타인의 선출원 등록권리의 권리범위에 속하는 행위임에도 후출원 등록권리 객체의 사용 또는 실시라는 이유로 침해가 부정되는지에 관하여 논란이 있어왔다. 종래 대법원 1986. 7. 8. 선고 86도277 판결, 대법원 1999. 2. 23. 선고 98다54434, 54441 판결은 후출원 등록상표를 무효로 하는 심결이 확정될 때까지는 후출원 등록상표권자가 자신의 상표 사용행위로서 선출원 등록상표와 동일·유사한 상표를 그 지정상품과 동일·유사한 상표에 사용하는 것은 선출원 등록상표권에 대한 침해가 되지 않는다고 판시하여 침해 부정의 가장 큰 근거가 되었다. 위 판결은 심사를 거쳐 등록된 산업재산권의 효력을 보장하여야 한다는 취지를 담고 있고 이러한 취지가 일반론으로서 타당하다고 할 수는 있으나, 원래 산업재산권 권리 부여의 체계상 선출원에 대하여 대항할 수 있는 근거가 없는 후출원을 단지 등록되었다는 이유만으로 선출원 등록권리자와의 관계에서까지 강력하게 보호하여야 하는지 의문이 있었다.
대상판결은 대법원 전원합의체 심리를 거쳐 상표권자가 상표등록출원일 전에 출원·등록된 타인의 선출원 등록상표와 동일·유사한 후출원 등록상표를 선출원 등록상표권자의 동의 없이 선출원 등록상표의 지정상품과 동일·유사한 상품에 사용하였다면 후출원 등록상표의 적극적 효력(전용권)이 제한되어 후출원 등록상표에 대한 등록무효 심결의 확정 여부와 상관없이 선출원 등록상표권에 대한 침해가 성립함을 명확하게 하였다. 또한 이러한 법리가 특허권과 실용신안권, 디자인권의 경우에도 마찬가지로 적용됨을 밝혔다.
대상판결은, 피고가 후출원 등록권리의 존재를 주장하더라도 후출원 등록권리에 대한 무효 심결의 확정을 기다릴 필요 없이, 후출원 등록권리의 객체를 사용하거나 실시하는 행위가 선출원 등록권리의 권리범위에 속하는지를 심리·판단하면 족함을 밝힘으로써, 무효와 침해 판단의 절차적 이원화를 극복하고 침해소송 법원이 간명하게 완결적인 판단을 하도록 하였다는 점에서 의의가 크다. 이제 대상판결로 후출원 등록 권리 항변은 받아들일 수 없음이 명확하게 되었으므로, 앞으로 사실심 법원 심리에서는 후출원 등록권리 객체의 사용 또는 실시가 고의·과실에 의한 침해로 인정될 것인지에 보다 집중할 수 있게 되었다.
대상판결은 또한 후출원 등록상표의 사용이 선출원 등록상표권 침해로 됨을 인정하면서 후출원 등록상표권은 무효로 될 것임이 명백하다는 취지의 권리남용 법리를 원용하지 않고 있어, 이 점에서도 의의가 크다고 생각된다. 무효절차를 통한 무효 확정이 이루어지기 전이지만 등록권리의 행사를 저지하기 위해서는 권리남용의 항변과 같은 법리가 필요하나, 애초에 선출원 등록권리와의 관계에서만 상대적인 효과로서 후출원 등록권리의 전용권을 제한하는 저촉관계에서는 선출원 등록권리의 침해를 인정하기 위해 후출원 등록권리에 대하여 권리남용 항변과 같은 법리를 원용할 필요가 없다고 생각된다. 원래 이용·저촉관계에 의하여 후출원 등록권리자의 전용권이 제한되는 효과는 선출원 등록권리와의 관계에서만 일어나는 상대적인 효과이고, 선출원 등록권리자와 무관한 제3자와의 관계에서는 후출원 등록권리의 행사에 제약을 받지 않는다는 법리(대법원 2006. 9. 11. 자 2006마232 결정 참조)에 의하여 보더라도 그러하다. 출원의 선후를 기준으로 간명하게 침해의 성립 여부를 판단할 수 있게 하는 대상판결의 법리는 논리가 일관되고 명쾌하며 법적 안정성을 가져온다는 점에서도 의의가 크다.
Although an act falls within the scope of the rights of the right which another person applied and registered first, there has been controversy over whether the infringement is denied on the grounds that such act is an act of using or practicing the object of the right which he or she applied and registered later. The previous Supreme Court Decisions including Supreme Court Decision 86do277 decided July 8, 1986 and Supreme Court Decision 98da54434, 54441 decided February 23, 1999 ruled that the use of the trademark by the trademark holder was not infringed even if the trademark was identical or similar to the trademark registered by another person first until the trademark registered by a subsequent application was invalidated. The above ruling contains the purpose of ensuring the effect of registered industrial property rights through examination, and this purpose can be said to be valid as a general theory. However, in the system of granting industrial property rights in accordance with the original principle of first-to-file rule, it was questionable whether the rights filed later, which had no basis to counter the rights filed first, should be strongly protected just because they were registered.
The subject case ruled as follows. The Trademark Act provides that where one intellectual property (hereinafter “IP”) right is in conflict with other IP right, the first-to-file right, or the earlier created right, is given priority over the other, and it is reasonable to assume that such rule invariably applies to a trademark conflict. Therefore, where a trademark owner filed an application for registration of a trademark similar or identical to a prior applied and registered trademark before the filing date of the said trademark owner’s application for trademark registration (hereinafter “subsequent registered trademark”) and used the subsequent registered trademark, without authorization of the owner of a prior trademark, on goods similar or identical to designated goods of the prior registered mark, an exclusive right to the use of the subsequent registered trademark is no longer exercisable, and an infringement on the prior registered mark is established without regard to whether a trial ruling that invalidates registration of the subsequent trademark has become final and conclusive or not. In addition, it was revealed that the above legal principle is likewise applicable to cases concerning patent rights, utility model rights, and design rights.
The legal principle of the subject case, which does not use the defense of abuse of rights and allows a simple judgment on whether infringement is established according to the principle of prior application, is also of great significance in that it is logically consistent and clear and brings legal stability.
