2021년 「환경정책기본법」이 개정되면서 수익자부담원칙이 환경재정원칙으로 수용되었다. 이 논문은 「환경정책기본법」에 도입된 수익자부담원칙의 등장배경 및 필요성, 그리고 오염원인자책임원칙과의 구별, 기존 개별법상의 적용사례와 수익자부담원칙이 구체적으로 적용되기 위한 요건과 향후 법적 과제를 다루었다. 수익자부담원칙을 통하여, 공동체의 구성원들로 하여금 자신들이 환경보전사업의 중요한 수혜자이며 이와 관련하여 현저한 이익을 얻은 수익자라면 환경보전이라는 공공재·공공서비스의 비용을 함께 부담함으로써 환경보전을 위한 재원 조성에 기여할 수 있어야 한다는 점에서 의미가 있다. 문제는 수익자부담원칙의 개별 환경분야에 적용하는 경우 그 요건에 관한 입법설계가 용이하지 않다는 점이다. 수익자부담원칙의 적용요건과 관련하여 ① 국가가 제공하는 공공재·공공서비스인 환경보전사업의 내용, ② 현저한 이익의 내용과 ‘현저한 이익을 얻는 수익자’의 범위, ③ ‘해당 환경보전을 위한 사업’에 대하여 수익자가 부담하는 비용에 대한 판단, ④ 수익자가 부담한 전부·일부의 비용에 대한 회계처리 등에 대한 단계적인 검토가 필요하다. 이에 관한 헌법재판소나 대법원의 판례이론도 향후 입법과정에 반영하여야 하지만 기존의 수익자부담금이 적용되고 있는 개별법에 관해서도 차제에 전반적 검토와 개선이 필요하다. 중요한 것은 수익자부담원칙이 적용되는 영역의 확대와 관련하여 최근에 국내외적으로 기후위기에 따른 환경정책이나 제도설계로 인하여 현저히 이익을 보는 자가 있는 경우에 그 비용을 부담시켜야 한다는 견해가 설득력을 얻고 있다. 이외에 폐기물 관련 정책이나 시설설치 및 운영 등의 비용부담에 관하여 수익자부담원칙의 적용을 검토하는 것도 향후 중요한 과제로 남아 있다. 물관리 비용부터 공원입장료, 생태계서비스 비용, 기후위기대응정책비용, 폐기물처리비용 등 개별환경분야에 지속가능성과 사회적 형평성 이념을 확장하기 위하여 수익자부담원칙의 점진적 확대를 위한 많은 고민이 필요한 시점이다.With the revision of the 「Environmental Policy Framework Act」 in 2021, The Beneficiary Pays Principle(BPP) was accepted as the environmental finance principle. This thesis examines the background and necessity of The Beneficiary Pays Principle introduced in the 「Framework Act on Environmental Policy」, the distinction from The Polluter Pays Principle(PPP), the application cases of the existing individual laws, the requirements for the specific application of the principle of beneficiary burden, and future legal tasks. Through the Beneficiary Pays Principle, the members of the community are encouraged to share the cost of public goods and services called environmental conservation if they are important beneficiaries of the environmental conservation project and are beneficiaries who have obtained significant profits in this regard. It is meaningful in that you should be able to contribute.
The problem is that, when The Beneficiary Pays Principl is applied to individual environmental fields, it is not easy to design legislation regarding the requirements. Regarding the application requirements of The Beneficiary Pays Principl: ① Contents of environmental conservation projects that are public goods and public services provided by the state, ② Contents of significant profits and the scope of ‘beneficiaries who obtain significant profits’, ③ ‘Projects for environmental conservation’ A step-by-step review is necessary for determining the cost to be borne by the beneficiary, and accounting for all or part of the expenses borne by the beneficiary.
The case theory of the Constitutional Court or the Supreme Court on this should also be reflected in the future legislative process, but overall review and improvement of individual laws to which the existing beneficiary contribution is applied is also necessary.
Importantly, in relation to the expansion of the area to which the Beneficiary Pays Principle is applied, the view that if there is a person who has significantly benefited from the environmental policy or institutional design caused by the climate crisis at home and abroad in recent years, it is persuasive that the cost should be borne. In addition, it remains an important task in the future to review the application of the Beneficiary Pays Principle in relation to the cost burden of waste-related policies and facility installation and operation. It is time to think a lot about the gradual expansion of the Beneficiary Pays Principle in order to expand the ideology of sustainability and social equity in individual environmental fields such as water management costs, park admission fees, ecosystem service costs, climate crisis response policy costs, and waste treatment costs.
