수 개의 가액배상판결이 중첩되는 경우 수익자가 이중지급 위험에서 벗어나기 위한 방안으로서 청구이의의 소가 인정된다는 것은 종전부터 대법원이 확인하고 있는 법리이다. 취소채권자의 피보전채권액이 사해행위 목적물의 공동담보가액을 초과하는 경우 각각의 가액배상판결에서 인정되는 가액배상의 금액은 공동담보가액이 될 것인데, 하나의 사해행위에 대해 복수의 가액배상판결이 내려질 경우 각 판결에서 인정된 가액이 다를 가능성이 크다. 수익자가 그중에서 특정 가액배상판결에 따라 일부를 배상하였을 때 다른 가액배상판결에 대하여 청구이의의 소를 통해 집행력을 배제할 수 있는 범위가 문제 된다.
대상판결은 위 쟁점이 문제 된 사안에서 청구이의의 대상이 되는 해당 가액배상판결에서 인정된 공동담보가액이 아니라 가장 다액의 공동담보가액을 기준으로 집행력의 배제 범위를 판단해야 한다고 판시하였고, 그 근거로 ‘채권자취소권의 취지’를 제시하고 있다. 대상판결이 위와 같은 입장을 취한 것은 다액의 가액배상이 인정된 취소채권자가 수익자와의 합의하에 일부에 대한 가액배상에 나아가지 아니하는 경우 상대적 초과 부분에 대한 책임재산의 회복을 실현할 마땅한 방안이 존재하지 않고, 수 개의 가액배상판결을 받은 수익자의 입장에서도 그 책임에서 벗어날 수 있는 기준이 마련되어야 한다는 현실적인 필요성에서 기인한다.
채권자취소권의 효력과 관련하여 상대적 효력설을 취하는 통설·판례의 태도에 따르면 어느 하나의 사해행위 취소판결이 동일한 사해행위에 관한 다른 취소판결에 효력을 미친다고 보기 어려우므로, 대상판결에서 가장 다액의 공동담보가액을 인정한 가액배상판결이 해당 취소채권자뿐만 아니라 다른 채권자들에게도 영향을 미친다는 부분이 설명되기 어렵다. 한편 민법 제407조는 “사해행위의 취소와 원상회복은 모든 채권자의 이익을 위하여 효력이 있다.”라고 하여 채권자평등주의를 규정하고 있는데, 여기에 대해서 취소와 책임재산의 환원을 구분하여 책임재산의 환원이 이루어지면 다른 채권자들에게도 그 효력이 미친다고 보는 것이 위 규정과 관련하여 전반적으로 받아들여지고 있는 해석론이다. 위와 같은 해석론은 일견 상대적 효력설과 모순되는 것으로 보이는 민법 제407조를 조화롭게 해석하고자 시도한 결과이고 이는 민법 제407조의 도입연혁에 비추어 보더라도 타당하다. 다만 최근 대법원 판례의 경향에 따르면, 책임재산의 환원이 이루어지기 이전의 국면에서 민법 제407조를 근거로 사해행위취소의 효력 범위를 확대하려는 여러 시도들이 이루어지고 있음을 알 수 있다. 대상판결이 채권자취소권에 관한 상대적 효력설의 관점에서 부딪히는 난점은 민법 제407조의 적용 범위를 확대하고자 하는 위와 같은 경향을 통해 설명될 수 있을 것으로 보이기는 하다.
그러나 민법 제407조에서 취소판결의 효력이 모든 채권자에게 미친다는 의미는 소송법 내지 실체법상 어떠한 효력이 인정된다는 의미가 아니라 회복된 재산에 대한 강제집행의 단계에서 취소채권자가 아닌 다른 채권자도 참가할 수 있다는 제한적인 의미로 보고 있다. 이러한 관점에 비추어 보면 책임재산의 회복과 그에 따른 개별집행이 동시에 발생하는 가액배상판결에서는 민법 제407조가 적용될 여지는 희박하다. 특히 대상판결은 아직 책임재산의 회복이 이루어지지 않은 부분, 즉 공동담보가액 중 상대적 초과 부분에 관하여 다른 취소채권자에게 그 효력이 미친다는 관점에 서 있는바, 이는 민법 제407조의 기존 해석론에 부합하지 않는다. 결국 대상판결의 입장을 민법 제407조로 설명하는 것은 위 조항의 기존 해석론에 정면으로 배치된다.
