파라미터 발명의 개념 설정과 관련하여, 파라미터 발명의 특수성은 해당 발명이 ‘출원 당시 통상의 기술자가 이해하기 어려운 특정 물성 치로 표현된 발명’이라는 점에서 비롯되는 것이기는 하나, 개념 안에 ‘이해의 곤란함’이라는 실체적 판단요소가 포함된다면, 명세서 기재요건, 특허요건 등에서 다루어져야 할 쟁점들이 발명의 분류 단계에서부터 중복하여 다투어질 우려가 있으므로, 파라미터 발명의 개념 자체는 특정 물성 치에 의해 특정되는 발명인 것으로 폭넓게 인정한 다음, 파라미터 발명의 특수성(통상의 기술자에 의한 이해의 어려움)은 특허요건의 각 판단 국면에서 고려되도록 운용하는 것이 소송상 불필요한 공방의 억제를 위해 바람직하다.
한편 파라미터 발명의 특수성을 고려한 특허성 여부의 각 판단 국면별 개별적 검토가 필요하다는 사정이 파라미터 발명과 일반 발명의 각 특허성 판단 기준 자체가 상이함을 전제로 하는 것이 아님을 주의하여야 한다. 이와 관련해서는 최근 선택발명 등 특수 유형 발명의 진보성 판단 사건들에서 내려진 일련의 대법원판결들을 주목할 필요가 있다.
비발명, 미완성발명 등 발명의 성립(또는 완성)을 비롯하여 산업상 이용 가능성에 대한 기존의 일반 논의들은 그 실체가 중첩되는 범위 내에서 파라미터 발명의 해당 논의에 적용될 수 있다. 이때 미완성발명, 실시가능 요건, 뒷받침 요건 상호 간의 관계에 있어서는 실시가능 요건 충족 여부가 우선적으로 판단되는 것이 바람직하다. 명세서 기재요건과 관련해서, 파라미터 발명과 의약용도 발명의 효과 기재 정도가 항상 동등한 수준으로 이루어져야 한다고 볼 수는 없다.
파라미터 발명이 이미 공지된 기술인지의 여부는, 먼저 해당 파라미터 발명의 대상 유형을 확정한 다음, 그 보호범위에 맞추어 해당 파라미터 발명의 물성 치를 공지된 기술의 다른 물성 치로 환산하여 그 중첩 여부를 살펴보거나, 양 발명의 구체적 실시형태를 서로 비교하여 그 중첩 여부를 살펴보는 등의 여러 가지 간접 정황에 의해 인정되도록 하는 것이 타당하다.
파라미터 발명의 신규성 및 진보성은 위와 같은 간접 정황에 의해 이해·파악된 파라미터 발명의 내용이 선행발명의 대응되는 부분과 대비됨으로써 해당 파라미터 발명이 선행발명에 대해 신규성 및 진보성을 인정받을 수 있는지가 판단되는 것이다. 특허청 심사기준도 대체로 이와 같은 취지로 규정되어 있다. 다만 합리적인 의심이 드는 경우 구성의 엄밀한 대비 없이 파라미터 발명의 신규성 및 진보성 거절이유를 통보할 수 있다고 규정한 부분과 관련해서는 굳이 ‘합리적인 의심’이라는 용어를 사용함으로써 파라미터 발명의 신규성 및 진보성 부정에 대한 증명책임 완화 또는 전환의 논란을 불러일으킬 필요가 없을 것으로 보이므로 재고를 요한다.
최근 대법원판결은 파라미터 발명의 개념을 구체적으로 정립하고, 파라미터 발명의 신규성 및 진보성 판단에 관한 체계를 보다 정합적으로 구축하며, 파라미터 발명의 신규성 판단에 대한 증명책임의 정도를 명확히 하였다는 점에서 의의가 크다.
The peculiarity of the parameter invention stems from the fact that the invention is “expressed in a particular physical property value that is difficult for the ordinary skilled in the art to understand at the time of application.” However, if the concept of this invention includes a substantive judgment element of “difficulty of understanding”, then there is some risk that the issues to be handled in the latter stages of litigation, where the written description requirements and the patentability, etc. are examined, are contested in duplicate from the earlier stages where the type of invention is determined. Thus it is desirable that the concept of the parameter invention itself be broadly recognized as being an invention specified by a particular physical property value while the peculiarity of the parameter invention, that is, the difficulty of understanding the invention by the ordinary skilled in the art, is to be taken into account in each phase of the judgment phase of the written description requirements and the patentability.
It should be noted that the circumstances that a patentability judgment taking into account the peculiarity of the parameter invention is necessary do not presuppose that the patentability judgment criteria of the parameter invention and the general invention are different from each other. In this regard, it is worth noting a series of recent Supreme Court rulings in cases that have deliberated on the non-obviousness of special types of inventions, such as selective inventions.
Existing general discussions of industrial availability, including the establishment (or completion) of inventions, which can be categorized into non-inventions and incomplete inventions, can be applied to the corresponding discussion of parametric inventions to an extent of overlap of the substantive substance of such discussions. It is desirable that the satisfaction of the enablement requirement be determined ahead of the determination of the whether the invention in question is an incomplete invention and whether the supporting requirement has been satisfied. It cannot be considered that the degree of effect description of the parameter invention and the invention for medicinal use should always be at an equal level.
Whether the parameter invention is a skill already known in the art should be decided by first examining the category of the parameter invention in question, and then by checking the identity of the physical properties of the inventions in light of various indirect circumstances.
The current Manual of Patent Examination Procedure of Korean Intellectual Property Office provides that if there is a “reasonable doubt” that two are the same invention, the reasons for rejection may be notified that there is no novelty and non-obviousness compared to a prior art. However, it is necessary to reconsider the above provision, since it provokes controversy as to whether the burden of proof has been relieved or shifted in relation to the determination of the patentability of a parametric invention.
The recent Supreme Court ruling is significant in that it specifically establishes the concept of parameter invention, develops a coherent structure of the novelty and non-obviousness judgments of parameter invention, and clarifies the degree of the burden of proof for determining the novelty of parameter invention.
