위 판결의 법리가 선언된 이후 책임주의 원칙과 관련하여 해당 양형사유를 양형조건으로 참작할 수 있는지 여부가 실무에서 문제 된 사례들이 다수 있다. 폭행 등의 범행 이후 피해자가 사망한 경우, 성범죄 피해를 당한 피해자가 자살한 경우, 도주차량으로 기소된 사건에서 음주운전을 한 정황이 있는 경우 등에서 피해자의 사망이나 음주운전 정황 등을 양형사유로 참작하는 것이 적법한지에 관하여 실무상 논란이 있어왔다. 각각의 사안에서 해당 양형사유가 형법 제51조가 정한 양형조건에 포섭되는지 여부, 해당 양형사유가 합리적인 의심을 배제할 정도의 증명력을 갖춘 증거에 의하여 증명되었는지 여부, 해당 양형사유를 핵심적인 형벌가중적 양형조건으로 삼아 양형을 하였는지 여부를 검토하여야 한다.
먼저, 해당 양형사유가 형법 제51조가 정한 양형조건에 포섭되는 경우에 그 양형사유가 합리적인 의심을 배제할 정도의 증명력을 갖춘 증거에 의하여 증명되었다면, 이를 양형사유로 당연히 고려할 수 있다.
다음으로, 해당 양형사유가 형법 제51조가 정한 양형조건에 포섭되지 않는 경우 그 양형사유가 합리적인 의심을 배제할 정도의 증명력을 갖춘 증거에 의하여 증명되지 않았다면, 이를 핵심적인 형벌가중적 양형조건으로 삼는 것은 원칙적으로 허용되지 않는다고 보아야 한다. 다만 해당 양형사유를 핵심적인 형벌가중적 양형조건으로 삼지 않고 단순 참작하는 것만으로는 책임주의의 본질적 내용을 침해하였다고 볼 수 없다.
대상판결은 위 대법원 2008도1816 판결의 법리를 그대로 따르고 있는데, 특히 위 판결의 법리 중 ‘해당 양형사유를 핵심적인 형벌가중적 양형조건으로 삼아 양형을 하였는지 여부’에 관하여 구체적인 판단을 하고 있다.

해당 양형사유를 핵심적인 형벌가중적 양형조건으로 고려하였는지 여부는 공소가 제기된 범행의 법정형, 처단형과 양형기준상 권고형 범위, 공소가 제기되지 않은 범행의 법정형과 양형기준상 권고형 범위, 실제 선고된 선고형, 양형기준상 권고형 범위를 이탈한 정도, 항소심의 경우 제1심과 다른 양형조건에 의한 형의 급격한 가중 여부 등을 종합하여 구체적 사안에 따라 판단하여야 할 것이다.
대상판결은 원심이 ‘양형의 이유’에 공소가 제기되지 않은 필로폰 ‘판매’를 양형사유처럼 기재하기는 하였으나, 제1심과 비교하여 양형의 조건에 실질적인 변화가 없는 상태에서 필로폰 ‘판매’를 양형사유로 기재하지 않은 제1심과 같은 형을 정하여 선고하였으므로, 위 필로폰 판매 사실을 핵심적인 형벌가중적 양형조건으로 삼아 양형에 반영하였다고 보기 어렵다고 판단하였다. 대상판결은 공소제기되지 않은 범죄사실을 핵심적 양형조건으로 삼은 양형판단의 위법성과 관련한 종전 대법원판결(대법원 2008도1816 판결)의 법리를 유지하면서, 해당 양형사유를 핵심적인 형벌가중적 양형조건으로 삼았는지 여부에 관하여 구체적인 판단 기준을 제시하였다는 점에서 의의가 있다.
The gist of the subject case pertains to the questions of whether it can be regarded as illegal when sentencing is made with the fact of an offense that has not been prosecuted as a sentencing factor.
Previously, the Supreme Court Decision 2008Do1816 decided May 29, 2008 determined that if the trial court made sentencing by using the fact of an offense which is not included in sentencing factors as a key aggravating factor even though such fact has not been proven by evidence, it should be deemed illegal in violation of the principle of liability.
After the above Supreme Court decision was pronounced, there have been many cases where whether the corresponding fact may be taken into consideration as sentencing factors in relation to the principle of liability comes into question in practice.
First of all, if the sentencing factor is included in the sentencing factors listed in Article 51 of the Criminal Act, and the sentencing factor is proven by evidence with enough proof to rule out a reasonable doubt, it can be considered as a sentencing factor.
Next, if the sentencing factor is not covered by the sentencing factors listed in Article 51 of the Criminal Act, and the sentencing factor is not proven by evidence with enough proof to rule out reasonable doubt, it is not allowed to consider it as a key aggravating factor. However, simply taking into account the sentencing factor without making it a key aggravating factor cannot be seen as violating the principle of responsibility.
The subject case follows the jurisprudence of the above Supreme Court Decision 2008Do1816, and, in particular, made a specific judgment on whether the corresponding sentencing factor was used as a key aggravating factor.
According to the precedent, if the accused can be seen to be actually punished for the fact of an offense which has not been prosecuted, it can be said that the corresponding sentencing factor was considered as a key aggravating factor.
In the subject case, the second trial listed methamphetamine “sale” for which has not been prosecuted as a “sentencing factor.” However, the Supreme Court judged that viewing the above sales of methamphetamine as a key aggravating sentencing factor is difficult because the second trial passed the same sentence as the first trial with no substantial difference in sentencing conditions.
The subject case is meaningful in that it presented specific criteria for determining whether the corresponding sentencing factor was considered as a key aggravating factor.
