본 연구는 국내 경쟁정책 중 부당한 공동행위 금지규정에 대한 집행 과정에서 지속가능성을 고려할 방안에 대해 살펴본다. 경쟁정책과 지속가능성정책은 경제학적 관점에 따르면 각각 시장실패의 원인인 불완전경쟁 및 외부효과를 교정하는 정책에 해당하기에 경제적 효율성 측면에서 조화될 수 있다. 그런데 경쟁정책과 지속가능성정책을 별도로 집행하는 경우 한 정책이 다른 정책에 영향을 미쳐 각 정책이 의도하는 효과를 얻지 못하는 문제가 발생할 수 있고, 정책 집행 과정에서 당국 사이의 갈등이나 충돌을 방지하기 위해 조정이 필요할 수 있다. 이러한 점들을 고려하였을 때, 두 정책을 각각 추진하는 것보다 지속가능성을 고려한 경쟁정책이 더 우월한 사회적 편익을 달성할 가능성이 있다. 다만 국내 경쟁정책에 지속가능성을 고려하는 것은 구체적 집행수단 부족으로 인하여 쉽지 않은 상황으로 평가된다.
이미 EU에서는 경쟁정책에 지속가능성을 고려하기 위한 논의를 활발하게 진행하고 있다. EU 차원에서는 수평협력 가이드라인 개정안에 지속가능성 합의의 개념을 정의하고, 경쟁상 문제를 일으키지 않는 지속가능성 합의를 예시하며, 지속가능성 합의 평가방식을 포함하는 등 지속가능성 고려 방안을 포함하고 있다. EU 회원국인 네덜란드에서는 지속가능성 합의 가이드라인에 지속가능성 합의의 개념을 정의하고, 반경쟁적이라고 간주되지 않는 합의 및 법적 면제가 부여되는 합의 등을 예시하는 것은 물론 이를 실제 사건에 적용하고 있는 상황이다.
이를 참고하였을 때, 우리나라 경쟁정책 중 부당한 공동행위 집행 과정에 지속가능성을 고려하기 위하여, 검토대상 지속가능성 관련 공동행위를 식별하고, 경쟁제한 효과가 적은 행위를 대상으로 하는 안전지대를 설정하여 공정위원회 업무 증가 수준을 적절하게 조절하며, 지속가능성 관련 공동행위가 억제되지 않도록 지속가능성 영향(효율성 증대효과) 정량화 방법에 대한 연구와 안내를 제공하고, 일시적으로 제재 수준을 감경하는 방안 등을 생각해 볼 수 있을 것이다.
The main purpose of this paper is to examine enforcement measures to consider the sustainability in domestic cartel regulation. From the perspective of economics, competition and sustainability policies can be harmonized in terms of economic efficiency. Both policies are designed to correct market failures caused by incomplete competition and external effects, respectively. However, if competition and sustainability policies are enforced separately, they may be ineffective that one policy do not have the intended effect because one policy affects another, and policy conflict between authorities occurs in the course of policy enforcement. Considering these points, there is a possibility that competition policy considering sustainability will achieve greater social benefits than enforcing each of two policies. But there is a lack of concrete enforcement measures to consider the sustainability in current domestic competition policy.
Meanwhile, in the EU, considering sustainability in competition policy is currently under active discussion. At the EU level, the revised Horizontal Guidelines include sustainability considerations, including the definition of sustainability agreements, the example of sustainability agreements not raising competition concerns, the assessment method of sustainability agreements. In the Netherlands, a member state of the EU, Guidelines on Sustainability Agreements include the definition of sustainability agreements, the example of sustainability agreements without restrictions of competition and sustainability agreements with benefits that offset restrictions of competition etc. This guideline is being used to enforce Dutch competition policy.
Therefore, in order to consider the sustainability in domestic cartel regulation, the following points could be taken into consideration: defining the sustainability agreement; establishing the safe zone for agreements with less competitive restriction effect; providing guideline on how to quantify the sustainability effect; temporarily reducing the level of sanctions.
