개인파산절차는 지급불능 상태에 빠진 채무자에 대한 파산선고, 파산채권의 조사 및 확정, 파산재단의 관리·환가절차를 거쳐 면책과 복권에 이르는 일련의 과정을 통해 채권자들에게는 평등하게 채권을 변제받을 수 있는 기회를, 채무자에게는 경제적으로 재기·갱생할 수 있는 기회를 부여하는 것을 목적으로 한다.
파산절차에서는 일반적으로 파산재단의 가치 하락을 방지하기 위한 취지에서 신속한 처리가 강조되곤 한다. 아울러 개인파산절차의 신속화에 관해서는 개인파산제도가 가지는 몇 가지 고유한 특성들, ① 개인파산절차는 법인파산절차와 달리 면책이 주된 목적인 점, ② 개인채무자는 자신 또는 가족이 신체적·정신적 건강이 좋지 않은 경우가 많아 개인파산절차가 실제로 사람을 살리는 활인절차로 기능하는 점, ③ 개인파산절차는 사건 수가 많은 대량성 때문에 절차면에서 통일적이고 일관된 업무처리시스템을 구축할 필요가 있는 점 등을 주목할 필요가 있다.
구체적인 신속화 방안으로, ① 파산선고와 관련하여, 심사절차의 간이화, 차등화, 분업화 및 상시화, 인지·송달료의 국고부담 또는 창구지도 활용, 보정명령과 예납명령의 동시/병행 송달, 직권 소송구조의 적극적 활용, 예납기간 및 보정기간 단축, 신속한 기각결정 및 재도의 고안, 파산선고 횟수 증가 등의 방안을, ② 송달과 관련하여, 마이데이터 산업 활용, 신속한 주소보정명령 및 재송달, 해외 소재 채권자에 대한 국내 송달 또는 대안적 방법 활용 등을, ③ 속행과 관련하여, 추정형보다는 속행형을 채택하되 속행 자체를 최소화하고, 합리적 기간을 정하여 속행하며, 속행기간을 단축하는 방안을, ④ 채권조사기일과 관련하여, 불필요한 채권조사기일 지정 지양, 제1회 채권자집회 및 채권조사기일 병합, 신고기간 후 채권신고에 대한 제재 강화, 조사확정재판의 신속한 처리 등을, ⑤ 환가 및 환가포기와 관련하여, 법원 매각공고 게시판의 범용성 증진, 인터넷 경매나 전문 중개업자 의뢰 등 다양한 방법을 통한 임의환가 활성화, 합리적인 환가포기 기준 마련 등을, ⑥ 면책과 관련하여, 의견청취기일의 생략(무심사 면책제도, 취약채무자 신속면책제도, 서면에 의한 의견청취절차 활용) 또는 합리적 운영, 면책불허가사유의 엄격한 해석 및 재량면책의 적극적 활용 등을 생각해볼 수 있다.
마지막으로 개인파산절차의 신속화를 위하여 강조되어야 할 부분은 어느 국면에서나 ‘적극적인 사건관리자(active case manager)’로서의 법원 및 파산관재인의 역할이 무엇보다 중요하다는 것이다.The individual bankruptcy proceeding aims to provide creditors with an opportunity to obtain performance on obligations and debtors with an opportunity for financial rehabilitation through a series of process encompassing declaration of bankruptcy on debtors in insolvency, investigation and confirmation on bankruptcy claims, management and conversion of bankruptcy estate, and a discharge and reinstatement.
In general bankruptcy proceedings, it is common to emphasize prompt treatment to prevent depreciation in value of the bankruptcy estate. It is likewise in the case for individual bankruptcy proceedings, but the following unique characteristics are particularly taken into account: ① The main purpose of the individual bankruptcy proceeding is a discharge, unlike the corporate bankruptcy proceeding; ② for personal debtors who mostly involve physical or mental illness of themselves or family members, the individual bankruptcy proceeding functions as a life-saving/emergency procedure; and ③ the lump sum nature of the individual bankruptcy proceeding requires the establishment of a unified and consistent service system.
The following proposals are presented as specific plans for the implementation of prompt individual bankruptcy proceedings: ① the ways to expedite bankruptcy declarations include the simplification, differentiation, and division of the examination procedures so that each step of the procedure can be handled on a regular basis; charging the national treasury with stamp duties and service fees; providing instructions at the window; combined and concurrent service of compensation and prepayment orders; active utilization of ex officio litigation aids; reduction of the prepayment/compensation period; issuance of prompt decision of rejection and the court’s review of its own judgment that was subject to an appeal; and increasing the number of declarations of bankruptcy; ② the ways to expedite service include the utilization of MyData industry; prompt issuance of address correction orders and notification; provision of domestic service or alternative methods for creditors living abroad; ③ with regard to continuation of proceedings, it must be noted that while continuation is preferred than presumption, it is best to minimize the recourse to continuation, practice it within a reasonably designated period, and shorten the period; ④ regarding the deadline of inspection of claims, the following measures are recommended, including the bankruptcy court’s avoidance of unnecessary designation of the inspection period of claims; consolidation of the first creditor assembly and inspection date of claims; stricter regulation on the reporting of claims after the lapse of the designated period for reporting; and prompt processing of final judgment on the investigation; ⑤ regarding conversion and waiver of conversion into cash, the following measures are recommended, including promotion of the widespread use of the court’s public noticeboard; facilitation of various optional conversion methods such as internet auction or professional agency; and establishment of reasonable standards for conversion waiver; and ⑥ regarding a discharge, the following measures are recommended, including omission of the period of hearing of opinion (a discharge without examination, a prompt discharge of vulnerable debtors or its reasonable operation, the use of the hearing of opinion in a written form); strict interpretation of the grounds for not granting a discharge; and active utilization of a discretionary discharge.
Finally, for prompt implementation of individual bankruptcy proceedings, the role of courts and trustees in bankruptcy as the “active case manager” must be emphasized across all steps taken.
