앞으로 법관의 평균연령은 점차 증대될 것으로 예상되고, 그 결과 법관 1명이 사건에 들일 수 있는 시간과 노력은 체력 등 물리적인 측면에서 감소할 것으로 예상된다. 이에 대한 대책 중 하나는 법원 외의 분쟁해결절차를 강화하고 법원은 해당 절차를 통해서도 해결되지 않은 고분쟁 사건에 대해 역량을 집중하는 것이다. 행정소송분야에 있어서는 미국의 행정쟁송체계가 이러한 구조설계에 단초를 제공할 수 있다. 미국의 연방행정절차법은 규칙제정과 명령 등 재결을 하기 위해서 청문절차를 거치도록 규정하고 있다. 청문절차는, 행정법판사 등 청문 주재자가 당사자 등 이해관계인에게 청문실시를 통지하고, 당사자 등 이해관계인의 의견을 청취하며, 재판에 준하는 절차를 통해 증거를 수집하고 이에 대한 상세한 기록을 작성한 후, 청문 주재자가 스스로 초기 결정을 하거나 결정권자에게 결정권고를 하는 방식으로 진행된다. 비록 개별 행정기관의 행위는 대부분 개별법령에 의해 규율되는 관계로 연방행정절차법에 의한 엄격한 절차보다는 완화된 절차가 적용되나, 기본적으로는 일정한 신분보장을 받는 행정법판사로 하여금 행정기관에 소속되어 청문절차를 담당하게 하고 결정절차에 관여하게 함으로써 행정행위를 사전에 통제하는 구조이다. 미국 법원은 이러한 절차를 전제로 소송요건으로 최종성, 사건의 성숙성, (개별법령이 있는 경우) 보충성 등을 요구함으로써 행정기관의 전문성을 충분히 활용하고 법원의 업무부담은 경감하고 있다. 나아가 본안에서도 사실확정 및 법률해석에 있어서 행정기관의 판단을 상당히 존중하고 있는데, 특히 사전에 어떠한 절차를 거쳤느냐에 따라 존중 정도를 달리함으로써 절차통제를 중시하고 있다. 우리나라의 청문절차는 청문 주재자의 독립성, 최종 결정에 관여할 수 있는 정도, 이유제시 기능에 있어서 아직 많이 미흡하다. 이를 강화하기 위해서는 미국과 같이 법조경력자로 행정법판사 제도를 도입하여 재판에 준하는 의견청취, 증거수집절차를 거친 후 최종 결정에도 관여하게 하고 결정에 대해 판결문에 준하는 정도의 이유제시를 하게 하는 방안을 생각해 볼 필요가 있다. ‘최적 효율의 사회분쟁해결절차’를 수립하기 위해서는 모든 분쟁해결은 법원이 주도적으로 해야 한다는 관념을 깨고 미국과 같이 유연한 사고를 통한 해결책을 모색할 필요가 있다.
In the future, the average age of judges is expected to increase gradually, and as a result, the time and effort that a judge can spend on a case is expected to decrease in physical aspects. One of the countermeasures against this is to strengthen ‘dispute resolution procedures outside the courts.’ In the field of administrative litigation, the US administrative litigation system can provide a clue to such structural design. The Administrative Procedure Act (APA) of the US stipulates that a hearing procedure is required to make decisions such as rulemaking and orders. In the hearing procedure, the hearing presiding employee, such as an administrative law judge (ALJ), listens to the opinions of interested parties, collects evidence through a procedure similar to a trial, prepares detailed records, and makes the initial decision himself or makes a ‘decision recommendation’ to the agency. As most of the actions of administrative agencies are regulated by individual laws, a relaxed procedure is applied rather than a strict procedure according to the APA, but basically, it is a structure that controls agency actions in advance by allowing ADJ to proceed hearings and make detailed records and to be involved in the decision-making process. On the premise of the procedure, U.S. courts are making full use of the expertise of administrative agencies and reducing the workload of the courts by requiring finality, ripeness of the case, and (if there is an individual statute) exhaustion of administrative remedies as the litigation requirements. Furthermore, the judgment of the administrative agency is highly respected in fact finding and legal interpretation. Korea’s hearing procedures are still very lacking in the independence of the hearing presiding officer, the extent to which he/she can be involved in the final decision, and the function of giving reasons. To strengthen this, it is necessary to consider US-style administrative procedures such as ALJ. In order to construct an ‘optimal efficiency social dispute resolution procedure,’ it is necessary to break the notion that all dispute resolution must be led by the courts and seek solutions through flexible thinking like the United States.
