형사사건에서 허용되는 영상재판의 범위를 확대하는 형사소송법이 2021. 11. 18. 시행된 때부터 약 2년이 넘는 시간이 흘렀고, 그 기간 동안 영상재판의 실시 건수가 비약적으로 증가하였다. 이 글은 구속 이유 고지, 공판준비기일, 증인·감정인신문에 영상재판이 허용되면서 피고인의 반대신문권과 관련하여 발생할 수 있는 문제를 살펴보고, 형사사건에서 영상재판의 허용범위를 확대할 필요가 있는지 여부 및 그 범위를 검토한 것이다.
형사사건에서 영상재판이 실시되면서 발생할 수 있는 중요한 문제로 피고인의 반대신문권 제한을 들 수 있다. 공개된 법정이 아닌 곳에서 증인·감정인이 증언을 하는 경우 제3자가 증언에 개입하거나 그 장소의 특수성 등으로 인해 증언의 독립성, 신빙성이 감소할 수 있다. 또한, 영상, 음향의 상태, 그 전달 등 기술적 문제로 인해 사실상 피고인의 반대신문권이 제한될 수도 있다. 영상재판으로 인한 피고인의 반대신문권 제한이 침해에 이르지 않기 위한 요건을 국내외 규정 및 판례를 통해 검토하고자 한다.
나아가, 형사 영상재판은 재판의 효율성 및 피해자·증인 보호를 통한 재판의 공정성을 촉진하고, 피고인의 신속한 재판을 받을 권리를 향상시킬 수 있으며, 향후 실시될 형사 전자소송과도 긴밀히 연계되어 그 허용범위를 확대할 필요가 있다. 형사 영상재판의 허용범위를 확대한다면, 미국, 독일 등의 사례를 참고하여 구속 전 피의자심문, 구속적부심사, 보석을 위한 심문기일에 영상재판 도입이 가능할 것이다. 또한, 심문기일 지정이 법관의 재량으로 되어 있는 각종 형사신청사건에 영상재판이 실시되면 피고인의 사법접근권도 향상될 것이다. 또한, 피고인의 불출석 재판이 허용되는 경미사건에서도 영상재판이 실시된다면, 공판절차의 효율성 및 피고인의 방어권 보장에 기여할 것으로 기대된다.
마지막으로, 형사사건에서 영상재판 실시와 관련된 쟁점과 그 허용범위를 정하는 문제는 공정한 재판을 보장하기 위하여 재판을 둘러싼 법률전문가뿐만 아니라 피고인의 관점에서도 검토되어야 함을 강조한다.The Criminal Procedure Act, which expands the scope of video trials allowed in criminal cases, took effect on November 18, 2021, and about two years or so has passed, and the number of video trials has increased dramatically during that period. This thesis examines the issues that have occurred or may arise as video trials are permitted for notification of reasons for arrest, trial preparation date, and witness/expert interrogation and examines whether or not to expand the permissible scope of video trials in criminal cases and its scope.
One of the problems that may arise when video trials are conducted in criminal cases is whether the defendant's right to cross-examination is violated. If a witness or expert witness testifies in a place other than an open court, the independence and credibility of the testimony may be reduced due to a third party intervening in the testimony or the peculiarity of the place. In addition, the right to cross-examination may be limited due to difficulties in technical aspects such as video and sound conditions and delivery. In order to prevent the limitation of the defendant’s right to cross-examination due to the video trial to be infringed, the requirements should be reviewed based on domestic and foreign regulations and precedents.
Furthermore, criminal video trials not only promote fairness of trial through trial efficiency and protection of victims, witnesses but improve the defendant’s right to a speedy trial, and is closely linked to criminal electronic litigation to be conducted in the future. By referring to the cases of the United States and Germany, video trials can be introduced to interrogation of suspects before arrest, review of suitability for detention, and interrogation for bail. In addition, if video trials are conducted in various criminal cases where the designation of an interrogation date is at the discretion of the judge, the defendant’s right to access to justice will be enhanced. In addition, if a video trial is conducted even in a minor case where the defendant’s absentee trial is permitted, it is expected to contribute to the efficiency of the trial process and the guarantee of the defendant’s right to defense.
Lastly, the issues related to the conduct of video trials in criminal cases and their permissible scope must be reviewed from the viewpoint of the accused as well as legal experts surrounding the trial to ensure a fair trial.
