6월항쟁의 결과 탄생한 87년 체제는 최협의, 협의, 광의의 세 차원으로 그 개념을 정리할 수 있다. 단순한 정부형태와의 관련성을 중심으로 이해되는 최협의의 87년 체제는 체제 자체의 종합적 평가와 대안의 모색을 가능하게 할 내포와 외연을 갖추지 못하여 채택하기에 적합하지 않다. 87년 체제의 공과를 보다 거시적인 차원에서 정확히 평가하고 개혁과제를 체계적으로 설정하기 위해서는 정부형태를 포함한 헌법상의 제도와 다양한 하위정치제도와 정치관행을 결합한 체제로 87년 체제를 협의의 개념으로 이해하고 맥락에 따라 정치영역을 넘어 사회경제적 영역까지 포괄하는 광의의 이해와 병행하여 고찰될 필요가 있다.
협의의 87년 체제는 ‘한국형 민주공화제’로 부를 수 있을 만큼 정치영역과 경제영역에서 괄목할 성취를 이루었지만 여전히 경제와 사회의 양극화를 비롯한 현안의 해결에 부족함을 드러내고 있다. 거대정당중심의 정치적 독과점이 심화되고 정치의 자유화와 민주화가 민주화 이후에도 지체되어 정치과정의 민주적 결핍이 구조화된 상태이다. 이와 같은 역사사회적 한계에 직면한 87년 체제는 지식정보화사회의 도래와 세계화, 탈탄소-기후변화로 상징되는 대전환의 시대를 맞아 고전적 삼권분립체계와 국가와 사회영역의 기계적 이분화에 기초한 전통적 헌정 패러다임을 분권화, 지역화, 자율화, 국민참여를 세부실천과제로 삼는 거시적 비전으로 설계되어 모두가 더불어 인간의 존엄과 가치 및 행복추구권을 실현하는 ‘공존・공생・공영의 공동체’로 민주공화국을 업그레이드할 보편적 과제도 수용해야 할 국면을 맞고 있다.
이 글은 이와 같은 87년 체제의 의의와 한계를 정치적 권력구조와 비정치적 권력구조를 구분하는 차원에서 검토하는 것을 목적으로 하면서 그 범위를 헌법재판의 역할과의 관련성을 중심으로 제한하였다.
우선 정치적 권력구조와 관련하여 87년 체제의 정치적 권력구조의 진면목을 분권형 대통령제로 규정하고 이 본질이 한국형 민주공화제의 중추를 구성하고 있음을 전제하면서 이 체제를 더욱 헌법적으로 제도화된 분권형, 즉 이원정부제 혹은 혼합정부제로 전환시키고자 하는 시도는 대통령제의 정체성 자체를 본질적으로 전환시키는 것으로 국민적 지지를 받기 어려울 뿐만 아니라 합의적 정치문화가 발전하지 못한 정치문화와도 부합하지 않아 비현실적 대안이며, 특히 헌법재판에 과잉의존할 수 있는 위험성 때문에라도 수용하기 힘들다. 결국 정치적 권력구조에 대한 개헌론 차원의 개혁여지는 제한적이지만 분권형 대통령제의 구조적 문제인 집행권력의 이원화가 낳은 헌정파동의 위험성에 대한 대안으로 대통령의 사고 시 권한대행과 관련하여 헌재에 새로운 헌법적 역할을 부여할 필요성이 제안되었다. 또한 새 정부 출범시의 내각구성과 관련하여 총리대행을 활용하는 관행의 형성이 위헌소지가 있음을 지적하면서 헌법화를 통한 해결방안을 제시하였다.
비정치적 권력구조와 관련하여서는 견제적 민주주의와 심의적 민주주의를 기준으로 87년 체제에서 개헌을 통한 개혁의 필요성이 가장 필요한 사법권력과 관련한 부분 가운데 헌재의 구성과 관련한 여러 쟁점을 문재인 개헌안을 소재로 검토하는 한편 헌재가 정치적 사법기관으로서의 본질과 주어진 역할에 부합하게 견제적・심의적 기능을 중심으로 헌정의 조정자적 역할을 감당할 필요성과 관련 과제를 검토하였다.The 1987 System of South Korea based upon the Constitution of 1987 driven by 1987 People’s Uprising can be best understood not by the constitution itself as a legal document but by comprehensive constitutional arrangements defined by relevant inferior legislation, administrative and political conventions as well as the constitution.
The 1987 System has made it possible that the nation should be proud of evolving into a unique model of Korean Democratic Republic accomplishing both political democratization and economic development while there still remain a lot of social problems like economic and social bi-polarization. The aim of this article is to evaluate the 1987 system and to examine reform agenda in relation to the role of constitutional justice.
The 1987 System can be divided into two dimensions: political limb of governmental structure and non-political limb. The author begins with an assumption that the political limb has a unique feature of semi-presidentialism in the sense that the executive power is endowed not with the president alone but with the collective entity consisting of the president as the head of government and the prime minister together with ministers and the Council of State, and the prime minister has an autonomous constitutional status as he or she is appointed upon the consent of the National Assembly and he or she has an autonomous power to recommend ministers and to countersign the presidential acts concerning national affairs. This nature of governmental structure has an ambivalent representation; on the one hand, the omnipotent imperial presidency and the impotent nominal presidency on the other. It is argued that considering a desirable solution to this institutional instability, a radical change of governmental system from a soft semi-presidentialism to a rigid dualist governmental system is not an acceptable option since such change makes demerits rather than merits of not only presidentialism but also cabinet system take place.
Regarding non-political limb of governmental structure, the author argues that considering a new trend of contemporary democracy towards contestatory and deliberative democracy, constitutional adjudication is expected to play an important role as a political coordinator in constitutional arrangements of the democratic republic by way of providing a vital public sphere for citizens’ constestation and deliberation and performing its role as the adjudicator in this complex process featuring not only judical but also political characteristics. The constitutional justices have to enhance their role perception as a coordinator for the stable and democratic advancement of constitutional government.
