학계에서는 일찍이 선구적인 견해로부터 적극적 형사주권론이 선견성 있게 제창되었다. 이러한 “형사주권론”을 토대로 하여 이행법률은 대한민국의 1차적 재판권의 근거를 적극적으로 규정하고 있다. 또한, 동법 제3조 제5항은 세계주의를 규정하고 있다. 동법의 세계주의 규정에 의하면, 외국에서 핵심범죄를 저지르고 국내로 도피해 온 외국인 범죄자가 그 주된 대상이다. 그리고 해외로 도피한 범죄자에 대해서는 대한민국은 해당 국가에 대하여 범죄인인도를 요청할 수 있다. 북한인 행위자에 대해서도 역시 그러하다. 이때 법원은 외국으로부터 범죄자를 인도받아 재판권을 행사할 수 있다.
우리나라가 “국제형사재판소 규정”에 가입한 이후, 당사국의 사형규정은 피고인 측으로부터 국제규범과 상응하지 아니하다는 비판에 직면하여 왔다. 특히, 리비아 사형규정의 보복 위험성이나 자의적 운영이 논란의 대상으로 되었다. 카다피와 세누시의 범죄행위가 동일한 유형이었음에도 불구하고, 리비아의 사형재판은 상이하게 진행되었다. 카다피 사건의 사형재판은 조기에 확정된 후 사면되었는가 하면, 세누시의 경우에는 그러하지 아니하였다. 세누시 사안에 있어서 전심재판부는 세누시에 대한 리비아의 재판을 거부하고, 그래서 세누시는 국제형사재판소에 인계되어 재판을 받아야 할 것이라고 주장되었다. 카다피 사안에서 국제형사재판소는 국제규범에 상응한 논지에 따라 사형재판의 자의성을 이유로 리비아의 재판권을 배척하였다.
제2차 세계대전을 거치며 전체주의 국가체제 아래 수많은 인명이 사형규정에 의하여 희생되었다. 중국의 정권 교체기나 대한민국의 전쟁 과정에서도 사형규정 적용에 따라 부적절하게 생명권을 침해하는 사례들이 발생하였다. 이것은 사형규정의 자의적 적용 때문이었다. 사형존치국 피고인은 사형선고의 위험에 처한다. 그리하여, 사형존치국가의 1차적 재판권 행사 여부 등과 관련하여, 국제형사재판소에서 판단되는 기준 역시 국제형사재판소 규정 제21조를 근거로 하여 보다 높게 설정될 수밖에 없었다. 장차 이행법률의 적용단계에서도, 사형규정으로부터 얻고자 하는 실익은 불가피하게 감소하는 것이라고 생각된다. 그럼에도 불구하고, 여전히 입법자는 사형제도를 존치하고자 한다. 이러한 측면에서 필자는 핵심범죄 피고인에게 이행법률에 의한 사형규정을 적용함에 있어서 실효적으로 재판권을 확보할 수 있는 방안을 고찰하였다.
Korean Act for Implementation of the Rome Statute(Act on punishment, etc. of crimes under jurisdiction of the international criminal court) regulates the death penalty. Reflecting developments in international human rights law, the Rome Statute of International Criminal Court excludes any possibility of sentencing death penalty. However, the statutory rules in the Statute shall not affect the national law on the matter which may provide for the death penalty. Yet, the article 21. 3 of the Rome Statute directs the Court to be consistent with International Human Rights Norms. Amnesty International also opposes to the death penalty in all cases without exception. The Article has still been read to prohibit an abolitionist country from sending a person to a retentionist country. As a result, the summery of this paper is as follows.
Firstly, the author discusses that the more the Rome Statute could be protective of domestic due process, then the more protective against imposition of the death penalty. It isn’t consistent with international human rights to indirectly authorize trial in a country that retains the death penalty. The extradition of the accused to the nation where the death penalty is available would violate his rights under the article 7 of International Covenant on Civil and Political Rights.
Secondly, he argues that no penal code should be only retributory. In a situation where the right to a fair trial is violated and the death penalty may be imposed, there is a compound human rights violation. Thus the ‘Implementation Act’ must be applied in accordance with the right to a fair trial.
Lastly, the resolutions for abolitionist countries had been gone through in the Statute. Naturally there is gab for punishment of the crimes within jurisdiction of the Court between abolitionist and retentionist country. Therefore, for de lege lata and de lege ferenda the article of the capital sentence in ‘Implementation Act’ might be restrictly interpreted and reformed.
