부부관계에 있는 일방이 타인과 부정행위를 한 경우 그로 인하여 이혼에 이르지 아니하는 경우는 물론이고, 이혼에 이르게 되는 경우라고 하더라도 부정행위에 따른 위자료의 산정이 가장 큰 법률상 문제가 되는 경우가 많다. 특히 헌법재판소의 위헌결정에 따라 부정행위에 따른 위자료의 청구가 부정행위에 대한 유일한 법률적 제재수단이 됨에 따라 그와 같은 위자료의 청구가 증가하고 있는바, 본고에서는 그에 따른 위자료의 산정에서 실무상 문제 되는 몇 가지 사항에 대한 고찰을 시도하였다.
먼저, 간통죄 폐지 전후의 부정행위에 따른 위자료 산정에 대한 통계의 분석 결과 일반적인 통념과는 달리 위자료의 액수에 큰 변동이 없거나, 오히려 감소하는 경향이 나타났고, 위자료 산정의 기준 역시 추상적으로만 제시되고 있음이 확인되었는바, 이는 다른 불법행위에 대한 위자료의 액수가 점차 현실화되고 있고, 그 산정 기준 역시 구체화되고 있는 것과 비교하여 볼 때 적절하지 아니하다고 볼 수 있다.
다음으로 부정행위의 당사자, 즉 배우자와 상간자 사이의 차등적 위자료 산정의 경향에 대하여 분석하였다. 부정행위의 당사자들의 관계는 공동불법행위자임에도 실무상 위자료가 달리 산정되는 경향이 뚜렷하게 나타났는바, 최근의 대법원판결 및 학설로서 제기되고 있는 공동불법행위책임의 개별화 시도에 비추어 부정행위에 따른 위자료에 대해서도 위와 같은 경향이 타당하다고 볼 수도 있다. 그러나 그와 같은 경우에도 공동불법행위자 사이의 구상권의 행사가능성을 배우자와 상간자 사이의 위자료의 차등적 산정의 근거로 삼는 것은 적절하지 아니하다고 할 것이다.
마지막으로 배우자가 수인의 상간자와 부정행위를 한 경우 상간자들 사이의 손해배상책임 사이의 관계에 관하여 실무는 상간자들의 손해배상책임은 모두 개별적인 불법행위책임으로 파악하는 것이 일반적이나, 이와 같은 경우에는 이혼이라는 결과의 초래 및 부정행위의 시간적 중복 여부에 따라 공동불법행위책임을 부담한다고 보는 것이 타당하다고 생각된다.
If one of the couple in a marital relationship commits adultery, regardless of whether it leads to divorce or not, the calculation of alimony often becomes the biggest legal problem. In particular, since the Constitutional Court of the Republic of Korea ruled criminal punishment of adultery unconstitutional, claims for alimony on the basis of adultery became the only legal sanction against adultery. In this context, this paper attempted to consider some practical problems in calculating alimony.
First, the statistical analysis of the calculation of alimony resulting from adultery before and after the abolition of the criminalization of adultery confirmed that the amount of alimony did not change significantly, but rather decreased, and that the criteria for calculating alimony were presented in abstract terms.
Second, the tendency of calculating the amount of alimony differently for the parties to adultery, i.e., the claimant’s spouse and his or her partner, was examined. While the parties involved in extramarital affairs are joint tortfeasors, the calculation of the amount of alimony demonstrates a clear tendency of differential treatment of the two. Such discriminatory calculation could be justified in light of the recent Supreme Court rulings and the attempts to individualize joint tort liability. However, even in such case, it is not appropriate to cite the possibility of exercising the right of reimbursement between joint tortfeasors as the grounds for differential calculation of alimony between the spouse and his or her partner.
Finally, when a spouse commits adultery with many partners, it is common in practice to identify responsibilities for damages among the partners as an individual tort liability, but in this case, it is reasonable to consider that the spouse and the partners assume joint tort liabilities depending on their contribution to divorce and whether the extramarital encounters overlapped in time.
