심리상담 분야의 전문화를 위한 중요 과제로 모법 형태의 심리상담 법령 제정의 중요성이 대두되고 있다. 2022년 현재 우리나라 법률체계 내에는 다양한 심리상담 관련 법규들이 존재하나 정작 가장 중요한 심리상담이 무엇인가에 대한 정의와 직무 범위에 관한 내용을 담은 법령은 부재한 상태이다. 이에 2021년 한 해 동안 심리상담 학계에서 다양한 심리상담 예시 법안이 제시되었고, 이들 법안을 토대로 2022년 3월 최종윤, 전봉민 의원과 4월 서정숙 의원이 각각 모법 형태의 심리상담 관련 법안을 발의하였다. 본 원고에서는 발의된 세 법안의 공통점과 차이점을 비교 및 검토하였다. 나아가 이들 법령을 대한민국보다 앞서 모법 형태의 심리상담 법령을 제정한 대만의 법령과 비교하여 관련 시사점을 제시하고자 하였다. 마지막으로, 각 발의안과 대만 법령의 고찰을 통해 앞으로 우리나라의 심리상담 분야 정책이 나아갈 방향성을 도출하고자 하였다.The enactment of a mother law for counselors has been emerging as an important key task with regard to the specialization of the counseling field. As of 2022, various laws related to counseling exist in the Korean legal system, but there is no law that contains the definition of counseling and duties of counselors. In 2021, several example bills defining counseling service and counselor were proposed from the field of counseling. Based on these examples, Representative Choi Jong-yoon, Jeon Bong-min, and Seo Jungsook respectively proposed the mother-type counselor bill through March and April, 2022. In this article, the similarities and differences between the bills were compared and examined. Furthermore, implications were suggested by comparing these bills with the law governing counseling service of Taiwan, which enacted a mother-type law earlier than Korea. Finally, by examining the proposed bills and Taiwanese Law, we suggested the future direction of Korean counseling policy.
