가상자산거래소인 미국의 FTX 도산 사태, 일본의 마운트곡스 파산 사건 등을 계기로 가상자산거래소 운영자의 도산절차에 대한 논의가 진행되고 있다. 대상 사건은 우리나라 법원에 최초로 제기된 가상자산사업자 파산사건으로 이 논문에서는 그 실무 내용에 대하여 살펴본다.
가상자산거래소는 이용자들에게 가상자산과 금전의 보관, 가상자산의 매매·교환에 대한 중개서비스 등을 제공하는 플랫폼이다. 위 거래소를 운영하는 자가 파산에 이르게 될 경우 가상자산이 물권의 객체가 되는지, 거래소 내 가상자산의 처분권이 거래소 운영자와 이용자 중 누구에게 귀속되는지, 나아가 이용자들이 파산채권자인지, 환취권자인지 문제 되는데, 이를 어떻게 보느냐에 따라 파산절차의 내용이 매우 달라질 수 있다.
따라서 이러한 논의를 중심으로 하여 파산의 신청, 파산선고, 채권의 신고 및 조사, 환가와 배당 방법에 대하여 살펴보고 그 개선점을 제시해 보기로 한다.Bankruptcies of virtual asset exchanges like the U.S. platform FTX and Mt. This paper aims to examine practical considerations involved in the first virtual asset exchange operator bankruptcy filed at a Korean court.
A virtual asset exchange is an intermediary platform for storage of virtual assets and funds, as well as trading and exchange of virtual assets. In the event that the operator of a virtual asset exchange goes bankrupt, several questions may arise, such as whether virtual assets become the object of a real right, whether the right to dispose of virtual assets held inside the exchange belongs to the operator or users, and whether users are the creditors or repossession right holders. The answers to these questions would have significant implications for the contents of the bankruptcy proceedings, as different views can lead to vastly different outcomes.
Therefore, this paper focuses on these discussions and examines various aspects of the bankruptcy process, including the application for bankruptcy, declaration of bankruptcy, declaration and investigation of claims, and methods of liquidation and distribution. Furthermore, the paper suggests potential improvements to the current procedures, taking into account the unique nature of virtual assets and challenges they pose to the traditional bankruptcy frameworks.
