대법원 2022. 11. 24. 자 2020스616 전원합의체 결정은 대법원 2011. 9. 2. 자 2009스117 전원합의체 결정에서 성전환자의 성별정정 허가의 독자적 소극 요건으로 정한 성전환자가 ‘미성년 자녀를 두고 있는 경우’와 ‘혼인 중에 있는 경우’ 중 전자의 경우에 성전환자의 성별정정이 가능하다고 함으로써 앞선 전원합의체 결정을 변경하였다.
대법원은 그동안 성전환자 성별정정에 관한 3차례의 결정을 통하여 성의 결정 기준, 성전환자의 전환된 성을 법적으로 승인(평가)받기 위한 기준, 성별정정 허가의 독자적 소극 요건 등에 관하여 변화하여 왔다. 이와 관련하여 세 번째 결정인 대법원 2022. 11. 24. 자 2020스616 전원합의체 결정은 성전환자에게 미성년 자녀가 있는 경우가 두 번째 전원합의체 결정에서 판시한 ‘신분관계의 중대한 변경을 초래하거나 사회에 부정적 영향을 주는 경우’에 해당한다고 보기 어렵고, 미성년 자녀의 복리에 반한다고 보기 어렵다고 판시함으로써 ‘미성년 자녀가 있는 경우’ 신분관계의 중대한 변경 등에 관한 판단을 달리하였다. 성전환자의 성별정정에 관한 세 차례에 걸친 대법원 전원합의체 결정의 흐름에 비추어 보면, ‘사회통념’이 ‘사회규범’으로, ‘사회규범’이 성전환자의 성별정정할 권리를 제한하는 기능에서 ‘성전환자의 성별정정 권리의 실현이라는 목적을 이루기 위하여 마땅히 따르고 지켜야 할 가치 판단 기준’으로 그 의미가 적용·발전하여 왔음을 확인할 수 있다.
한편 대법원은 앞선 두 차례의 전원합의체 결정에서는 전환된 성으로 법적 승인을 받기 위한 적극적 요소 중 신체외관과 관련하여 성전환수술이 당연히 요구된다는 취지로 판시하였으나, 대법원 2022. 11. 24. 자 2020스616 전원합의체 결정에서는 성전환자가 전환된 성에 부합하는 외부 성기를 갖추었는지는 성전환자의 전환된 성의 외관을 평가하는 여러 요소 중 하나로만 파악하였는데, 그 의미를 짚어 보았다.
또한, 대법원 2022. 11. 24. 자 2020스616 전원합의체 결정은 성전환자가 미성년 자녀가 있는 경우를 성별정정 허가의 독자적 소극 요건으로 삼아서는 아니 된다고 판시하였다. 이 쟁점에 관하여 의견을 달리하는 견해의 논거를 소개하고 이에 대한 반박을 통해 위 전원합의체 결정의 의의가 무엇인지 검토하였다. 그러나 대법원 2022. 11. 24. 자 2020스616 전원합의체 결정은 성전환자가 혼인 중에 있는 경우 성별정정이 가능한지에 관하여는 판단하지 아니하였다. 따라서 대법원 2011. 9. 2. 자 2009스117 전원합의체 결정 중 성전환자가 혼인 중에 있는 경우를 성별정정 허가의 독자적 소극 요건으로 삼은 부분은 아직도 유효하다. 이에 대하여 견해 대립을 상정하고 그 논거들을 살핀 후, 우리의 가족제도와 헌법 제10조, 제11조, 제36조 제1항, 제37조 제1항 및 비례원칙 등에 비추어 성전환자가 혼인 중인 경우 이를 성별정정 허가의 독자적 소극 요건으로 보아 무조건 불허가하는 것에 대하여 비판적으로 검토하였다.
이와 같은 쟁점들을 검토함으로써 앞으로 성별정정 허가 요건을 어떤 관점에서 접근해야 하는지에 관하여 모색하고자 하였다.Supreme Court en banc Order 2020Seu616 dated November 24, 2022 overruled the previous Supreme Court en banc Order by ruling that of the two conditions of the absolute disapproval requirements for permission of gender rectification for transsexuals determined by Supreme Court en banc Order 2009Seu117 dated September 2, 2011, which are “the case of having a minor child” and “the case of being married,” gender rectification should be allowed merely in the former case.
Through three orders on gender rectification for transsexuals, the Supreme Court has shown changes in rulings on gender determination standards, standards for legally approving and evaluating gender transitions of transsexuals, and the absolute disapproval requirements for permission of gender rectification. In this regard, Supreme Court en banc Order 2020Seu616 dated November 24, 2022, which is the third Supreme Court en banc order among them, rendered a different judgment regarding the significant change in the status relationship in relation to the case of “having a minor child” by ruling that it is hard to view that permitting the revision of gender for a transsexual who has a minor child corresponds to “the case of causing a significant change in social status or negatively affecting society” determined by the second Supreme Court en banc order or is contrary to the welfare of the minor child. In light of these changes of the Supreme Court en banc orders on gender rectification for transsexuals, comparing the concept of “social common notion” with the “social norms,” we can check that the meaning of “social norms” has been applied and developed from the function of restricting the rights to gender rectification of transsexuals to the “value judgment standard that must be followed and observed in order to achieve the purpose of realizing the right of transsexuals.”
Meanwhile, the previous two Supreme Court en banc orders ruled to the effect that gender reassignment surgery should be naturally required in relation to the physical appearance among the positive factors to obtain legal approval as a converted sex; however, Supreme Court en banc Order 2020Seu616 dated November 24, 2022 determined that whether a transsexual has external genitalia consistent with the converted sex is only one of many factors to evaluate a transsexual’s physical appearance, and this paper reviewed the meaning of the determination.
Supreme Court en banc Order 2020Seu616 dated November 24, 2022 ruled that the case of a transsexual having a minor child should not be considered as an absolute disapproval requirement for permission of gender rectification. This paper tried to examine the significance of the above Supreme Court en banc order by introducing the arguments of differing views on these issues and refuting them. However, Supreme Court en banc Order 2020Seu616 dated November 24, 2022 did not determine whether gender rectification may be permitted in the case of a transsexual being married. Therefore, of the judgement rendered by the Supreme Court through Supreme Court en banc Order 2009Seu117 dated September 2, 2011, the part in which the case of a transsexual being married should be regarded as an absolute disapproval requirement for gender rectification is still valid. On this issue, after assuming conflicting views and examining the arguments, in the light of our family system, Articles 10, 11, 36(1), and 37(1) of the Constitution, and the principle of proportionality, this paper critically reviewed the unconditional disapproval of gender rectification of a transsexual who is married by viewing the case as an absolute disapproval condition for gender rectification.
Through this review, this paper tried to find out from what point of view we should approach the permission requirements of gender rectification of transsexuals in the future.
