최근의 범죄는 최신 정보통신기술을 접목하고, 점조직을 활용하는 등 지능화·조직화가 촉진되고 있다. ‘N번방 사건’과 같은 디지털 성범죄, 보이스피싱과 같은 신종금융사기, 마약거래 등 여러 범죄에 디지털 기술과 점조직이 활용됨에 따라 수사기관이 범죄에 접근하는 것 자체가 제한되고, 주범을 검거하기 어려운 상황이 초래되고 있다. 이에 대응하기 위하여 새로운 수사방법을 도입할 필요성이 높아졌는데, 「아동·청소년의 성보호에 관한 법률」의 개정으로 ‘신분비공개수사와 신분위장수사’(이하 ‘위장수사’라고 한다)가 도입되었고, 최근 발의된 「사기방지 기본법안」에서 일부 사기범죄에 대하여 위장수사를 할 수 있도록 규정을 두는 등 새로운 수사방법으로서 위장수사가 주목받고 있다.
그런데 입법적 해결 이전에 위장수사의 본질과 요건에 대한 충분한 검토가 이루어질 필요가 있다. 위장수사로 인하여 수사 대상자의 기본권이 제한되는지, 그 제한이 정당화될 수 있는지, 위장수사는 강제수사에 해당하는지, 강제수사에 해당한다면 영장주의가 적용되는지, 필요한 절차적 통제는 무엇인지 등에 따라 위장수사의 요건이 달라지므로, 이에 관한 상세한 검토가 필요하다. 이를 통해 위장수사에 대한 해석론을 보다 정교하게 하고, 향후 위 「사기방지 기본법안」을 포함하여 개별 범죄에 대한 위장수사 규정을 신설하는 입법에 이를 고려할 수 있다고 할 것이다.
위장수사는 수사기관이 신분을 위장하고 대상자에게 접근하여 증거나 자료를 수집하는 국가의 행위이므로, 비록 고전적인 개념의 기본권 제한에는 해당하지 않더라도, 헌법상 ‘사실적 기본권 제한’에 해당하는 것이다. 이에 따라 대상자의 사생활의 비밀과 자유, 개인정보자기결정권을 제한하게 되는데, 다만 기본권 제한은 헌법 제37조 제2항에 따라 정당화될 수 있다고 할 것이다.
한편 위장수사는 기망적인 수단으로 수사 대상자의 의사에 반하여 법익을 침해하는 것이므로 강제수사에 해당한다고 보아야 한다. 다만 영장주의의 본질에 비추어 모든 강제수사의 영역에 영장주의가 적용되는 것은 아니므로, 위장수사에 영장주의는 적용되지 않는다고 볼 수 있으나, 위장수사는 국가가 기망적 수단으로 개인의 법익을 침해하는 것이라는 점에서 법원의 허가라는 사법적 통제는 필요하다고 봄이 타당하다.
위와 같은 위장수사에 관한 일반론 검토를 토대로, 위 두 법률(안)의 위장수사 규정을 검토하였다. 요약하자면, 법원의 허가를 요건으로 하지 않는 신분비공개수사에 대한 통제절차 보완 필요성, 인권보장의 관점에서 허가 청구에 검사를 경유할 필요성, 위장수사 사실의 통지의무 규정의 필요성이 있다는 것이다.In recent years, crimes have evolved into more intelligent and organized ones, such as by applying the latest information and communication technology and mobilizing point organizations. As digital technology and point organizations are used in various crimes, such as digital sex crimes, new types of financial fraud such as voice phishing, and drug dealing, it is difficult for investigative agencies to even have access to crimes and arrest the main culprit. Accordingly, the need to introduce a new investigative method to address this difficulty has increased. Recently, upon the amendment of the Act on the Protection of Children and Juveniles against Sexual Offense, the provisions on the “identity-concealed investigation and undercover investigation” (hereinafter referred to as “undercover investigation”) were introduced, and the Basic Act on Fraud Prevention, which includes the provisions on undercover investigations, was also introduced. Along with the introduction of these proposals, undercover investigations are garnering attention.
However, it seems that a sufficient review of the substance and permissible conditions of undercover investigations has not been carried out yet. The requirements for the permissibility of undercover investigations may vary depending on whether fundamental rights are restricted by undercover investigations, whether the restriction can be justified, whether undercover investigations fall under compulsory investigation, and if it falls under compulsory investigation, whether the warrant principle is applied. Therefore, a detailed review of this is necessary.
Since undercover investigations are an act by a state, in which an investigative agency disguises its identity and approaches a target to collect evidence or information, it falls under the constitutional limitation of fundamental rights per se. And this restricts the freedom of privacy and the right to self-determination on personal information. However, such restrictions on fundamental rights can be justified in accordance with Article 37(2) of the Constitution of the Republic of Korea.
On the other hand, undercover investigations use deceptive means to infringe on the right to legal protection of the target of investigation. Therefore, it should be regarded as compulsory investigation. However, since the warrant principle does not apply to all areas of compulsory investigation, it can be seen that the warrant principle does not apply to undercover investigations. Even so, it is reasonable to assume that the judicial control of the court’s permission is required in that the state infringes on an individual’s interest by deceptive means when conducting undercover investigations.
In this paper, the provisions on undercover investigations of the two legislative bills were reviewed, based on the general review of undercover investigations above. In summary, there is a need to supplement the procedural control for identity-concealed investigations, the need to go through the prosecutor when requesting permission, and the need for a regulation that imposes an obligation on the investigative agency to notify the fact of undercover investigations.
