장애인차별금지 및 권리구제 등에 관한 법률(이하 ‘장애인차별금지법’이라 한다)은 모든 차별 분야에서 권리구제수단으로 손해배상 및 적극적 조치 청구를 인정하고, 행정적 구제절차를 필요적으로 거치지 않아도 그 청구를 할 수 있도록 규정하고 있다. 장애인차별금지법이 시행된 지 10여 년이 지났지만, 적극적 조치와 관련된 대법원의 판결은 2021. 4.에 처음 선고되었다. 하급심판결은 매년 3~4건씩 꾸준히 선고되고 있는데, 상대적으로 금융 분야와 교통수단 분야의 사건들이 많다. 한편 아직 본격적으로 다루어지지 않았으나, 향후 생각해 볼 만한 쟁점들은 다음과 같다.
① 국가나 지방자치단체를 상대로 한 적극적 조치 청구의 소는 소송물 또는 그 전제가 되는 법률관계의 성격에 따라 민사소송 또는 당사자소송으로 제기할 수 있고, 통상 국가나 지방자치단체 등이 사경제 주체로서 작용하는 것이 아닌 이상 당사자소송 절차에 따를 것이다.
② 차별행위가 일회적인 성격의 것으로 장래 반복될 구체적·현실적 개연성이 없음이 분명하다면, 그 시정을 위한 적극적 조치를 명할 실익이 크지 않다. 한편 원칙적으로 차별행위의 피해자가 아니라면 적극적 조치를 청구할 수 없을 것이나 가까운 미래에 피해를 받을 것이 충분히 예상 가능한 경우이거나 직접 차별을 경험하고 난 뒤에야 청구할 수 있다고 보는 것이 현저히 부당한 경우에는 예외적으로 적극적 조치를 청구할 수 있다고 봄이 타당하다.
③ 일반적인 소극적 확인의 소와 달리 적극적 조치 의무 부존재 확인의 소에서 확인의 이익은 유사한 사례가 반복되고 있거나 편의 제공의 요구 또는 손해배상을 구하는 범위가 법령에서 예정하고 있는 정당한 수준을 벗어난 것이라 볼 만한 예외적 사정이 있는 경우로 한정해서 인정할 필요가 있다.
④ 소송 계속 중 차별행위가 시정되어 원고의 청구를 기각한 경우, 언제나 패소 당사자인 원고에게 소송비용 전부를 부담시킬 게 아니라 원고의 소 제기가 차별시정에 결정적인 계기가 되었는지를 기준으로 소송비용 분담을 정해야 한다.
Unlike the Americans with Disabilities Act, the Act on the Anti-Discrimination Against and Remedies for Persons with Disabilities permits a private individual to seek remedies in a lawsuit such as damages and remedial measures in every category, and does not require the person to exhaust all administrative remedies or complaints available before being able to sue. With respect to remedial measures as referred to in the Article 48(2) of the Act, the Supreme Court has handed down its decision for the first time since the enforcement of the Act in 1998. There have been there to four decisions rendered by the lower court every year, most of which pertain to financial products and services as referred to in the Article 17 and means of mobility and transportation as referred to in the Article 19.
We need to think more carefully about the following issues.
① A lawsuit against the State and local governments can be processed under a civil suit or a party suit in accordance with the Administration Litigation Act, based on the object of a lawsuit or juridical relationship between parties.
② The standing to sue might be granted to a plaintiff who has not suffered from the discrimination yet when filing an injunction lawsuit but can sufficiently demonstrate a real threat of injury in the very near future.
③ In the proceedings for a declaration of the non-liability, the courts should consider all the circumstances such as how frequently similar cases arise and whether the opposite party makes a reasonable demand, when concluding that the plaintiff has a case against the defendant who has alleged the discrimination.
④ The courts should consider whether the lawsuit provides a decisive opportunity for redressing the discrimination when deciding the allocation of attorney’s fee and court cost between the parties, in the case where the discrimination has been redressed after the plaintiff filed a lawsuit.
