2019. 2. 광역자치단체 단위에 자치경찰제도 도입이 확정되고, 2020. 12. 22. 「경찰법」이 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」로 개정되어 2021. 1. 1.부터 시행되었다. 이에 따라 2021. 1.부터 시·도자치경찰위원회 설치 및 위원 구성 등 자치경찰제도 시행을 위한 일련의 준비절차가 진행되었고, 4. 1.부터 6. 30.까지 시범운영을 통해 조직·인사구성 등 제도의 보완, 법령 정비를 거쳐 7. 1. 전국에 전면 시행되었다.
자치경찰제도에는 이원화 모델과 일원화 모델이 있는바, 개정된 「경찰법」은 일원화 모델을 취하고 있다. 동법은 일원화 모델을 취하면서 경찰의 사무를 국가경찰사무와 자치경찰사무로 구분한 후, 이 가운데 자치경찰사무에 대해서는 신설된 시·도자치경찰위원회의 지휘·감독을 받도록 하고 있는 것을 특징으로 한다. 시·도자치경찰위원회의 신설은 현행 자치경찰제도의 가장 큰 특징이며, 이는 자치경찰제도의 핵심이라고 할 수 있다. 한편 동법이 일원화 모델을 택함에 따라 현행 자치경찰제도는 기존의 경찰사무를 수행하는 조직 체계는 그대로 유지되게 되었다.
시·도자치경찰위원회는 시·도지사 소속의 지방행정기관이지만, 합의제 행정기관으로서 그 권한에 속하는 업무를 독립적으로 수행한다. 그런데 아직도 시·도자치경찰위원회의 법적 성격에 대한 논란이 있으며, 운영과정에서도 혼란을 빚고 있다.
이러한 여건하에서 자치경찰제도 도입 초기의 부작용을 최소화하고 연착륙을 할 수 있도록 지방자치단체 차원의 전략적 방향 설정이 요구되고 있는바, 자치경찰제도의 성공적 안착을 위해서는 합의제 행정기관인 시·도자치경찰위원회의 운영에 있어서 다음과 같은 사항을 유의하여야 한다.
첫째, 자치경찰제도의 목적이 민주적·지방적·자치적 경찰행정의 가치를 지향해야 한다.
둘째, 시·도자치경찰위원회의 사무 범위가 구체적·세부적으로 정립될 필요가 있다.
셋째, 시·도자치경찰위원회가 자치경찰사무에 대하여 심의·의결권으로써 행사하는 시·도경찰청장에 대한 지휘·감독권을 좀 더 구체화할 필요성이 있으며, 임용권 또한 자치경찰제도의 입법 취지에 맞도록 위임·행사되어야 한다.
넷째, 선출직 공무원인 지방자치단체장으로부터 시·도자치경찰위원회가 가진 경찰행정 직무의 독립성을 어떻게 유지할 것인가에도 관심을 가져야 한다. 왜냐하면, 이는 곧 시·도경찰청장의 독립적 직무수행과도 직결되기 때문이다.
어떤 제도가 정착되기 위해서는 많은 시행착오가 예상되는 것은 불문가지(不問可知)이며, 자치경찰제도도 역시 마찬가지이다. 따라서 위와 같은 문제점을 지적하며 섣불리 자치경찰제도의 실패를 논할 것이 아니라, 문제점들을 정비·보완하는 노력을 기울여야 할 것이다.
주민 친화적·지방행정과 연계하면서도 국가경찰행정과의 통일성을 유지하는 균형적인 자치경찰제도의 중심에 시·도자치경찰위원회가 자리잡고 있다.

The Municipal and Provincial Self-governing Police Commission is a local administrative agency belonging to the Municipal and Provincial Governor, but as a collegiate administrative agency, it independently performs its duties belonging to its authority. However, there is still controversy over the legal nature of the Municipal and Provincial Self-governing Police Commission, and confusion arises in the operation process.
Under these conditions, the strategic direction of local governments is required to minimize side effects and make a soft landing at the beginning of the introduction of the Self-governing Police System. For the successful settlement of the Self-governing Police System, the following matters shall be noted in the operation of the Municipal and Provincial Self-governing Police Commission.
First, the purpose of the Self-governing Police System should be to aim for the value of democratic, local, and self-governing police administration.
Second, the scope of the affairs of the Municipal and Provincial Self-governing Police Commission needs to be established in detail.
Third, it is necessary to further refine the authority of the Municipal and Provincial Self-governing Police Commission to direct and supervise the Chief of the Municipal and Provincial Police Agency by deliberating and voting on self-governing police affairs, and appointment rights shall also be delegated and exercised in accordance with the legislative purpose of the Self-governing Police System.
Fourth, we should also pay attention to how to maintain the independence of the police administrative duties held by the Municipal and Provincial Self-governing Police Commission from the heads of local governments, the fourth elected official. This is because it is also directly related to the independent performance of the Chief of the Municipal and Provincial Police Agency.
In order for a system to be established, many trials and errors are expected, and so are the Self-governing Police System. Therefore, instead of discussing the failure of the Self-governing Police System by pointing out the above problems, efforts should be made to repair and supplement the problems.
The Municipal and Provincial Self-governing Police Commission are at the center of a balanced Self-governing Police System that maintains unity with the national police administration while connecting with residents-friendly and local administration.
