오스트리아에서는 일반법원에 부속된 노동사회법원이 노동사건과 사회보장사건을 모두 심리하고, 근로자 대표기관인 노동회의소와 사용자 대표기관인 경제회의소에 의하여 선거로 선출된 해당 분야의 전문가인 전문직 명예법관과 직업법관이 재판부를 구성한다는 데 그 제도적 특색이 있다. 노동회의소는 노동사건과 사회보장사건에서 근로자와 신청인을 법적으로 보호하는 데 핵심적인 역할을 수행한다. 근로자는 근로관계를 시작할 때 노동회의소에 당연히 가입되고, 노동회의소는 그 회원들에게 1차적으로는 상담 등 비공식적인 수단, 2차적으로는 소송대리 등 공식적인 수단을 통하여 노동법, 사회보장법과 관련한 법적 보호를 무료로 제공하고 있다.
설령 근로자와 신청인이 노동회의소와 변호사에 의한 법적 조력을 받지 못한다고 하더라도, 노동사회법원의 소송절차에서 이들의 상대적으로 열악한 법적 지위는 충분히 고려된다. 법관은 소송대리인이 없는 사건에서 실체법과 소송절차에 관한 지식이 없는 원고가 권리를 추구할 수 있도록 손을 잡아 이끌 의무를 부담한다. 그에 따라 원고는 구두로 소송을 제기할 수 있고, 특정한 청구액을 밝힐 필요도 없다. 소송절차는 원고 친화적이어서 소송대리인이 없는 원고가 뒤늦게 청구를 변경하거나 새로운 증거를 제출한다고 하더라도 제재를 받지 않는다. 또한 근로자는 노동사건 중 일정 액수 이하의 청구 등에서는 소송비용을 지출하지 아니하고, 사회보장사건에서는 사회보장기관이 소송비용을 전액 부담한다. 나아가 임금과 사회보장급여에 관한 하급심판결은 즉시 집행할 수 있다. 소송절차는 노동사건과 사회보장사건에 공통적으로 적용되지만 각 사건의 특성을 고려한 특칙이 있다. 노동사건에만 적용되는 특칙인 특별확인절차와 사회보장사건에만 적용되는 특칙인 사회보장기관에 대한 필요적 전치절차가 그것이다.
오스트리아 노동사회법원과 그 소송절차를 제도적으로 수용하기 위해서는 다음과 같은 측면을 고려하여야 한다. 첫째, 노동과 사회보장의 연계성, 소송당사자 사이에 존재하는 힘의 불균형이라는 공통점을 고려할 때 노동사회법원을 도입할 필요성이 있고, 노동사회법원이 일반법원에 부속된 형태를 보이는 것도 노동법원과 사회보장법원으로 분리된 형태보다 수용할 여지가 더 크다. 오스트리아의 참심재판은 전문가 명예법관의 선출과정에서 민주적 정당성이 충분히 확보된다는 점에서 우리의 참심재판 도입에 참고할 만하다. 다만 참심재판의 위헌론을 넘어서서 참심재판을 도입할 수 있다고 하더라도, 그 이전에 준참심제라는 과도기를 거치는 것이 현실적이다. 둘째, 근로자와 신청인의 권리구제 신장을 위해서는 사건의 가액, 종류, 성격 및 당사자의 자력 등을 고려하여 소송비용을 감면하고, 청구취지의 엄격한 특정을 지양함과 아울러 구두에 의한 소제기를 인정하며, 특히 사회보장소송에서는 직권탐지주의에 의한 심리를 강조하는 노동사회사건에 관한 소송법이 제정되어야 한다. 셋째, 노동위원회의 부당해고 등에 대한 판정이 본질적으로 사법작용이기는 하지만 노동위원회가 사법기능을 담당하는 것은 최소화하는 것이 바람직하므로 지방노동위원회와 중앙노동위원회는 노동위원회로 일원화하는 것이 타당하다. 이로써 노동위원회가 부당해고 구제신청사건을 낮은 비용으로 신속하게 처리하는 장점을 살리고 노동사회법원과 노동위원회와의 기능적 중첩 문제를 해소할 수 있을 것이다.
