각 국가는 보호하는 지식재산권의 종류 및 그 보호의 요건, 침해 시 구제 수단 등을 개별적, 독자적으로 정하고 있다. 그리고 속지주의 원칙에 따라 지식재산권의 성립·변동·소멸 및 내용은 그 지식재산권을 권리로서 인정하고 이를 부여한 당해 국가의 법률에 의하여만 결정되며, 그 효력은 이를 부여한 국가의 영토주권이 미치는 영역 안으로 한정된다. 최근 세계화와 디지털화 및 손쉬운 전파수단의 발달로 국경을 넘는 지식재산권 계약이나 침해행위가 증대되고 있다. 이로 인해 외국적 요소를 포함하고 있는 분쟁에서 지식재산권에 대한 보호를 구하거나 그와 관련된 계약을 근거로 이행을 구하는 소송에서 지식재산권에 대한 성립, 유효성, 소멸 등이 선결문제로서 종종 쟁점이 되고, 국내 법원이 이를 심리함에 있어 국제재판관할권, 준거법과 같은 국제사법적 쟁점이 선결적으로 문제 된다.
최근 전부 개정된 국제사법은 헤이그관할합의협약 등 국제규범을 참작하여 지식재산권 분쟁을 규율하는 여러 국제재판관할 규정을 새로이 도입하였다. 즉 국제사법은 이제 지식재산권 분쟁과 관련하여 합의관할(제8조), 전속관할(제10조), 지식재산권 계약에 관한 소의 특별관할(제38조), 지식재산권 침해에 관한 소의 특별관할(제39조) 등에 관하여 명시적으로 규정하게 되었고, 반면 준거법과 관련해서는 보호국법주의를 선언한 규정(제24조)이 조문의 위치만 바뀌어 거의 동일한 내용으로 규정(제40조)되었다. 이제 실무에서 국내 법원이 국제적 지식재산권 분쟁을 처리함에 있어 개정된 국제사법에 따라 위 각 규정을 충실히 해석하고 적용하는 것이 필요하다.
이를 위해 이와 관련된 여러 국내외 판례와 이론을 ① 당사자 간의 합의가 있는 경우, ② 지식재산권의 성립, 유효성과 소멸이 쟁점인 경우, ③ 지식재산권 이용 등의 계약이 있는 경우, ④ 지식재산권 침해가 쟁점인 경우로 나누어 각 재판관할권과 준거법에 대하여 해당 조문을 중심으로 정리하였다. 나아가 지식재산권 가처분 소송이나 영업비밀 침해 사건, 직무발명보상금 사건, 도메인이름 분쟁 등에 대하여도 관련 내용을 정리하였다.
Each country individually and independently defines the types of intellectual property rights (hereinafter “IP rights”) to be protected, the requirements for protection, and the remedy in case of infringement. Under the territoriality principle, the establishment, assignment, and extinction, and the content of IP rights are regulated only by the laws of the country which grants them, and the effect of IP rights is limited within the territorial boundaries of each sovereign country. With globalization, digitalization, and the development of easy means of propagation, cross-border intellectual property contracts or infringements are recently increasing. As a result, the issues of the establishment, validity, and extinction of IP rights often arise as a prerequisite question in lawsuits with foreign elements seeking protection of the rights or in disputes based on IP related contracts. Thus, domestic courts often encounter the international issues, such as international jurisdiction and choice of law in the litigation.
The recently revised Private International Law has introduced several new international jurisdiction rules that govern IP disputes by taking into account international norms, such as the Convention on Choice of Court Agreement. Specifically, the Private International Law explicitly stipulates jurisdiction by agreement (Article 8), exclusive jurisdiction (Article 10), special jurisdiction over lawsuit regarding contract for IP rights (Article 38), special jurisdiction over lawsuit regarding infringement of IP rights (Article 39), etc. On the other hand, with respect to governing law, the provision declaring of the principle of lex protectionis (Article 24) was regulated with almost the same content in the other article (Article 40).
From now on, in practice, it is necessary for domestic courts to correctly interpret and apply each of the above new provisions in the amended Private International Law when dealing with international IP disputes. To this end, this thesis has mainly analyzed the relevant provisions regarding jurisdiction and governing law by separating precedents and theories of various domestic and foreign into each circumstance as follows: ① when there is an agreement between the parties in suit; ② when the establishment, validity and extinction of IP rights are on the issue; ③ when there is a license agreement for use of intellectual property; and ④ when the infringement of IP rights is on the issue. This thesis further has covered related subject matters on intellectual property preliminary injunction cases, trade secret infringement cases, employee invention compensation cases, and domain name disputes.
