인슈어테크의 발전 과정에서 보험신용정보는 주로 빅데이터로의 활용을 위한 익명처리 및 가명처리를 통한 활용의 측면에서 주로 논의되고 있고, 보험신용정보에 관하여는 징벌적 손해배상제도 및 법정손해배상제도 등 보호의 측면이 강조되고 있다. 그런데 신용정보의 보호와 활용이라는 두 개의 가치는 서로 균형감을 가지고 추구되어야 한다. 특히 보험사기 적발을 위해서는 정보공유와 분석이 필수적인데 지나치게 신용정보 보호 쪽으로 치우치게 되면 보험산업의 건전한 발전을 저해하게 될 우려가 있다. 현재 보험신용정보는 한국신용정보원에서 집중관리되고 있고, 보험자들은 개별 보험계약자로부터 조회에 대한 동의를 받아 과거 보험계약 정보 및 보험금 지급 관련 정보를 조회할 수 있다. 보험법의 해석론에도 위와 같은 과학기술의 발전된 모습이 반영되어야 할 것이다. 본 논문에서는 특히 보험법상 고지의무의 해석론이 변화될 여지는 없는지를 중심으로 검토하였다. ICIS 발전에 따라 보험자가 보험계약 체결 과정에서 조회가능한 보험신용정보에 대하여는 고지의무의 보험자 고의·중과실이 인정되어야 한다. 현행법상 보험자의 고의·중과실을 보험계약자가 증명하여야 할 것으로 보이는데, 최소한 ICIS에서 조회가능한 보험신용정보에 대하여는 증명책임을 전환할 필요가 있다. 그 외에도 단체보험이나 사망사실이 확인된 경우 생명보험금 지급통지 등의 경우에 ICIS를 더욱 보험계약자 친화적으로 운영할 수 있도록 할 필요가 있다. 보험신용정보가 유출된 경우, 개인정보 유출의 경우와 마찬가지로 손해배상책임이 문제 된다. 결국 위 손해배상책임은 정신적 손해배상책임의 인정 여부로 귀결된다. 물론, 헌법상 기본권인 개인정보의 보호를 법률상 강하게 강제할 필요성은 높다. 하지만, 개인정보 보호만을 지나치게 강조하면 기업의 영업활동을 심각하게 제한하게 되고, 새로운 기술 접목 등에 소극적으로 대응하게 하여 결과적으로 해당 산업의 국제적 경쟁력을 약화시킬 우려도 있다. 각 권리에 대한 균형잡힌 시각이 요구된다고 할 수 있다. 보험신용정보의 유출, 가령 질병전력이 유출되어 회사에서 퇴직하는 등 직접적인 재산상 손해를 입은 경우에 관하여는 별다른 의문이 없고, 개인정보 보호법상 민감정보가 유출되었다면, 그 유출만으로 정신적 손해를 인정할 수 있다. 그 외의 보험신용정보에 관하여는 제3자에게 전파되었거나, 전파될 여지가 있었는지 여부를 심사하는 기존의 대법원 판례의 법리가 고려될 수 있다.Technology in the insurance industry continues to develop. Insurance credit information is mainly discussed in terms of using information as big data. Therefore, the key is to anonymize insurance credit information. Insurance credit information should be protected. Therefore, a punitive damages system is needed. However, insurance credit information has two values: protection and utilization. And the two values must be balanced against each other. Information sharing and analysis are essential to detect insurance fraud. And, there is a concern that excessive bias toward credit information protection may hinder the sound development of the insurance industry. Currently, insurance credit information is intensively managed by the Korea Credit Information Service. Insurers inquire past information with consent from policyholders. The development of science and technology should be considered when applying insurance laws. In this paper, the possibility of change in the applying of the obligation to notify under the insurance law was examined. ICIS systems are developing, and inquiry speed is improving. Therefore, when signing an insurance contract, insurance credit information that an insurer can inquire should not be subject to the obligation to notify. According to the current insurance law, the policyholder must prove the insurer’s recognition. The burden of proof of insurance credit information that can be inquired through the ICIS system should be shifted. The ICIS system should operate in favor of policyholders. For example, when a new group insurance is signed due to resignation and employment, the existing group insurance can be changed to individual insurance. If the death is confirmed, life insurance money may be notified using ICIS system. If insurance credit information is leaked, liability for damages is a problem. As a result, it is a question of whether to admit the responsibility for mental damage. Personal information is a fundamental right under the Constitutional Law. Therefore, personal information should be strictly protected. However, emphasizing the protection of personal information severely restricts the business activities of companies. Furthermore, as new technologies are not utilized, the international competitiveness of the insurance industry may be weakened. Therefore, a balanced view of rights is needed. In the event of direct property damage, such as retirement from the company due to the leakage of a history of illness, which is insurance credit information, it should be strictly protected. Mental damage can be accepted if sensitive information is leaked. Other than that, it shall be examined whether it has been spread to a third party or is likely to be spread in accordance with the Supreme Court precedent.
