이 논문은 국제법상 강행규범과 시제법(時際法)의 관계를 다루었고, 이를 강제징용·위안부 사안에 적용하였다.
강행규범은 1969년 조약법에 관한 비엔나협약에서 국제사회에서는 공식적으로 최초로 채택된 이래 지금까지 발전을 해 왔다. 강행규범이 무엇인가에 관하여 몇몇 이론들이 존재하나, 현 주류적 입장은 강행규범을 국제사회의 근본가치인 국제공서(國際公序)를 보호하기 위한 국제법상 최상위규범으로 설명한다. 즉, 국제사회의 존재를 전제로 국제사회를 지탱하기 위한 최소한의 국제법 규범을 강행규범으로 정의하고 있다. 그 대표적 예로는 노예 금지, 제노사이드 금지, 인도에 반하는 죄 금지 등이 있다.
한편 시제법은 법 불소급(不遡及)과 사실상 동일한 개념으로서, 그 핵심은 ‘법적 사실은 그 사실이 발생한 때에 존재하는 법에 의하여야 한다.’는 것이다.
위와 같은 개념을 갖는 강행규범과 시제법은, 어떤 사실이 예를 들어 제노사이드 금지와 같은 강행규범의 요건을 충족할 경우, 그 사실이 발생할 당시에는 제노사이드 금지 규범이 존재하지 않았더라도 제노사이드 금지 규범 위반으로 취급할 수 있는가의 논점을 발생시킨다.
이 글은 위와 같은 논점에 대한 해답을 강행규범의 근본성을 포함한 강행규범의 특성 자체에서 찾으려 시도하였다. 그리고 그러한 과정을 통해 강제징용·위안부 문제를 강행규범의 시각에서 접근하는 것이 시제법의 관점에서도 문제가 없음을 밝혔다. 나아가 논리의 연장선에서 최근 문제 되고 있는 강제징용 피해자들 회복청구권의 소멸시효 완성 여부에 관해서도 강행규범 법리를 바탕으로 한 나름의 시각을 제시하였다.This thesis deals with Jus Cogens based on the mainstream approach. It also looks into the relationship between the norm and “intertemporal law”, whose meaning basically indicates that all legal facts must be viewed from the law at the time they occur.
The concept of Jus Cogens was officially accepted for the first time in the international community at the Vienna Convention on the Law of Treaties (VCLT, 1969) and has been continuously evolving since then. Although there are varying opinions regarding its definition, Jus Cogens generally refers to the norm that legally protects the international public order.
It is now predominantly known that Jus Cogens is a special customary international law, whose universality, normative hierarchy, and non-derogability are accepted and recognized by the international community as a whole. Its contents include the prohibition against serious violations of international human rights and humanitarian law, such as the prohibition of slavery, genocide, crimes against humanity, etc.
With regard to the relationship between Jus Cogens and intertemporal law, it is safe to say that intertemporal law theory cannot be maintained when Jus Cogens breach is involved. In other words, any legal facts which satisfy the components of one Jus Cogens must be considered as the breach of that Jus cogens even though it does not exist at the time of the legal facts.
The conclusion as above could be applied to forced labor and comfort women issues. The damages of victims emanate from the actions of Japanese government or companies at the colonial period. Those actions satisfy components of the two Jus Cogens norms - prohibition of slavery, prohibition of crimes against humanity, because the both victims suffered extremely hard labors at the situation where there was no freedom to decide their conditions based on their wills and those labors were under widespread and systematic control of Japan.
Thus, assuming that two Jus Cogens norms do not exist at the time, the two norms still can be applied to the issues. Put in another way, the intertemporal law theory cannot be applied to the forced labor and comfort women cases due to the retroactive effect of two Jus Cogens norms.
