형사소송법은 제216조와 제217조에서 영장에 의하지 않은 강제처분을 규정한다. 그런데 위 두 규정에 의한 압수·수색은 모두 영장을 발부받을 시간적 여유가 없을 때 긴급하게 이루어지는 것임에도, 요급처분에 관한 제220조는 제123조 제2항과 제125조의 적용을 배제할 수 있는 대상으로 제216조만을 언급하고 있다. 이러한 제220조의 문언으로 인하여 제217조 제1항의 압수·수색에 제220조가 적용될 수 있는지에 관한 해석상 견해의 대립이 있고, 실무상으로도 혼란이 있다.
제217조 제1항의 압수·수색에 요급처분이 허용될 것인지에 관하여는, 제220조의 문언에 따라 요급처분이 허용될 수 없다는 견해, 사후영장의 발부로 적법한 처분이 된다는 견해, 제217조 제1항에서 긴급성 요건과 시간적 요건을 두고 있으므로 요급처분이 허용된다는 견해가 있다. 실무상으로는, 특히 야간에 이루어진 제217조 제1항의 압수·수색에 관하여 검찰이 사후영장을 청구하고, 법원도 이를 엄격하게 심사하여 영장을 발부하고 있다. 대법원도 야간에 이루어진 위 압수·수색이 적법하다고 볼 수 있는 판결을 하였다. 그러나 최근 하급심에서 사후영장이 발부된 제217조 제1항에 의한 야간 압수·수색이 위법하다고 판단하기도 하였다. 이와 같은 해석상, 실무상 혼란을 해소하기 위한 해석론의 정립이 필요하다.
형사소송법 규정인 제220조와 제217조 제1항을 해석함에 있어서도 문언해석의 방법에 더하여 체계적·논리적 해석방법을 적용할 수 있다. 이에 따라 관련 규정의 입법 취지와 체계를 종합적으로 해석하면, 제217조 제1항에 제220조가 준용된다고 해석함이 타당하다. 즉, 제217조 제1항은 증거인멸 등에 긴급하게 대응하기 위한 규정이고, 제220조는 위와 같은 긴급한 압수·수색의 경우 따르기 불가능한 절차 규정의 적용을 배제하기 위한 규정인데, 제217조 제1항 자체에서 긴급성의 요건과 시간적 요건을 요구하고 있으므로, 제220조를 제217조 제1항에도 준용할 수 있다고 보아야 하는 것이다. 이렇게 해석함으로써 요급처분으로 이루어진 제217조 제1항의 압수·수색이 위법하다고 전제하는 사후추인설 등 다른 견해가 갖는 법리적 문제를 해소할 수 있고, 실무상의 혼란도 해결할 수 있다.
다만 수사상 강제처분의 절차에 관한 규정은 법률에 명시적으로 규정되는 것이 타당하므로, 제220조에 제217조 제1항의 처분을 포함시키는 법률 개정을 보충적으로 제안한다.
Articles 216 and 217 of the Criminal Procedure Act provide for compulsory dispositions without warrant. However, although the seizure and search pursuant to the above two provisions are urgently carried out in a situation where there is no time to obtain a warrant, Article 220 that can exclude Articles 123 (2) and 125 refers only to Article 216(Article 217 is not mentioned). Due to the wording of Article 220, there is a conflict of opinion in interpretation as to whether Article 220 can be applied to the seizure and search of Article 217 (1), and there is confusion in practice.
There are three opinions as to whether the seizure and search of Article 217 (1) is permitted as an urgent disposition: the first view is that urgent disposition cannot be permitted according to the words of Article 220; the second view is that the issuing of an ex post warrant will result in a legal disposition; and the third view is that urgent disposition is permitted because Article 217 (1) stipulates urgency and time limit. In practice, in particular with respect to seizures and search under Article 217 (1) carried out at night, a prosecutor requests an ex post warrant and a judge issues it. The Supreme Court also ruled that the seizure and search executed at night under Article 217 were lawful. However, the court of the first instance recently judged that the nighttime seizure and search pursuant to Article 217 (1), for which an ex-post warrant was issued, was illegal. It is necessary to establish a theory of interpretation to resolve such confusion in interpretation and practice.
In interpreting Articles 220 and 217 (1) of the Criminal Procedure Act, a systematic and logical interpretation method can be applied in addition to the verbal interpretation method. If we comprehensively interpret the legislative purpose of the relevant regulations and the system of regulations, it is reasonable to interpret that Article 220 applies mutatis mutandis to Article 217 (1). Article 217 (1) is a regulation to respond urgently to the destruction of evidence, and Article 220 is a regulation to exclude restrictions that cannot be followed in the case of urgent seizure and search, and Article 217 (1) also requires urgent circumstances and time restriction. Therefore, it should be interpreted that Article 220 can be applied mutatis mutandis to Article 217 (1). By interpreting in this way, it is possible to solve the problems in the theory of law held by other views, such as the post-approval theory, which presupposes that the seizure and search under Article 217 (1) is illegal, and it can also solve the confusion in practice.
However, since it is reasonable to explicitly stipulate the provisions of the compulsory disposition in the Act, I propose to amend the Act to include the disposition under Article 217 (1) in Article 220.
