본 연구의 목적은 인천광역시 지하도상가 관리 운영 조례의 입법과정에 대한 사례분석을 통해 자치입법권의 한계와 제약요인을 살펴보고 자치입법권을 실질적으로 강화하고 확대할 수 있는 방안을 제시하는데 있다. 자치입법권은 지방자치단체의 존립목적을 실현하는 가장 본질적이고 핵심적인 자치권이다. 그동안 지방행정을 둘러싼 환경변화와 법령의 개정이 꾸준히 이루어지면서 법 제도적 측면에서 자치분권의 확대와 진전이 있었다. 그럼에도 불구하고 「헌법」과 「지방자치법」을 비롯한 개별 법령에서는 소관사무의 원칙, 법령우위의 원칙, 법률 유보의 원칙, 집행기관과 의결기관 간의 견제와 균형의 원리 등을 요청하고 있어 자치법규로서 자치행정의 입법적 근거를 마련하기에는 많은 어려움에 노정되어 있다.
인천광역시 지하도상가 관리 운영 조례에 대한 사례연구에서 법령우위의 원칙에서만 조례 제정이 가능하다는 자치입법의 한계가 명확히 드러났다. 따라서 자치입법권의 확대를 위해서는 조례제정권의 보장과 강화, 조례 대상사무와 위임내용 확대, 국가와 지방자치단체 간의 입법 분담, 의회와 집행기관 간의 상호 견제와 보완 기능의 균형 강화 등의 다양한 방안을 고려해야 한다.
The purpose of this study is to examine the limitations and constraints of local autonomous legislation power through case analysis on the legislative process of the Incheon Metropolitan City Underpass Shopping Mall Management and Operation Ordinance, and to present solutions to substantially strengthen and expand local autonomous legislation power. Autonomous legislation power is the most essential and core autonomy that realizes the purpose of the existence of local governments. With changes surrounding local administration environment, revisions of laws and regulations have been steadily made, which contributed to the progress of self-government and decentralization. Yet, there are still many difficulties in forming the legislative basis for self-government through current self-government laws, because the nation’s Constitution and individual statutes related to local autonomy require the principle of affairs under one’s jurisdiction, the principle of primacy of the statutes, the principle of reservation of the laws, and the principle of check and balance between executive branches and legislative branches.
In the case study on the Incheon Metropolitan City Underpass Shopping Mall management and operation ordinance, the limitation of self-governing legislation was affirmed as the ordinance can only be enacted under the principle of primacy of the statutes. Therefore, in order to expand self-governing legislative power, it is necessary to consider various measures, such as guaranteeing and strengthening the right to enact ordinances, expanding local affairs and power delegation capable of enacting ordinances, dividing legislation between the state and local governments, and strengthening mutual checks and supplementary functions between local legislative councils and executive branches.
