게임 저작물은 그 구성요소에 시청각적, 시나리오적, 캐릭터적 요소가 포함되어 있다는 점에서 영화, 뮤지컬 등의 저작물과 유사하나, 사용자가 저작물과 상호작용을 한다는 점, 컴퓨터 프로그램에 의해 구동된다는 점에서 다른 저작물과 구별된다. 이와 같은 게임 저작물의 특징 중에서도 사용자와의 상호작용은 가장 두드러진 특징이고, 상호작용에 있어 신선한 경험을 제공하는지 여부가 해당 게임의 성공은 물론 관련 산업의 발전을 크게 좌우한다. 따라서 게임 저작물에 있어서는 상호작용에 관한 부분에 저자의 창작성이 가장 크게 발휘되어야 하고, 또 발휘되는 것이 일반적인바, 다른 부분과 독립하여 이에 관한 부분 또한 보호되어야 한다.
다만 오늘날에는 상호작용에 관한 부분 중 저작권법의 보호대상인 것이 명백한 부분(시청각적, 시나리오적, 캐릭터적 표현 등)이 실질적으로 유사해 저작권 침해가 문제 되는 경우는 찾아보기 어렵고, 게임의 규칙, 진행·작동방식 등 그 자체나 그 선택·구성·배치·조합이 유사하나 이를 구현한 시청각적, 시나리오적, 캐릭터적 표현에서 다소 차이가 있는 경우에 저작권 침해가 주로 문제 되고 있다. 이와 같은 경우에 시청각적, 시나리오적, 캐릭터적 표현에 차이가 있다는 이유만으로 저작권 침해를 일률적으로 부정하게 되면, 원 게임을 모방한 게임이 순식간에 다수 등장하여 원 게임과 성공의 과실을 공유하게 되는 것을 막을 수 없는바, 게임 저작물에 대하여는 그 산업의 향상·발전이라는 저작권 보호의 목적을 달성할 수 없게 될 것이다.
상호작용에 관하여는 신선한 시청각적, 시나리오적, 캐릭터적 표현을 하는 것에 못지않게 신선한 규칙, 진행·작동방식 등을 도입하여 이들을 다른 요소와 적절하게 선택·구성·배치·조합하는 것이 중요하다. 여기에 게임 저작물에 편집저작물적인 성격이 있다는 점을 더하면, 게임의 규칙, 진행·작동방식 등을 포함한 구성요소의 선택·구성·배치·조합에 창작성이 인정되는 경우에는 편집저작물에 관한 법리를 준용해 게임 저작물 전체를 보호할 필요성이 있다. 물론 그와 같은 경우에도 그 조합 등의 실질적 유사성이 인정되어야 함에 더하여 이를 구현한 시청각적, 시나리오적 또는 캐릭터적인 표현 사이에도 실질적 유사성이 인정되어야 하나, 그 조합 등의 실질적 유사성이 인정되는 이상 이를 구현한 표현의 실질적 유사성의 인정 요건이 다소 완화되어야 할 것이다.
이런 점에 다른 저작물과 구별되는 게임 저작물의 특성과 판단 대상·방식·결과에 대한 당사자들의 예측 가능성 보장이라는 측면까지 고려하면, 규칙, 진행·작동방식 등에 관한 표현 부분을 아이디어에서 분리하되 표현 사이의 실질적 유사성 여부를 판단함에 있어 전체 설정, 테마, 구상, 분위기 등도 고려해 유사성을 넓게 인정하는 미국 법원의 판단 방식보다는 구성요소의 선택·구성·배치·조합에 창작성이 인정되는 때에 추상적 게임 규칙 등 저작권법의 보호대상에 해당하지 않는 구성요소의 선택·구성·배치·조합도 실질적 유사성 판단 시에 고려하는 우리나라 법원의 판단 방식이 보다 타당한 것으로 보인다. 따라서 앞으로 포레스트 마니아 사건의 법리에 따라 게임의 규칙, 진행·작동방식 등에 관련된 부분을 보호해야 할 것이다.
다만 그 법리를 적용함에 있어서는 당사자들로 하여금 유사성을 다투는 부분을 명확히 하도록 해야 하고, 그 조합 등이 유사하지 않거나 그에 관한 시청각적, 시나리오적, 캐릭터적 표현에 크게 차이가 나는 경우에 해당함에도 게임 저작물의 편집저작물적인 성격을 기초로 양 게임 사이의 실질적 유사성을 인정해 특정인이 저작권에 기해 장기간 아이디어를 독점하는 것을 인정하는 결과가 발생하지 않도록 유의해야 할 것이다.Games have a lot in common with other copyrightable works such as movies and musicals in that they consist of audiovisual elements, scenarios, and characters. Today's conflicts are more about the games that have substantially similar rules, procedures, mechanisms without having substantially similar characters, scenarios, or audiovisual expressions. Therefore, it is the gist of today's copyright infringement conflicts to find out if game rules, procedures, mechanisms, and something like them can be protected by copyright by themselves or by other ways.
When it comes to fresh interaction experiences, it is imperative to introduce new rules, procedures, mechanisms, and so on, and then compose, arrange, and harmonize them with other elements, as well as to adopt distinguished audiovisual expressions and characters. Considering this combined with game's another characteristics as a compilation work, the game as a whole should be protected by copyright like a compilation work in such a case mentioned above. However, games are not pure compilation works, so requirements on similarities related to the embodiment of the rules, procedures, mechanisms, and so on should be eased unlike pure compilation work's cases.
In this sense, the way of reasoning mentioned above is more desirable than that of separating ideas from expressions and then determining if there are substantial similarities between expressions all the while considering theme, mood, setting, etc. Therefore, the parts related to rules, procedures, mechanisms, and something like them should be protected when they are creatively composed, arranged, harmonized with other elements like a compilation work. However, when the court applies this way of reasoning, they should make it clear what parts parties claim to be similar or different, and they should be careful not to let somebody monopolize ideas by copyright.
