임금피크제는 2013년 개정 「고용상 연령차별금지 및 고령자고용촉진에 관한 법률」이 정년을 60세로 연장함에 따라 이에 수반하는 임금체계 개편 조치의 핵심적인 수단 중 하나로 여러 기업들에서 활발하게 도입되었고, 최근 그 효력에 관한 다수의 판결들이 선고되고 있다. 이 연구는 임금피크제의 효력에 영향을 미치는 절차적, 실체적 요건과 그 구체적인 판단 기준에 관한 것이다.
임금피크제의 절차적 쟁점은 임금피크제가 단체협약이나 취업규칙 변경과 같은 방식으로 기업 내에 도입되는 과정에서 문제가 된다. 임금피크제가 취업규칙의 변경 방식으로 도입되는 경우 이는 근로자에게 불이익한 변경에 해당할 가능성이 크다. 이 경우 임금피크제는 취업규칙의 불이익 변경 절차를 거쳐야 하며, 그렇지 못한 경우 사회통념상 합리성이라는 까다로운 예외적 요건을 갖추어야 그 효력을 인정받을 수 있다.
실체적 요건과 관련하여서는 임금피크제가 고용상 연령차별금지를 위반한 것에 해당하는지가 가장 중요한 쟁점이 된다. 최근 대법원에서 확인한 것과 같이 고령자고용법의 고용상 연령차별금지 규정은 강행규정이므로, 임금피크제가 이 강행규정을 위반하는 경우 그 효력을 인정받을 수 없다. 임금피크제가 연령차별금지를 위반한 것인지는 차별의 합리적 이유의 유무를 기준으로 판단하게 된다. 임금피크제가 합리적 이유가 없는 연령차별인지는 정년유지형인지, 정년연장형인지 등과 같이 일의적 기준에 따라 결정되는 것이 아니다. 합리적 이유의 존부는 차별적 처우의 필요성, 차별적 처우의 방법·정도 등의 적정성을 비롯한 제반 사정을 고려하여 판단해야 한다. 차별적 처우의 필요성과 관련하여서는 임금피크제 도입 목적의 타당성, 임금피크제로 마련된 재원의 사용처를, 차별적 처우의 방법·정도 등의 적정성과 관련하여서는 근로자의 불이익의 정도, 임금 삭감에 대한 대상조치의 도입 여부 및 적정성을 충분히 검토하여야 한다.As the 2013 Act on Prohibition of Age Discrimination in Employment and Elderly Employment Promotion(hereinafter “the Act”) raised the mandatory retirement age to 60, the wage peak system was actively introduced by various companies, and a number of court rulings have recently been issued on its effectiveness. This study is about procedural and substantive requirements that affect the effectiveness of the wage peak system and its specific criteria for judgment.
The procedural issue on the wage peak system arises a problem in the process of introducing the wage peak system by collective agreements or changes to employment rules. If the wage peak system is introduced by changing employment rules, it is highly likely to be a disadvantageous change for workers. In this case, the wage peak system must go through the procedure of changing employment rules to address the disadvantage of workers, and if not, it must meet strict exceptional requirements of the socially accepted rationality to be recognized.
Regarding the substantive requirements, the most important issue is whether the wage peak system violates the prohibition of age discrimination in employment. As recently confirmed by the Supreme Court, the prohibition of age discrimination in employment under the Act is a mandatory regulation, so if the wage peak system violates this mandatory regulation, it shall be invalidated. Whether the wage peak system violates the prohibition of age discrimination is judged based on the existence of reasonable grounds for discrimination. Whether the wage peak system is age discrimination without a reasonable ground is not determined according to uniform standards such as whether it is a retirement age maintenance type or a retirement age extension type. Whether or not the reasonable ground is recognized shall be judged by considering all circumstances such as the necessity of discriminatory treatment and the appropriateness of the method and degree of discriminatory treatment. Regarding the necessity of discriminatory treatment, the validity of the purpose in introducing the wage peak system, the use of funds secured by reducing wages of the aged should be reviewed. And regarding the appropriateness of the method and degree of discriminatory treatment, the degree of disadvantage for senior-aged workers, and whether appropriate countermeasures for wage reduction have been introduced should be fully reviewed.
