2. 손해배상액의 산정 기준
손해배상의 범위와 관련하여 특히 육질 저하에 관한 상세한 법적 검토가 필요하다. 당사자의 주장과 법관의 적극적인 석명을 거쳐 판결문에 육질 저하에 관한 부분이 명시되어야 할 것이다. 소음·진동으로 인한 식육의 품질 저하는 농장동물사육자의 경제적 손실과 직결된다는 점에서 특히 의의가 있다. 구체적인 산정방식은 “육질등급차액 × 두당육질중량 × 두수”로 하는 것이 타당하다.
3. 과실상계
법원이 농장동물사육자의 과실을 판단할 때 소음·진동으로 인한 농장동물 피해를 방지하였는지를 고려하여야 한다. 주요 기준으로 축산법상 적정사육기준과 동물복지축산농장인증제의 사육공간기준을 활용하는 것이 타당하다. 축산법상 적정사육기준을 준수하지 않은 경우 과실비율을 10% 수준으로 설정하는 것이 바람직하다. 동물복지축산농장인증제의 사육공간기준을 미준수한 때에는 농장동물사육자의 과실을 최소 7% 인정하여야 할 것이다.This article deals with agriculture animal welfare standards from a tort law perspective. In addition, it is necessary to take into consideration the meat quality related to the plaintiff's property right.
2. Pecuniary compensation
It is appropriate to take into account the meat quality when it comes to calculating the pecuniary damage. The court should consider all circumstances concerning the meat quality even in the absence of clear evidence. The meat quality is associated with the plaintiff's economic loss. The formula can be as follows: difference according to the grades for livestock products × carcass weight × number of head.
3. Comparative negligence
It is imperative to focus on the stocking density especially because it is closely related to the injury in agricultural animals incurred by noise pollution. The victim who does not comply with the standards under the Livestock Industry Act should be able to recover the amount of damages that is reduced by 10%. If the victim is not in compliance with the standards for certification of animal welfare livestock farms, the court should find the victim at least 7% responsible for an injury.
