근래 부모가 자녀를 살해한 사건들이 이어지면서 큰 사회문제가 되었고, 이에 대응하고자 현재 국회에는 형법에 비속살해죄 규정을 신설하기 위한 법안들이 발의되어 국회와 행정부에서 비중있게 검토되고 있다. 형법전에 비속살해죄를 별도로 규정하여 가중처벌하는 국가는 드물다. 미국의 경우 ‘비속살해’ 대신 ‘아동살해’라는 개념이 사용되고 있고, 형법전상 아동살해죄를 살인죄의 가중요건으로 규정하여 기준연령에 이르지 못한 아동을 살해하면 처벌을 가중하는 주(州)가 과반수인 26개에 달한다. 미국의 사례 등을 검토한 결과 현재 우리나라 국회에 계류 중인 비속살해죄 신설안에 특히 다음과 같은 문제가 있음을 알 수 있다. 첫째, 존속살해죄 규정을 강화하여 그 폐지가 요원해진다. 둘째, ‘아동’과 ‘비속’을 혼동하여 입법목적과 법조문에 논리적 일관성이 없다. 셋째, 아동살해범죄는 유교 관념에 입각한 부모-자녀관계보다 보편적 가치인 아동인권의 관점에서 접근하여야 한다. 넷째, ‘비속살해’보다는 ‘아동살해’라는 개념이 피해자인 아동의 관점에 더 부합한다. 다섯째, ‘비속살해죄’는 아동살해 범죄의 주체가 직계존속으로 제한되어 추후 재개정이 요구될 수 있다. 여섯째, ‘비속’이라는 개념은 ‘아동’의 보호조치 등을 규정한 아동학대범죄의 처벌 등에 관한 특례법과 유기적으로 연결되지 않는다. 따라서 본고는 1) 형법을 개정하지 않고 아동살해를 살인범죄 양형기준상 가중요건으로 추가하거나, 2) 형법 개정이 불가피하다면 미국의 사례와 같이 ‘비속살해죄’ 대신 ‘아동살해죄’를 가중처벌하는 규정을 신설할 것을 제안한다.
In recent years, cases in which parents murder their children have become a major social problem, and in order to respond to this, bills to add a provision on filicide to the Criminal Act have been proposed and are being reviewed by the National Assembly and the Ministry of Justice. In the current criminal code of many countries, including Germany and Japan, which have a legal system that is similar to the Korean system, the crime of filicide is not stipulated or subject to aggravated punishment. However, in the penal code of twenty-six states in the United States, the concept of “child murder” is used instead of “filicide,” defined as an aggravating factor for first-degree murder. The bills to add a provision on filicide to the Criminal Act, which are currently pending in the National Assembly, are problematic considering the following points: First, the grounds for the provision on the crime of killing an ascendant will be strengthened, making it difficult to abolish it. Second, there is no logical consistency between the legislative purpose and the legislative text. Third, child murder should be approached from the perspective of children’s human rights, a universal value, rather than the traditional parent–child relationship based on Confucianism. Fourth, the concept of “child murder” rather than “filicide” is better aligned with the victim’s perspective. Fifth, a provision on filicide may need to be revised in the near future, since the subject of the crime is limited to ascendants. Sixth, the concept of filicide is not closely connected to the Act on Special Cases Concerning the Punishment of Child Abuse Crimes, which stipulates protective measures for children and not descendants. Therefore, this paper proposes 1) to add child murder as an aggravating factor to the sentencing guidelines for murder without revising the Penal Code or 2) to create a provision that imposes aggravated punishment on child murder instead of “filicide” as in the case of the United States—if revising the Criminal Code is inevitable.
