법무부는 “동물은 물건이 아니다”의 조항을 신설하는 민법 개정안을 입법예고 하였다. 민법 개정안이 국회를 통과하면 동물은 물건이 아닌 동물 그 자체로서의 법적 지위를 인정받게 된다고 한다. 동물보호 및 동물과 관련한 법제의 개편을 진행한 국가들은 동물의 개념을 종래 물건이라는 개념에서 분리하고 나아가 권리의 객체라는 기존 동물의 법적 지위 역시 승격하는 입법이 이루어지고 있다. 독일, 오스트리아, 스위스, 프랑스 및 스페인은 민법에서 동물은 물건이 아니라고 규정하며, 특히 스페인의 경우 동물을 물건이 아닌 ‘지각 있는 존재’로 간주한다. 물건의 지위에서 동물을 해방시킨 국가들은 대부분 헌법에서 동물보호 관련 규정을 갖고 있으며 스위스의 경우 동물의 존엄성을 언급하기도 한다. 물건이 아닌 동물의 새로운 법적 지위를 검토하는 각국의 판례들도 등장하고 있는데, 미국의 침팬지 Tommy 사례에서 법원은 Tommy가 인신보호영장제도의 적용 대상이 될 수 없다는 기각결정을 하면서도, 침팬지가 person의 개념에 부합하는지 또는 인간과 같은 권리의무를 갖는지를 판단할 것이 아니라 인신보호영장에 따라 보호되어야 할 자유에 관한 권리가 있는지를 검토해야 한다는 별개의견이 개진되었다. 캐나다의 열악한 동물원에서 생활하고 있던 Lucy라는 코끼리에 대해 당해 법원의 다수의견과 달리 지구를 공유하고 있는 동물에 대해 우리는 법적 의무가 있으며 동물의 이익을 적절히 보호할 수 있는지는 별론으로 하더라도 동물복지를 정하고 있는 현행법에 따라 동물, 그리고 적어도 그들의 변호인은 법적 지위를 부여받아야 한다는 반대의견이 있었다. 진돗개를 학대한 사례에서 우리 법원은 우리 사회에서 취약한 위치에 있는 사회적 소수자처럼, 동물을 인간중심주의 질서 속에 있는 사회적 타자로 구성한다. 이와 같은 사례를 비추어 볼 때, 더 이상 물건이 아닌 동물은 가족 구성원으로서 지위가 인정될 수 있으며 미국의 많은 주에서는 신탁, 보호명령, 이혼 등의 법제에서 반려동물을 인간의 어린 자녀의 지위로 구성하고 있다. 한편 열악한 환경에서 생활하던 침팬지 세실리아 사례에서 아르헨티나 법원은 동물을 물건이며 재산으로 취급하는 입법이 존재함에도 침팬지를 비롯한 유인원은 권리의 주체인 비인간 인격체라고 판단했고, 오랑우탄 산드라 사건을 담당했던 당해 법원은 법인격 개념의 가변성·유동성을 고려하여 동물을 법적 주체로서 인정할 수 있다고 하였다. 궁극적으로, 인간과 함께 지구에서 공존하고 있는 동물은 존중받아야 하고 실질적 존중에 대한 구현은 공동체의 구성원, 권리 보유자로서 인정하는 것인바, 이는 가족 구성원으로서의 지위 외 동물에게 인정할 수 있는 또 다른 법적 지위가 될 수 있다.
Ministry of Justice of Korea has issued the Civil Code Amendments to include ‘Animals are Not Objects’. It is said that if the amendment to the Civil Code passes the National Assembly, nonhuman animals will be recognized a legal status on one’s own. Many countries have reformed their legal systems related to animals that provide the contents concerns not only the separation of animals from the concept of objects, but also the improvement of animals from their existing legal status as objects of rights. Germany, Austria, Switzerland, France and Spain have provisions in their civil codes stating that animals are not objects. In particular, Spain defines animals as sentient beings.
In US Tommy case, which requested chimpanzee Tommy should be subject to the habeas corpus, the court issued the separate opinion that it is necessary to examine whether a chimpanzee has the right to freedom that should be protected under the habeas corpus, not deciding that a chimpanzee fits the concept of ‘person’. The court of the Elephant Lucy case in Canada included the dissent opinion, which says that we human beings have responsibility to nonhuman animals that share the earth with us, and animals and at least their lawyers should be given the legal status according to the current law stipulating about animal welfare. In Korean Jindo Dog case, the court viewed animals as social others in anthropocentric society, as in the case of Social minorities placed under vulnerable position or condition in our society.
Animals that are no longer objects can be recognized as family members, and many states of US prove it by declaring legislatively. In other words, the states of US consider animals as human children in the legal system of trust, Restraining Orders, divorce. In the Cecilia case, the chimpanzee Cecilia who lived in poor surroundings was liberated by court decision that it is undeniable fact that great apes, including chimpanzees, are sentient beings, and therefore, they are non-human persons subject to rights. Futhermore, the court in the orangutan Sandra case pointed out the variability and fluidity of the concept of legal personhood. According to such claims, animals could be a legal subject with legal personhood. Nonhuman animals co-existing with human beings on the earth should be respected, and it is realized by recongnizing them as members of our community and rights-holder.
