디지털 대전환 시대를 맞이하여 인공지능 기술의 개발과 이용에 대한 관심이 높다. 금융 분야에서는 알고리즘을 이용하여 최적의 조건을 찾아 자동으로 주식 거래가 이루어지게 하거나 투자자의 성향 등을 분석하여 투자 포트폴리오를 제시하고 자산을 운용해 주는 등 자동화된 투자수단을 이용하여 보다 손쉽고 빠르고 정확한 투자가 이루어질 수 있다. 한편 기술을 이용한 자동화된 금융거래에서는 인간의 개입이 없거나 인간의 개입을 최소화하는 과정에서 일어난 오류가 거래의 신속성 및 대량성과 맞물려 큰 규모의 사고를 야기하기도 한다. 이렇듯 기술의 편의성과 함께 그로 인한 위험성도 간과할 수 없는데, 자동화된 시스템을 이용하는 알고리즘 매매가 일반투자자에게도 소개되어 활용되고 있고, 2017년경 도입된 로보어드바이저는 “맞춤형” 투자자문과 운용 서비스 제공을 내세워 홍보·광고가 이루어지는 만큼 투자자에 대한 보호 필요성이 커지고 있다.
자동화된 투자수단을 이용하는 투자자의 관점에서는 해당 서비스 제공자가 투자자문업자 내지 투자일임업자인지 아니면 유사투자자문업자인지에 따라 투자자 보호에 큰 차이가 있다. 비단 투자자뿐 아니라 서비스 제공자의 입장에서도 제공하려는 해당 서비스가 구체적으로 어느 ‘업’에 해당하는지 정확하게 알아야만 이에 맞는 진입요건을 갖출 수 있을 것이지만, 자동화된 투자수단의 경우 그 구별이 쉽지 않다. 특히 유사투자자문업자의 불법·탈법적인 영업으로 인한 피해가 커지면서 규제 강화 목소리가 높아지는 만큼 이에 대한 해석적 접근뿐 아니라 입법적 해결이 필요해 보인다.
알고리즘이나 머신러닝, 딥러닝 등 인공지능 기술이 발달하게 됨에 따라 블랙박스화 위험에 노출되어 있고, 전문가조차도 이에 대한 이해 부족으로 자동화된 투자수단에 대한 설명을 제대로 할 수 없게 된다면, 그로 인한 피해는 투자자에게 고스란히 전가될 수밖에 없다. 또한 기술의 발전이 일정한 단계를 넘었을 때 이러한 기술을 악용하여 자본시장과 금융투자업에 관한 법률상의 불공정거래행위를 야기함에도 이에 대한 규제가 적절하게 이루어지지 않을 가능성이 있기에 이에 대한 대비가 필요하다.
기술의 발전을 저해하지 않으면서도 위험을 대비할 수 있도록 양자 사이에서 균형점을 찾는 규제 마련을 위한 연구와 고민이 계속적으로 이루어져야 하고, 그 중심에는 ‘사람’이 있어야 할 것이다.
