실무상 구속취소, 보석과 같이 신청의 철회에 대한 명문 규정이 없는 경우에도, 피고인이 신청을 철회하는 것을 인정하여 왔다. 이러한 실무례가 위법한 것은 아닌지 문제 된다.
이를 살펴보기 위해, 우선 형사소송에서의 소송구조론을 살펴보면, 직권주의와 당사자주의가 주장되고 있다. 우리 형사소송법은 위 두 가지 요소가 혼재되어 있다. 이 중에 당사자주의를 취할 경우 피고인 등 당사자의 주도적 지위를 인정하게 되므로 당사자에게 절차를 종결할 수 있는 권한까지 인정할 수 있을지 문제 된다. 그러나 피고인은 형사소송에서 절차의 대상으로서의 지위를 갖고, 피고인이 임의로 형사절차를 종료시킬 수 없다는 점에서 형사소송에서의 당사자주의를 민사소송에서의 처분권주의와 같게 볼 수는 없어, 당사자주의만을 근거로 피고인에게 신청에 대한 철회권이 인정된다고 보기는 어렵다.
결국 위와 같이 당사자주의를 처분권주의와 구별하는 소송구조론적 관점에서 보았을 때, 원칙적으로 명문의 규정이 없을 경우에는 당사자에게 절차종결권(철회권)을 인정할 수는 없다고 봄이 타당하다. 다만 명문의 규정이 없는 경우라도 당사자의 의사 존중, 실체진실주의 및 절차 안정 침해의 정도 등을 고려하여, 법원의 직권심리가 가능한 경우나 사적 법익을 추구하는 성격의 신청이거나, 같은 절차 내의 신청인 경우에는 피고인의 철회권을 인정할 수 있을 것이다. 이러한 기준에 따르면 현행 형사소송법에서 규정된 피고인의 신청권들은 명문의 규정이 없더라도 일단 모두 철회가 가능한 것으로 보인다.
그리고 철회가 가능한 시기와 관련하여서는, 재판의 농락 방지와 절차의 안정을 고려하여 피고인은 신청에 대한 법원의 결정이 있기 전까지 이를 철회할 수 있다고 보는 것이 타당하나, 재신청의 가능성 등을 고려하면 시기적 제한의 실익은 크지 않을 것으로 보인다.
향후 형사절차의 명확성을 위해서는 신청에 대한 철회권과 재신청에 대한 총칙적 성격의 제한규정을 명문화하는 것이 바람직하다.
In practice, a defendant’s withdrawal of an application, for example, for the suspension of execution of custody or for bail, has been admitted even when there is no express provision regarding thereto. The question is whether these practices are illegal.
The examination of the structure of criminal procedure theory to address this question requires a review of adversarial and inquisitorial procedures. Our criminal procedure law is a mixture of the above two elements. Among them, if you choose the adversarial procedure, the leading position of the parties, such as the defendant, is recognized, giving rise to a question of whether the party can even recognize the authority to terminate the proceedings. However, given that the defendant has the status as the subject of proceedings in criminal procedure and cannot terminate the criminal proceedings at will, the adversarial procedure in criminal proceedings cannot be regarded as the principal of disposition in civil lawsuits. Therefore, it is difficult to see that the right to withdraw the application is granted to the defendant.
In the end, from the point of view of the litigation structure that distinguishes the adversarial procedure from the principal of disposition, in principle, it is reasonable to think that the right to terminate the procedure (right to withdraw) cannot be recognized by the party in the absence of a substantive enactment. However, even in the absence of an explicit provision, in the case of an inquisitorial hearing by the court, in the case of the application which has the nature similar to a civil one, or within the same procedure, the defendant may exercise the right to withdraw. According to these standards, it seems that all of the defendant’s right to apply under the current Criminal Procedure Act can be withdrawn even if there is no explicit provision.
And with respect to the period of time within which it is possible to withdraw, it is reasonable to think that the defendant can withdraw the application before the court’s decision is made to prevent mischief in a trial and maintain stability of the procedure. However, considering the possibility of re-application, etc. the benefits of restrictions are not expected to be large.
To establish clarity of criminal proceedings in the future, it is desirable to stipulate the substantive enactment of the general nature of the right to withdraw the application and the re-application.
