조세법률관계는 국가와 납세의무자가 채권자·채무자로서 대립하는 공법상 채권·채무관계에 해당한다. 조세채무는 법률규정에 의하여 바로 성립하기 때문에, 그 성립에 관하여 과세관청은 재량권을 행사할 수 없다. 즉, 조세채무의 성립에 관한 과세관청의 모든 행정작용은 법률에 엄격하게 기속되어야 한다.
모든 법 영역에서 문리적/체계적/역사적/목적론적 해석과 같은 전통적인 해석방법론이 사용되는데, 구체적 사안에서 이루어지는 해석은 전통적인 해석방법을 토대로 하여 해당 영역을 규율하는 법률의 성격을 반영해야 한다. 예컨대, 형사법의 해석에 관하여 죄형법정주의 원칙을 우선시해야 하는 것과 마찬가지로, 세법의 해석도 위와 같은 전통적인 해석방법론을 토대로 하되, 헌법이 개인의 기본권을 보호할 목적으로 채택한 영국식 조세법률주의를 우선적으로 고려하는 방식으로 이루어져야 한다.
한편 ‘법률’의 해석과 ‘법률행위’의 해석은 해석방법론의 측면에서 같은 의미를 가진다. 또한 약관의 해석은 구조적으로 법률의 해석과 유사하므로, 세법해석에 관하여 약관통제에 관한 해석방법론을 원용할 수 있다. 즉, 세법조항의 경우 1차적으로 엄격한 문리해석을 해야 하고, 이를 토대로 제한해석의 원칙 등 다양한 기능적 해석방법론들을 적용하여 해당 세법조항의 일의적(一義的) 의미를 파악하기 위한 노력을 해야 하며, 이러한 과정을 거친 후에도 객관적으로 여전히 그 조항이 다의적(多義的)으로 해석되고 그 각각의 해석이 합리성이 있는 경우에는 해석통제단계의 마지막 시점에서 ‘의심스러우면 납세자의 이익으로’의 해석방법론이 적용된다고 봄이 타당하다.
모든 세법을 일반 국민들도 쉽게 내용을 파악할 수 있도록 만드는 것은 현실적으로 불가능하다. 그러나 세법의 내용이 지나치게 복잡하여 세법 전공 교수들조차 이해하기 어렵다고 공언하는 상황이 정상적이라고 할 수는 없다. 나아가 우리나라에서는 세무공무원이 모호한 세법조항을 일단 ‘적극적으로 해석’하여 ‘최대한’ 세금을 부과한다는 언론보도까지 나오고 있는데, 이러한 상황이 실제로 만연하고 있다면 이는 심각한 문제이다.
합헌으로 추정되는 세법에 대한 규범통제는 신중해야 하지만, 국회가 세법을 제정하거나 과세관청이 조세채무의 성립에 관한 각종 행정작용을 하는 과정에서 헌법이 규정한 조세법률주의에 위배되는 방향으로 공권력을 행사하는 것은 허용될 수 없다. 따라서 법원과 헌법재판소는 헌법상 조세법률주의의 취지를 반영하는 방향으로 세법을 해석하고, 사안에 따라 필수불가결한 규범통제를 하는 등 적절한 사법적 판단을 함으로써 개인의 기본권을 충분히 보호해야 한다. 국회의 입법은 헌법상 조세법률주의를 위반할 수 없고, 과세관청은 세법 및 관련 행정입법에 관한 규범통제를 할 수 없기 때문이다.
The legal relationship between the state and the taxpayer regarding taxes is equivalent to a debtor and creditor. Taxing authorities have no discretionary power to impose taxes because the enacted laws immediately establish tax liabilities. Therefore, all administrative actions of taxing authorities must be strictly bound by taxing statutes.
Under conventional interpretative methods, literal/systemic/historical/teleological interpretation must be applied for all legal areas. Furthermore, for specific cases, the interpretation must reflect characteristics of the regulatory law based on a conventional interpretative approach. For example, the principle of legality should be first considered in interpreting criminal law. The British style principle of ‘Taxation by Statutory Law’ (i.e., the principle of ‘no taxation without representation’) stipulated in the Korean Constitution protects individuals' constitutional rights and gives priority thereto. Likewise, to interpret tax law, the principle of ‘no taxation without representation’ must be given preferential consideration based on a conventional interpretative approach.
In a basic framework, the interpretation of laws and contracts applies the same interpretation methodology. The interpretation of the terms and conditions is structurally similar to interpreting laws, which allows the tax laws to be interpreted as the terms and conditions. Thus, the literal approach to interpretation should be the starting point to interpret a tax-law provision. In other words, the strict literal approach is the primary method of interpretation. Based on such an approach, functional interpretation of the law can determine the whole meaning of the provision. Even after this process, when the provision can be interpreted in multiples of modes and each interpretation has a reasonable ground, the ‘in dubio contra fiscum’ is to be applied as the last step in the control-of-interpretation level.
Enacting tax laws that the public can easily understand is practically impossible. Yet enacting tax laws that are too complex for even experts such as taxation law professors to comprehend is entirely different matter. There are reports that when faced with ambiguous provisions in the tax laws, the revenue officers aggressively interpret the provision so that the highest amount of tax can be imposed on the taxpayers. If this were to be true, it would be erroneous.
Tax law statutes are presumed constitutional and controlling the norms should be approached with caution. However, for the National Assembly to enact unconstitutional tax law statutes or for taxing authorities to make administrative actions contrary to the constitutional principle of ‘Taxation by Statutory Law’ should not be permitted. Therefore, Korean courts and the Constitutional Court should interpret tax laws in light of the constitutional principle and sustain an inevitable norm regulation ad hoc. Judicial decisions that protect individuals’ constitutional rights are needed because legislations must not violate the constitutional principle of ‘Taxation by Statutory Law.’ Not only that, but the taxing authorities have no power to regulate norms such as tax law statutes or related administration legislations.