대신 하나의 사해행위에 관하여 채권자취소소송의 중복을 허용하는 이상 각 가액배상판결에서의 공동담보가액 사이의 관계는 본질적으로 동일하거나 중첩된 불가분의 관계라고 볼 수 있으므로 이를 부진정연대채권 관계로 구성하는 것이 충분히 가능하다고 생각된다. 확정된 수 개의 가액배상판결의 관계를 부진정연대채권 관계로 보는 것은 채권자취소소송의 중첩을 허용하는 상대적 효력설의 취지에 더 부합하고 민법 제407조를 근거로 할 경우의 이론상 난점을 극복하면서도 대상판결과 동일한 결론에 이를 수 있다. 다만 이러한 이론적 구성이 수 개의 가액배상판결에 얽힌 복잡한 법률관계를 간명하게 설명할 수 있는 도구가 될지에 대해서는 향후 심층적인 연구를 필요로 한다.In cases where multiple monetary compensation judgments overlap, the Supreme Court has long upheld the principle that a claim for objection serves as a means for the beneficiary to avoid the risk of double payment. If the secured claim amount of the canceling obligee exceeds the joint collateral value of the object of the fraudulent act, then the amount of monetary compensation recognized in each judgment will be equivalent to the joint collateral value. However, when multiple monetary compensation judgments are rendered for a single fraudulent act, there is a high likelihood that the recognized value in each judgment will differ. This presents an issue with regard to the scope of which the enforcement power of a certain monetary compensation judgment can be removed, where the beneficiary has compensated for a portion of the said judgment, through a claim for objection against other monetary compensation judgment.
The subject case held that the scope of the exclusion of enforcement power should be determined based on the highest joint collateral value rather than the joint collateral value recognized in the relevant monetary compensation judgment that is subject to a claim for objection. The rationale for this decision is that if a canceling obligee who received a large amount of monetary compensation judgment does not proceed with claiming for monetary compensation for a portion by agreement with the beneficiary, there is no viable means to recover the relative excess portion of the executable property. Additionally, from the perspective of a beneficiary who has received multiple monetary compensation judgments, it is necessary to establish a standard to absolve them of his or her responsibility.
According to the attitude of the general theory and precedents that take the relative effect theory in relation to the effect of the obligee’s right of revocation, it is difficult to see that one fraudulent act revocation judgment affects another revocation judgment for the same fraudulent act. Therefore, it is difficult to explain that the monetary compensation judgment that recognizes the highest joint collateral value affects not only the canceling obligee but also other obligees. On the other hand, Article 407 of the Civil Act stipulates, “The cancellation and restoration of a fraudulent act shall be effective for the benefit of all obligees.” The view that the effect of the restoration of executable property is also applied to other obligees when the restoration of executable property is achieved, by distinguishing between cancellation and restoration of executable property, is generally accepted in relation to the above provision. This interpretation, which seems to contradict the relative effect theory at first glance, has attempted to harmoniously interpret Article 407 of the Civil Act and is valid even in light of the legislative chronology of Article 407 of the Civil Act. However, there have been several attempts to expand the scope of application of Article 407 of the Civil Act, such as Supreme Court decisions applying Article 407 of the Civil Act to the stages prior to the restoration of executable property is completed. It appears that the difficulties encountered by the subject case in question from the perspective of the relative effect theory of creditor’s cancellation rights can be explained through the tendency to expand the scope of application of Article 407 of the Civil Act.
However, the meaning that the effect of the cancellation ruling under Article 407 of the Civil Act extends to all creditors does not mean that any effect is recognized under procedural or substantive law. Rather, it indicates that creditors who are not canceling creditors may participate in the stage of compulsory execution for recovered property. From this perspective, it is unlikely that Article 407 of the Civil Act would apply to appraisal awards where the recovery of seized property and individual execution occur simultaneously. Specifically, the ruling in question takes the view that its effect extends to other canceling creditors with respect to the relatively excessive portion of joint security among unrecovered seized property. This interpretation does not conform to the existing understanding of Article 407 of the Civil Act and thus categorically contradict the conventional interpretation of the said Article.
As long as the duplication of obligee’s cancellation lawsuits for one fraudulent act is permitted, the relationship of the joint collateral values in each monetary compensation judgment can be seen as an essentially identical or overlapped indivisible relationship. As such, it is possible to construct them as quasi-joint claim relationships. Viewing the relationship of finally binding multiple monetary compensation judgments as a quasi-joint claim relationship aligns with the purpose of the relative effect theory that allows for the overlap of obligee’s cancellation lawsuits. This approach can reach the same conclusion as the subject case while overcoming difficulties when using Article 407 of the Civil Act as a basis. However, whether this theoretical construction can effectively explain complex legal relationships entangled in multiple monetary compensation judgments requires further in-depth research.
