4차 산업혁명과 인공지능 기반의 사회·경제 변화는 보수적인 사법제도에도 영향을 미치고 있다. 온라인 기반의 법률서비스가 속속 개발되고 있으며 인공지능을 활용한 법률전문가 시스템도 발전하고 있는 중이다. 우리 사법부도 2024년을 목표로 ‘스마트 법원 구축 사업’을 추진 중에 있다. 인공지능 발전의 결과를 사법체계에 도입하려는 움직임이 주는 의미는 우리 사회의 가치를 결정하는 사법체계에 대한 근본적인 질문을 던지기 때문이다. 우리는 박근혜 정부의 사법농단 사건을 거치면서 사법에 대한 국민의 신뢰가 급격히 저하된 상황을 목격하고 있다.
이와 같은 신뢰 저하의 근본적인 원인은 단순히 사법 구조가 법률가들에 의해 형성된 체계가 아닌 사회의 다양한 가치와 사실과 규범이 상호작용하는 복합적인 시스템이라는 사실을 간과한데 있다. 사법의 궁극적인 최종 소비자는 국민이었고 그들의 신뢰가 없는 사법체계는 그 사회의 가치를 결정하는 근본적인 역할과 의미에 대한 의문을 제공하는 요인이 된 것이다.
인공지능 시스템을 사법체계에 도입하려는 논의는 그것이 정당한가 혹은 실현가능한가의 문제를 넘어서 지금의 사법체계에 대한 불신과 이를 혁신하려는 보다 근본적인 문제의식에 기초하고 있다. 새로운 기술 특히 인격적 편견이 없는 기계적 알고리즘인 ‘판결기계’를 더 신뢰할 수도 있다는 가능성이 우리 사법체계의 근본적 위기를 반영한 것일지도 모른다.
인공지능은 사법체계에 일정 부분 신뢰성을 부여할 수 있으며 긍정적 기여도 기대된다. 하지만 사법판단의 근본적인 구조와 가치에 대한 고민 없이 무분별한 인공지능 시스템의 도입은 사법제도 자체의 이념적·철학적 토대를 무너뜨릴 수 있다. 사법의 본질적인 영역인 인간의 규범판단의 주체성을 훼손하지 않으면서 사법의 공정성을 촉진할 수 있도록 제도적·기술적 발전의 방향을 모색할 필요가 있다.
인간 스스로 법적·사회적 가치에 대한 규범판단의 주체성을 강화하려는 노력의 과정에서 인공지능이 어떻게 사용될 수 있는가의 문제를 고민하는 것이 중요하다. 그러한 전제 위에서 인공지능 발전을 기초로 한 사회적 가치를 실현하는 사법체계의 혁신이 가능할 것이다.
그렇다면 인공지능으로 대표되는 과학기술의 발전은 사법체계의 혁신에서 어떤 역할을 할 수 있을지가 문제 된다. 일반인들의 사법판단의 기준은 불확실한 정보와 여론에 영향을 받는다. 이를 극복하기 위해서는 일반인들이 사법판단의 구조적 한계를 인식하고 올바른 사법판단의 기준을 갖게 하는 것이 중요하다. 사법체계 전반에 나타나는 구조적 불확실성의 문제에 대해 일반인들이 확실히 인식할 수 있고 이를 객관적인 절차로 극복할 수 있어야 한다. 따라서 사법제도에 인공지능의 도입은 사법제도의 구조적 한계를 기술적으로 제거할 수 있는 분야에서 시작되어야 한다. 특히 사실인정과 증거제시에 있어서 보다 객관적인 절차와 명확성을 제공할 수 있을 것으로 기대된다.
보다 근원적인 사법체계의 혁신을 위해서는 우리 사회가 추구하는 사회적 가치와 도덕적 지향성에 대한 사회적 합의가 필요하다. 인공지능은 우리 사회의 경제적 변화와 함께 제도적 변화와 발전도 촉발하고 있다. 그 변화의 크기와 범위를 예상할 수는 없지만 지금과는 다른 근본적인 변화가 예측된다. 이러한 변화의 파고 속에서 우리가 지켜야 할 궁극적 가치가 무엇인지에 대한 고민이 필요하다.
오늘날 우리의 헌법과 사법제도는 궁극적으로 ‘인간의 존엄과 가치’를 추구한다. 헌법이 추구하는 인간상은 우리 스스로의 운명과 사회 발전의 방향을 결정할 수 있는 개인의 주체성에 기반하고 있으며 이는 인공지능이 대체할 수 없는 우리의 권리이자 의무이다. 4차 산업혁명이라는 근본적 변화 속에서 인간의 주체성, 존엄과 가치는 새롭게 변화될 규범과 제도에 하나의 등불과 같은 역할을 할 것이다. 우리는 이 등불을 등대 삼아 우리 사법제도의 신뢰 회복과 새로운 사회적 가치의 발견이라는 긴 여정을 시작해야 할 것이다.

In order to overcome this, it is important for the general public to recognize the structural limitations of judicial judgment and to have the standard for correct judicial judgment. The general public should be able to clearly recognize the problem of structural uncertainty that appears throughout the judicial system and be able to overcome it through objective procedures. Therefore, the introduction of artificial intelligence into the judicial system should begin in the field that can technically remove the structural limitations of the judicial system. In particular, it is expected to provide more objective procedures and clarity in the recognition of facts and presentation of evidence.
In order to innovate the more fundamental judicial system, social consensus on the social values and moral orientation pursued by our society is necessary. We will have to use this lamp as a beacon and start the long journey of restoring trust in our judicial system and discovering new social values.
