법률의 명확성은 국가의 법질서가 안정적으로 운영되기 위한 필수조건이다. 명확성원칙이 요구하는 법률은 인간의 규범이고 실정성과 일반성을 형식적 요소로 하며 구체적 사안에 적용되는 것이기에 법률해석이 필요하다. 명확성원칙이 요구하는 법률의 명확성은 법률해석에 있어 합리적이고 객관적인 기준을 해당 법률로부터 도출할 수 있는지 여부로 판단된다. 법률을 형성·집행·통제하는 과정에서 국회·정부·법원은 각자 법률을 해석하는 주체이다. 국가기관의 자의적인 법률해석을 막기 위해서는 어느 한 기관이 법률을 독점적으로 해석하여서는 안 된다. 법률의 명확성은 이러한 법률해석을 통해 보편적 결론에 이를 수 있을 때 인정된다. 국가권력의 자의적인 법률해석을 막기 위해서는 국가의 통일적 의사형성을 목적으로 하는 기능적 측면에서 권력분립원칙을 파악해야 한다. 입법, 행정, 사법으로 구성된 법체계가 하나의 통일된 규범체계가 되기 위해서는 동적 규범체계와 정적 규범체계가 결합된 상태여야 한다. 다만 수권규범들이 연결고리로 작용할 때라야 독립된 법체계가 구축될 수 있는 점에서 동적 규범체계가 중심이어야 한다. 법체계는 위로부터 헌법, 입법, 행정, 사법 순의 단계구조를 통해 법질서를 형성하고 규율한다. 이 중 행정단계에서는 행정기관이 국민에 대해 법률을 일방적으로 적용하는 관계에 있으므로 수동적인 국민이 전제가 된다. 또한 행정기관은 국회의 통제로부터 자신의 권한을 독자적으로 확보하는 차원에서 법률을 해석한다. 행정단계에서는 이러한 행정기관의 법률해석을 전제로 해당법률로부터 해석의 객관적 기준을 도출할 수 있는지 여부로 법률의 명확성 여부를 판단한다. 반면, 사법단계는 행정기관이 법률을 적용한 것에 대하여 그 상대방인 개인이 소송을 제기함으로써 재판이 개시된다. 따라서 사법단계에서는 개인의 권리보장, 특히 헌법상 기본권 보장을 중심으로 법률해석이 이루어진다. 이에 따라 법률의 명확성도 기본권 중심의 법률해석을 전제로 하여 해당 법률로부터 해석의 객관적 기준을 도출할 수 있는지 여부로 판단한다. 그 결과 사법단계의 명확성원칙에 관한 고유한 심사기준은 다음과 같다. 첫째, 국회와 정부의 관계에 한정된 형식적 법치주의는 기본권 중심의 헌법과 관계를 맺어 실질적 법치주의로 확장한다. 둘째, 법률과 행정행위에 의해 제한되는 기본권의 종류에 따라 요구되는 법률의 명확성 정도가 달라진다. 셋째, 법률이 명확하게 규정되었다함은 법률에 의한 공정한 고지를 의미한다. 법률이 명확할 때 이를 신뢰하는 수범자와 집행하는 행정기관에게 동일한 규제내용을 제공할 수 있기 때문이다. 이를 토대로 공직선거법 제250조 제1항의 허위사실공표죄를 보면, 동 조문에서 ‘행위’로 확보되는 법률의 명확성 정도는 ‘학력’, ‘재산’ 등 다른 경우에 비해 현저히 낮고, 그렇게 차별할 만한 합리적 이유도 없으므로 법률에 의한 공정한 고지라는 측면에서 명확성원칙을 위반한다.The clarity of law is essential to maintain the legal order of the state stably, We need to interpret the law because it is a human norm which is specifically invoked and takes the form of positivity and generality. The clarity of the law is judged by whether we can derive the reasonable and objective standard of a law interpretation from the laws. The national assembly, the government and the courts are the the subjects to interpret the laws in the course of the formation, the enforcement of law and the legal control. No power should interpret the law exclusively. In addition, the clarity of the law is recognized when it reaches a universal conclusion through interpretation. Preventing that a power interprets the law arbitrarily, we should understand the separation of the powers functionally to reach a universal conclusion. A static system of norms should be combined with a dynamic system of norms for a legal system consisting of legislation, administration, and justice exists as a unified normative system. We need to focus on a dynamic system of norms besause authorized norms act as a link and establish an independent legal system. A legal system creats and regulates legal order through the hierarchy of legislative, administrative, and judicial order as a phase structure. It is based on a passive people to whom the agencies apply the law unilaterally at the administrative phase. Furthermore, the administrative agency interprets the law to secure its own authority from the control of the national assembly. At this phase, the clarity of the law is judged whether we can derive the objective standard for interpretation from the law on the premise of the administrative agency's legal interpretation, On the other hand, a trial begins at the judicial phase when an individual files a lawsuit against the administrative agency's enforcement of the law. A legal interpretation places emphasis on the guarantee of individual rights, especially fundamental right at this phase. The clarity of the law is judged whether we can the objective standard for interpretation from the laws on the premise of a fundamental rights-oriented interpretation, In consequence, the attribute standards at the judicial phase are as follows. First, formal rule of law which is limited to the relation between the national Assembly and the government extends to substantial rule of law that is related to the constitution centered on fundamental rights. Secondly, a degree of clarity of the law depends on a type of fundamental right restricted by law and administrative action. Third, the clarity of the law means that it provides the same content to the person who trusts the law and the agency which execute laws.
