2010년대에 들어와서, 대법원판결들을 통하여 ‘후발적 사유에 의한 경정청구’, 또는 줄여 말해서 ‘후발적 경정청구’ 제도의 활용 폭이 크게 넓어지고 있음을 쉽사리 확인할 수 있다. 그런데 어떤 납세의무의 존부나 크기를 다투는 취소소송이 계속 중인 상황에서 이 ‘후발적 사유’가 존재할 때, 납세의무자가 따로 후발적 경정청구를 해야 하는지, 아니면 계속하는 취소소송의 절차 내에서 이를 과세처분이나 경정거부처분의 ‘위법 사유’로 주장할 수 있는지에 관하여 의문이 생길 수 있다. 대법원은 2002년에 함께 선고된 두 건의 판결을 통해서 후자(後者)의 입장을 취하였다(‘대상 판례’). 이는 ‘후발적 사유’가 곧 과세처분이나 신고의 ‘위법 사유’가 된다는 일반론으로 이어지게 되고, 이러한 일반론은 조세쟁송법 체계 전반에 걸쳐 다양한 함의(含意)를 갖게 된다.
이 글은 이와 같이 대상 판례의 일반론을 전제했을 때, 이것이 기존의 조세쟁송법이나 행정구제법의 이론 체계와 어떤 관계에 놓이는지를 살펴보고 이에 따라 더 규명되어야 할 논점들을 제시한다. 또 후발적 경정청구 제도가 가지는 제도적 의의가 절차적 확정력, 또는 이른바 불가쟁력(不可爭力) 개념의 적용 범위에 대한 예외를 설정하는 데 있다는 것이 대상 판례의 이론적 귀결임을 보인다. 후발적 경정청구 제도를 둘러싼 현재의 이론적 논의가 후발적 사유의 범위 획정(劃定)을 둘러싸고 전개되고 있다고 할 때, 후발적 사유가 이와 같이 과세처분·경정거부처분의 위법 사유에 해당한다는 점과, 불가쟁력의 예외를 인정받는 요건이 된다는 점을 모두 균형 있게 감안한 일반론을 도출하는 것이 이 제도에 관한 현재의 주요 쟁점이자 앞으로의 연구과제가 된다.
According to the Basic Framework Act for National Taxes, taxpayers in Korea, who have over-reported their tax liabilities are entitled to file a petition for rectification within five years after the lapse of the period for submitting tax returns. The petition in this sense is called the (ordinary) “petition for re-assessment” (hereinafter either “PR” or “OPR”). Another type of PR is available to taxpayers, when one of the qualified incidences has occurred that affects their outstanding tax liabilities. This is allowed within three months after the relevant incidence has occurred. The latter type of PR is called the “PR ex post,” which lies in the heart of the discussion in this article.
Against this backdrop, this article discusses various implications that the PR ex post, of which the scope of application has of late rapidly expanded to a remarkable extent under the Supreme Court case law, has in the general theoretical framework of tax controversies in Korea. After analyses and discussions over various technical procedural issues relating to litigations over OPR, PR ex post and the like, this article points out that the legal concept that is compromised when a PR ex post is accepted, is none other than the statutes of limitation that prohibit taxpayers from filing appeals against tax assessments or his or her own tax returns. This obvious aspect of the PR ex post is, however, often not fully appreciated, partly because taxpayers who are in a position to file PR ex post tend to raise the issue at the already pending lawsuits, rather than to file a separate PR ex post. In such cases, the court examines the relevant incidence (not as a cause for a separate filing of an PR ex post but) in the context of ordinary review of the “legality” of the tax assessment or tax returns at the already pending lawsuit, which is a practice long legitimized by the Supreme Court. This trend might have encouraged the current trend of expansive interpretation on the statutory provisions allowing use of the PR ex post.
Considering the general understanding that the rules on the foregoing statutes of limitation constitute, for the sake of legal certainty, one of the important backbones of the whole theoretical framework of Korean tax controversies, however, this article suggests that the current trend of expansive reading of the statutory provisions on PR ex post should be carefully re-examined. In this regard, this article calls for more robust theoretical frameworks of general nature that delineate the exact scope of application of PR ex post. It is intended and hoped that the analyses and discussions of diverse technical issues contained in this article may serve as cornerstones for such subsequent studies.
