종자에 대하여 불이익을 줌으로써 간접적으로 강제되는 예방접종 제도가 헌법적 정당성을 갖추기 위한 고려요소들을 살펴보고자 한다. 유럽 일부 국가는 코로나19 확산 이전부터 홍역 등 예방접종을 의무화하고 있었고, 코로나19 확산이 심각해지자 그 예방접종을 의무화하려는 움직임을 보이고 있다. 다른 국가 또는 지역의 예방접종 의무화 조치와 이와 관련한 판례나 입법례 등을 살펴보고, 이를 토대로 예방접종 의무화에 대한 헌법적 정당성을 검토하는 것은 향후 예방접종을 통하여 감염병 대응을 강화하는 데 좋은 참고가 될 것이다.
As the COVID-19 situation continues for a long time, it is difficult for each state to continue its quarantine measures in the form of a total blockade. Accordingly, each state is focusing its capabilities on improving herd immunity and preventing the collapse of the medical system by increasing the vaccination rate, instead of strengthening lockdown even if the number of confirmed cases increases.
Vaccination is a highly effective means to protect the life and health of individuals from infectious diseases and to block or mitigate the spread of infectious diseases. However, some individuals refuse to vaccinate because they do not trust the safety or effectiveness of the vaccine. Accordingly, some states attempt to impose vaccination as a legal obligation or indirectly force by giving disadvantages to unvaccinated persons. Mandatory vaccination not only limits the individual's right to self-determination but also limits other fundamental rights depending on specific circumstances.
This article reviews the meaning of mandatory vaccination. Next, through this article, the consideration factors for establishing the constitutional legitimacy of the vaccination system that are indirectly forced by giving disadvantages to unvaccinated persons or legally compulsory are examined. Some European states are making moves to make COVID-19 vaccination mandatory as the spread of COVID-19 becomes severe. They have made vaccinations such as measles compulsory before the spread of COVID-19. Reviewing the precedents, legislative cases, and policies of these regions or states in relation to mandatory vaccination, and further reviewing the constitutional legitimacy for the mandatory vaccination is a valuable reference for strengthening the response to infectious diseases through vaccination in the future.
