대한민국 헌법은 법관의 재판 독립에 대한 규정(제103조)과 별도로 제101조 제1항을 두어 ‘법관으로 구성된 법원에 사법권이 속함’을 따로 명시하고 있다. 개별 법관의 재판 독립과 별개로 ‘기관으로서의 법원’에 속한다고 선언한 ‘사법권’에 사법행정권 또한 포함됨에도 국가재정법 제40조 제2항은, 정부가 사법부 등 독립기관의 예산요구를 임의로 심사할 수 있고 이를 감액하고자 할 경우 독립기관의 장의 의견을 청취하는 절차만 거치면 되게끔 하고 있고, 이에 따라 사법부 등 헌법상 독립기관의 예산안 또한 그 세부항목까지 정부의 감독하에 있다.
과거 정부들은, “헌법 제54조 제2항에 ‘정부는 회계연도마다 예산안을 편성하여...’라고 명기된 점을 들어, 정부의 헌법상 예산안 편성권한을 토대로 사법부 등 헌법상 독립기관의 예산 또한 심사하여 변경할 수 있는 것이고, 국가재정법 제40조 제2항은 이를 확인하는 조항으로, 이는 헌법적 결단에 기한 것이므로 헌법개정으로만 제도 변경이 가능하다.”라는 논리를 펼쳐왔다.
헌법 제101조 제1항에 법원의 권한으로 명시된 ‘사법권’을 구성하는 사법행정권 중 사법작용에 필요한 예산을 산출하는 기능(물적행정)만을 따로 떼어 이미 독립성을 인정받고 있는 인적행정과 달리 취급, 과거 정부들 논리처럼 정부의 감독하에 두기 위해서는, 헌법이 법원에 부여한 사법권 중 예산산출기능만을 따로 제한하거나 그 권한 주체를 정부로 변경하는 내용의 명시적 헌법규정의 존재가 최소한의 필요요건이라 할 것이다.
이에 첫 번째로, 기관으로서의 법원을 사법권의 주체로 명시한 헌법 제101조 제1항의 진정한 의미를 확인하기 위해 그 제도적 연원에 대한 연구를 실시하였다. 기관으로서의 법원을 사법권의 주체로 명시한 헌법은 1787. 9. 17. 제정된 미국 연방헌법으로, 2차 세계대전 패전 후 미국의 점령하에서 1946. 11. 3. 개정된 일본국헌법 및 미군정기를 거쳐 제정된 한국의 제헌헌법 또한 미국 연방헌법 제3조 제1항을 그대로 도입하였다는 역사적 사실 및 미국에서 위 헌법조항을 근거로 연방법원에 재판의 독립뿐 아니라 연방정부에 대한 관계에서 예산산출기능을 포함한 사법행정권한의 자율성이 보장되고 있음을 확인하였다.
두 번째로, 정부의 예산안 편성기능과 관련하여 영국, 프랑스, 독일, 미국, 일본 등 주요 국가들에 대한 비교법적 연구를 실시하였는바, 사법부에 초점을 두고 본 국가권력분립 체계 및 정부의 예산안 편성기능 등에 있어, 한국의 법제도와 유사점이 있고 우리 제헌헌법에 주된 영향을 미쳤을 수 있는 국가는 미국, 독일, 일본임을 확인하였고, 위 세 국가 공히 헌법상 독립기관들의 경우 헌법에 명시된 고유권한에 그 고유권한뿐 아니라 그 고유권한 행사를 위한 예산산출 등 행정권한 또한 포함되어 있다는 공통된 법인식을 공유하고 있음을 확인하였다.
이와 같은 공통된 해석하에서 ‘정부가 예산안을 작성 내지 편성한다.’는 취지의 우리와 동일한 정부기능을 의미하는 법문을 두고, 세 국가 어디에서도 위와 같은 법문이 헌법상 독립기관의 헌법상 고유권한 행사에 필요한 예산산출기능을 따로 제한하거나 그 권한 내지 감독 주체를 정부로 변경하는 내용의 규정 내지 결단이라 이해하는 국가는 없었고, 다만 독립기관들이 각 산출한 예산요구를 정부가 제출받아, 어떠한 방식으로든 그 예산요구 원안이 예산안에 포함되게끔 하여, 의회로 하여금 독립기관의 예산요구 원안을 온전히 받아 심의할 수 있게끔 하는 방식의 ‘절차’규정으로 제도운영이 이루어지고 있음을 확인하였다.
결국 우리 국가재정법 제40조 및 그 모태인 1951년 제정 구 재정법 제16조 등은, 우리 권력분립 체계와 유사성이 있고 우리와 같이 정부로 하여금 국가 예산안을 작성 내지 편성해 의회에 제출하게 하는 법제를 갖춘 위 세 국가들 중 어디에서도 찾아볼 수 없는 조항으로, 이와 같은 법률 조항들이 과연 어떠한 역사적 배경하에서 어떠한 경위로 구 재정법에 유입되게 된 것인지, 그 형성과정 및 연원에 대한 추적을 실시하였다.Article 40 of the National Finance Act states that the executive government can review and reduce the appropriation of budget proposed by other independent branchs like judiciary and legislature after hearing the opinion of the head of the branches.
Under the awareness that the above Article is contrary to the main principles of the Constitution such as separation of powers and independence of the judiciary, there had been several attempts to amend the above Article. However, every attempt ended in failure by the opposite logic of the past governments that “since Article 54(2) of the Constitution of the Republic of Korea stipulates that ‘the Government shall formulate its budget every fiscal year,’ the Government can review and reduce the appropriation of budget proposed by other independent branchs. Thus, it can be changed only by amending Article 54 of the Constitution.”
Recently, a different perspective appeared. It says that “the existing system of the Republic of Korea was first formed by Article 16 of the former National Finance Act enacted in 1951, not by Article 54 of the Constitution of the Republic of Korea. Moreover, Article 54 of the Constitution does not naturally include the authority to review and reduce the appropriation of budget proposed by other independent branchs.” Therefore, it says that “the existing system can be changed by amending just Article 40 of the National Finance Act (which is the same as Article 16 of the former National Finance Act).”
For my study, I conducted a research on the systems of major countries such as England, France, Germany, Japan, and the US that may have influenced the first Constitution of the Republic of Korea and confirmed that Germany, Japan, and the US have similarities with the Korean system and all three countries understand that the inherent power of each independent branch of government under the Constitution includes the function of calculating its budget. Furthermore, the executive government respects such function.
In Germany, Japan, and the US, only the legislature can review and change the appropriation of budget proposed by other independent branchs.
In addition, I found out that Article 40 of the National Finance Act (Article 16 of the former National Finance Act enacted in 1951) was made by the misperception of the first legislators just after Korea’s liberation from Japan, and such legislators had no sufficient opportunities to gain instruction on modern constitutional theories such as the real meaning of separation of powers as such theories did not exist in Japan before 1945.
Therefore, Article 40 of the National Finance Act should be amended so that the appropriation of budget proposed by independent branches shall be included in the budget by the executive government without any change, just like Japan, Germany, and the US.
