최근 대법원은 웹 크롤링에 의한 데이터 수집이 정보통신망 침입에 해당하는지 여부에 관해서 최초로 판단하면서, 서비스제공자로부터 권한을 부여받은 이용자가 아닌 제3자가 정보통신망에 접속한 경우 그에게 접근권한이 있는지 여부는 서비스제공자가 부여한 접근권한을 기준으로 판단하여야 하고, 정보통신망에 대하여 서비스제공자가 접근권한을 제한하고 있는지 여부는 보호조치나 이용약관 등 객관적으로 드러난 여러 사정을 종합적으로 고려하여 신중하게 판단하여야 한다고 하는 기준을 제시하였다.
웹 크롤링 또는 웹 스크래핑은 빅데이터나 인공지능 등 최근 중요한 산업으로 여겨지는 분야에서 필수적인 기술이고, 정보독점을 완화하거나 경쟁에 기여하는 공익적 측면도 있다는 점에서 정보통신망 침입을 인정함에는 신중하여야 할 것이다. 최근 미국 연방대법원도 Van Buren 판결과 LinkedIn 판결에서 CFAA 위반에 신중한 입장을 보였으며, 제9항소법원도 LinkedIn 판결에서 크롤링이 CFAA 위반에 해당하지 않는다는 판결을 하였다.
따라서 위의 대법원판결이 정보통신망 침입에 해당하는지 판단함에 있어서 보호조치와 이용약관 등을 고려하여 객관적인 관점에서 접근권한 유무를 신중하게 판단하도록 구체적 기준을 제시한 것은 큰 의미가 있고, 향후 관련 분쟁들에 상당한 시사점을 줄 수 있다고 생각한다.
Recently, the Supreme Court first judged whether data collection by Web crawling constitutes an information and communications network intrusion. The Supreme Court has presented a standard that judging authorization granted by the provider, whether the service provider restricts the access to the information and communications network should be carefully judged by comprehensively considering various objectively revealed circumstances such as protective measures and terms of use.
Web Crawling or Scraping is an essential technology in fields that are recently considered important industries such as Big data or Artificial Intelligence, and it also has a public interest that alleviates information monopoly or contributes to competition. Therefore, it is necessary to be cautious in acknowledging information and communication networks invasion. Recently, the U.S. Supreme Court also took a cautious stance on CFAA violations in Van Buren and LinkedIn decisions, and the 9th Court of Appeals also ruled that crawling did not constitute CFAA violations in LinkedIn decision.
Therefore, the judgment of the Supreme Court is very meaningful in that it presents specific standards to carefully judge whether or not the access is authorized from an objective point of view in consideration of protection measures and terms of use. I think it can give significant implications for future related disputes.
