코로나 팬데믹이 선포된 지 2년이 다 되어 간다. 그간 코로나로 인한 생명·신체의 피해와 경제적 손실은 눈덩이처럼 불어났다. 특히 자영업자는 국민의 건강을 보호하기 위한 영업제한조치로 큰 고통과 손실을 감내해 왔다. 이들의 자발적 호의에 기댈 수 있는 임계치는 이미 넘어선 상황이다. 그러던 중 코로나에 따른 영업제한(이하 ‘코로나 영업제한조치’라 한다)으로 인해 발생한 자영업자의 손실을 보상하기 위해 소상공인 보호 및 지원에 관한 법률(이하 ‘소상공인법’이라 한다)이 개정되기에 이르렀다.
소상공인법에서 코로나 영업제한조치의 손실보상규정이 도입되었지만, 손실보상의 시기별 사각지대가 존재하고 있는 상황이다. 2021. 7. 7. 이전의 손실에 대해서는 보상이 이루어지지 않으며, 일부 영업제한조치와 영업에 대해서는 손실보상에서 제외되어 있다. 특히 2021. 7. 7. 이전의 손실보상 문제는 감염병의 예방 및 관리에 관한 법률(이하 ‘감염병예방법’이라 한다)과 소상공인법이 중첩될 수 있는 복잡한 구조를 내포하고 있다. 본 논문은 이러한 손실보상 사각지대에 대해 유추적용의 방법론으로 그 공백을 메울 수 있는지를 중심으로 살펴보았다.
소상공인법이 개정되기 이전에는 감염병예방법의 손실보상규정을 유추적용할 수 있다고 보았다. 감염병예방법 손실보상규정의 목적과 내용, 손실보상규정에 열거된 손실보상 대상과의 유사성을 종합적으로 고려하면, 코로나 영업제한조치에 대해 감염병예방법의 손실보상규정을 유추적용할 수 있다.
소상공인법 개정 이후에는 소상공인법의 법해석을 통해 손실보상이 허용될 수 있다고 보았다. 코로나 영업제한조치의 성질이 2021. 7. 7. 이전과 이후를 기준으로 본질적으로 구분된다고 할 수 없다. 부칙 제2조 단서에 따른 2021. 7. 7. 이전 손실에 대한 피해 지원 규정은 조정적 보상이 가능하다는 점을 확인한 것이고, 본칙에 따른 손실보상의 기준에 따라 보상하는 것을 허용하는 법해석·적용도 가능하다고 본다. 코로나 영업제한조치는 코로나 이후 지속되어 왔다. 손실보상의 원인은 2021. 7. 7. 전후로 걸쳐 있는데, 손실의 발생 시점을 인위적으로 나누어 손실보상의 대상을 차별하는 것은 손실보상의 원인과 결과가 밀접하게 결부되어 있는 손실보상의 체계에 부합하지 않는다.
코로나 영업제한조치에 대한 손실보상 규정 흠결에 대한 반성적 조치로서 소상공인법 입법이 이루어졌다. 코로나 영업제한조치는 재산권에 대한 특별한 희생을 초래하는 것으로 판단한 것이다. 특히 코로나 손실보상액 수준의 완전성 논의를 떠나, 코로나 손실보상의 기준은 소상공인법으로 정립되어 있는 상황이다. 감염병예방법과 소상공인법의 유추가 중첩적으로 허용될 상황에서는 소상공인법의 손실보상규정을 코로나 영업제한조치에 유추하는 것이 바람직하다.
It has been nearly two years since the COVID-19 pandemic was declared. In the meantime, damages to life, body and economic losses caused by COVID-19 have increased. In particular, small business have endured pain and losses from business restrictions to protect the public health. The threshold for relying on their voluntary favors has already exceeded. We now have the Act on the Protection of and Support for Micro Enterprises(hereinafter referred to as the “the Small Business Act”) to compensate for the losses caused by business restrictions(hereinafter referred to as “COVID Business Restrictions”).
Although the compensation scheme for COVID Business Restrictions was introduced under the Small Business Act, blind spots of compensation exist by period. No compensation is made for losses prior to July 7, 2021, and some business restrictions and operations are excluded from the compensation scheme. In particular, the problem of compensation for losses before July 7, 2021 has a complex structure in which the Infectious Disease Control and Prevention Act(hereinafter referred to as the “the Infectious Disease Act”) and the Small Business Act can overlap. This article focused on whether these blind spots can be filled with a methodology for applying analogies.
Even before the Small Business Act was revised, it was considered that the compensation scheme of the Infectious Disease Act could be applied by analogy to the COVID Business Restrictions, given the purpose and content, and the similarity to targets listed in the compensation scheme of the Infectious Disease Act.
The application of the compensation scheme under the Small Business Act may also be permitted. The nature of the COVID Business Restrictions couldn't be said to be essentially distinguished based on before and after July 7, 2021. It is confirmed that government’s assistant for losses prior to July 7, 2021 under the proviso to Article 2 of the Addenda of the Small Business Act can be interpreted for accommodative compensation, and it is deemed possible to allow compensation according to the Article 12-2 of the Small Business Act. The COVID Business Restrictions have continued since COVID-19 pandemic. The cause of loss compensation spans around July 7, 2021, and artificially dividing the time of loss to discriminate against the loss compensation coverage does not fit for the compensation system due to the close linkage of the cause and effect.
Legislation of the Small Business Act was implemented as a reflective measure against defects in the loss compensation regulations for the COVID Business Restrictions. The COVID Business Restrictions can cause special sacrifices to property rights. In particular, regardless of full compensation for COVID-19, the standard of compensation for COVID-19 is established under the Small Business Act. In a situation where the analogy between the Infectious Disease Act and the Small Business Act is allowed overlappingly, it is desirable to apply or infer the Small Business Act to the COVID Business Restrictions.
