업무방해죄와 위계공무집행방해죄는 ‘위계’를 행위수단으로 규정하고, 미수범 처벌규정이 없어 유사한 규율체계임에도 양죄의 위험범 내지 결과범 여부에 관해 견해가 대립된다. 또한 대법원은 업무방해죄의 ‘방해’는 방해의 위험이 발생하는 것으로 족한 반면, 위계공무집행방해죄의 ‘방해’는 현실적인 방해의 결과가 발생할 것을 요한다고 해석한다. 그런데 경제적 내지 사회적 영역에서의 활동의 자유를 보호하는 업무방해죄는 의사결정의 자유를 전제한다는 점에서 협박죄와 연관성이 있고, 협박죄의 보호법익인 의사결정의 자유는 피해자의 내심의 영역의 문제로서 외부적으로 드러나지 않아 침해범으로 이해하면 사실상 피해자의 입장에 따라 보호법익의 침해 여부가 좌우되는 불합리한 점이 발생할 수 있어 위험범으로 이해함이 타당하다. 또한 업무방해죄 역시 위와 같은 활동의 자유가 침해되었는지 여부가 외부적으로 쉽게 나타나지 않는 경우가 많아 협박죄와 마찬가지로 위험범으로 이해함이 타당하다.
한편 위계공무집행방해죄의 보호법익인 국가적 기능으로서 공무가 행위객체에 불과한 공무원에 의해 그 침해 여부가 좌우되는 것은 보호법익의 성격상 불합리하므로 위험범으로 이해함이 타당하다. 그리고 양죄의 ‘방해’는 행위와 구성요건적 결과로서의 의미가 모두 있으나, 범죄 성립범위의 무분별한 확장을 방지하기 위해 결과범으로 이해함이 타당하다. 아울러 양죄의 ‘방해’의 의미에 관해 위계공무집행방해죄와 공무집행방해죄의 법정형이 동일한 점, 1995. 12. 29. 형법 개정을 통해 종전과 달리, 업무방해죄의 법정형이 위계공무집행방해죄보다 더 높게 변경된 점, 이는 사인과 국가기관의 전문성, 정보 접근권한의 차이를 고려한 것으로서 합리적 근거가 있는 점을 종합적으로 고려할 때 형법 개정 전에는 법정형이 더 높은 위계공무집행방해죄의 ‘방해’를 업무방해죄보다 더 엄격히 해석한 대법원의 입장이 타당하였으나, 개정 후에는 양죄의 ‘방해’에 모두 현실적인 방해의 결과를 요구하는 해석이 타당하므로 개정 전과 마찬가지로 양죄의 방해의 의미를 달리 해석하는 대법원의 입장은 재고할 필요가 있다.
There are conflicting views on whether to identify the crime of interference with business and the crime of obstruction of performance of official duties by fraudulent means, as crimes constituted through the abstract and concrete endangerment of legal interests or crimes that lead to a particular result. Views are also divided overr the definition of ‘interference and obstruction’ in these crimes. Regarding the identical statutory punishment imposed on the two aforementioned crimes, the balance between unlawfulness and statutory punishment can be justified on grounds that the crime of obstruction of performance of official duties by fraudulent means is deemed to require the outcome of actual obstruction, although fraudulent means are lower in unlawfulness than assault or intimidation. Moreover, with the amendment of the Criminal Act in 1995, the statutory punishment of the crime of interference with business was defined as more severe than that of the crime of obstruction of performance of official duties by fraudulent means; thus, the reversal of the statutory punishment of the two crimes needs to be noted. The reversal of the statutory punishment has theoretical legitimacy, as it has taken into account the gap in the counterparty’s expertise and information access authority, and thus needs to be fully considered for interpretation of the definition of ‘obstruction and interference’ in the two crimes. Therefore, before the amendment of the Criminal Act, the Supreme Court’s stance on broader interpretation of ‘obstruction and interference’ of the crime of interference with business was reasonable, but after the amendment of the Criminal Act, it would be reasonable for both of the crimes to require the outcome of actual obstruction and interference. In light of this, the Supreme Court’s broader interpretation of obstruction and interference for the crime of interference with business - pursuant to the pre-amended Criminal Act - requires rectification.
