하도급거래 공정화에 관한 법률(이하 ‘하도급법’이라 한다) 위반행위의 수에 관한 논의나 관련 연구는 많지 않다. 독점규제 및 공정거래에 관한 법률(이하 ‘공정거래법’이라 한다) 위반과 관련하여 부당한 공동행위, 불공정거래행위와 같이 위반행위 유형에 따라 개별 사안별로 판례를 통한 기준이 제시되어 왔으나 이것만으로는 하도급법을 비롯한 공정거래법 위반행위의 개수 판단에 관하여 통일적인 기준을 도출하기는 무리가 있다. 하도급법 위반행위의 개수 판단에 관한 문제가 형사상 죄수론과 같이 모든 위반행위 유형을 관통하여 동일한 판단 기준을 정립하는 정도까지는 아니더라도 기본적인 면에서는 동일한 기준을 가지고 각 사안마다 유연하게 적용할 수 있도록 할 필요는 있다.
대법원 2022. 9. 16. 선고 2020두47021 판결(이하 ‘대상판결’이라 한다)은 원사업자가 수 개 수급사업자에게 기술자료를 요구하면서 서면을 교부하지 않은 행위 및 수 개 수급사업자의 기술자료를 유용하는 행위를 한 경우에 각 수급사업자에 대한 법 위반 행위의 종료시점 및 개수를 어떻게 보아야 하는지, 각 수급사업자에 대하여 별개의 위반행위로 볼 경우 과징금 산정 및 부과도 별도로 하여야 하는지 아니면 하나의 과징금을 산정하면 족한지 등의 쟁점을 다루고 있다.
특히 대상판결은 수 개 수급사업자의 기술자료 유용행위가 여러 차례 있을 경우에 이를 포괄하여 하나의 위반행위로 보는 판단 기준을 처음으로 제시하였다는 점에서 의의가 있다. 이 글에서는 공정거래법 및 하도급법 위반행위의 수와 관련하여 지금까지 선고된 대법원 판례를 종합, 정리하고 대상판결을 분석함으로써 하도급법 위반의 경우 포괄적 단일행위로 인정하기 위한 요건을 도출하고, 동일 유형의 위반행위가 수 개일 경우에도 하나의 과징금을 부과할 수 있다는 대상판결의 논거를 검토한다.
There are only a small amount of research or studies on the number of violations of the Act Concerning the Fair Transaction in Subcontracting Act (hereinafter referred to as the “Subcontracting Act”). In relation to the violation of the Monopoly Regulation and Fair Trade Act, several standards have been introduced through precedents for each type of violation in individual case, such as prohibition of unfair collaborative acts and unfair trade practices; however, such standards are insufficient to develop an overarching standard for determining the number of violations of the Monopoly Regulation and Fair Trade Act and the Subcontracting Act. Albeit that establishing a uniform standard for determining the number of violations of the Subcontracting Act, which is applicable across all types of violations, may not be necessary, as is the case in determining the number of offenses under criminal law, it is necessary to devise, at least on a fundamental level, a uniform standard and flexibly apply it to each individual case.
Supreme Court Decision 2020Du47021 decided on September 16, 2022 (hereinafter “subject case”) deals with the issues of (1) counting the number of violations for each subcontractor and the point at which the violating act was terminated in a case where the principal contractor requested technical data from several subcontractors but did not provide related documents and misappropriated the technical data of several subcontractors; and (2) if the acts are assessed as separate violations, whether to calculate and impose penalty surcharges separately for each violation or imposing a single penalty surcharge is enough.
In particular, the subject case is meaningful in that it is the first case to introduce a standard for viewing multiple acts of misusing the technical data by each subcontractor as one single inclusive violation. This article examines the rationale of the subject case that a single penalty surcharge can be imposed on a number of the same type of violations and attempts to derive the requirements for regarding multiple violations of the Subcontract Act as a comprehensive single act, by exhaustively reviewing and organizing Supreme Court precedents that have been adjudicated so far in relation to the number of violations of the Fair Trade Act and the Subcontracting Act and analyzing the subject case.
