사업인정의 실효는 사업인정 이후에도 공공필요에 대한 검증을 지속함으로써 공공필요가 수용절차 전반에서 존속하여야 한다는 헌법상 요청을 구현한 제도로 이해할 수 있다. 토지보상법 제23조에서는 토지 등 소유자의 법적 지위가 장기간 불안정해지는 것을 막고, 사업시행자가 수용절차를 해태하는 것을 제지하고자 사업인정고시일로부터 1년 이내에 사업시행자가 재결신청을 하지 않은 경우 사업인정의 실효를 정하였다. 토지보상법 제24조에서는 사업의 폐지·변경에 따라 공공필요가 존재하지 않게 된 부분, 즉 토지 등의 전부 또는 일부를 수용하거나 사용할 필요가 없게 된 부분에 상응하는 사업인정의 실효를 규정하였다. 사업의 폐지·변경에 따라 토지보상법 제91조 제1항의 환매권 행사요건을 충족할 경우 토지소유자는 환매권을 행사하여 협의취득되거나 수용된 토지를 돌려받을 수 있다. 공공필요를 위하여 재산권의 가치보장으로 전환되었던 것이 재산권의 존속보장으로 회귀하는 것이다. 사업인정의 실효를 직접 원인으로 하여 토지소유자 또는 관계인이 손실을 입게 된 경우 사업시행자는 그 손실을 보상하여야 하는데, 사업인정의 실효와 상당인과관계에 있는 손실, 즉 사업시행자의 책임으로 귀속시킬 수 있는 손실이 인정될 여지는 많지 않아 보인다.
사업인정의제를 규정한 개별 법률에서는 재결신청기간을 해당 사업시행기간으로 하는 특례규정을 두어 재결신청 해태에 따른 사업인정 실효규정을 사실상 무력화하고 있다. 이는 재산권 침해의 소지가 다분하므로, 토지보상법 제23조로 일원화하여 재결신청기간을 정하되, 사업의 특성, 진행경과 등을 고려할 수 있도록 재결신청기간의 연장허가에 관한 규정을 신설하는 것을 검토해 볼 수 있다. 또한, 사업인정 실효의 시간적 범위에 관해서는 명문의 규정이 없어 실무상 혼선과 논란을 일으킬 수 있으므로, ‘장래를 향하여’라는 문구를 해당 규정에 삽입할 필요가 있다고 본다.
The invalidation of approval of public projects can be understood as a system in response to a constitutional request that public interests must exist throughout the taking procedure by verifying public interests even after the granting of approval of a public project. Article 23 of the Act on the Acquisition of Land, etc., for Public Works and the Compensation (hereinafter “the Act”) stipulates that approval of a public project shall be invalidated if the project implementer does not apply for decision of taking within one year from the date of the notification of approval of a public project to prevent the legal status of the land owners from suffering uncertainty for a long time. Article 24 of the Act stipulates the invalidation of approval of a public project corresponding to the part where public interests do not exist due to the abolition or change of the project, that is, the part where all or part of land need not be used.
If the requirements for exercising the repurchase right under Article 91(1) of the Act are met, the landowner may exercise the repurchase right to retrieve the land. The value guarantee of property rights for public necessity returns to the guarantee of the existence of property rights. If the landowner or related person suffers losses directly due to the invalidation of approval of a public project, the project implementer shall compensate for the loss, but the loss may rarely be attributed to the project implementer’s responsibility.
Many Acts that stipulate quasi-approval of a public project have exceptional clauses that set the period of application for decision of taking as the period of implementation of the project. They effectively incapacitate the invalidation of approval of a public project due to the neglect of application for decision of taking. To mitigate a high likelihood of infringement on property rights, the application period can be governed under the unified provision of Article 23 of the Act and a new regulation on the extension of the application period may be examined to reflect the characteristics and progress of the project. In addition, there is no regulation on the time range of the invalidation of approval of a public project, which can cause confusion and controversy in practice, so it is necessary to insert the phrase “for the future” into the regulation.
